Dear Mr. Waghorn:
The above - referenced site plan was approved on May 1, 2012. The site plan is approved for revisions to
the Rutherford Crossing Site Plan ( #55 -07) for the construction of a new Texas Roadhouse restaurant.
This new restaurant will be accessed via the existing internal road network within the development
(Market Street). Required site improvements include the following:
Construction of a 6,838 square foot restaurant building.
Construction and revision of the parking area around the proposed building (including the
construction of four handicap accessible), including curb and gutter, striping and handicap access.
This pad site has a total of 69 parking spaces dedicated for its use.
One loading space and one screened dumpster area.
Landscaping and lighting as shown on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to
contact me if you have any questions or concerns.

Dear Ms. Perkins:
Vanasse Hangen Brustlin, Inc. (VI -IB) has prepared this letter to provide responses to the comments
submitted by mail; regarding the Texas Roadhouse Restaurant at Rutherford Crossing, dated March 16,
2012.
I. Comment: Signed Application. The site plan application submitted with the plans was not
signed or dated; this needs to be completed prior to final approval.
Response: A signed and dated application is included with this submittal. A copy of this
signed application was also entailed to you on March 30, 2012.
2. Comment: Plan Sheets. It appears that many of the original site plan sheets submitted with this
site plan are unnecessary. '['his submission can consist of a new coversheet, the revised sheets
and the photometric plan, and can reference the original site plan for the additional details
(appears that only I I sheets are required for this submission).
Response: The number ofplan sheets hits been reduced peryour instructions.
3. Comment: Original Dumpster Area. Indicate what the area where the dumpsters were
originally supposed to be located will be used for. '
Response: The original ahunpster area is to rentain and will be paver.
4. Comment: Parking Lot Curb. The site plan shows a sidewalk flush with the parking lot, which
is not permitted. Curb and gutter is required (CG -6) unless a sidewalk with turndown curb is
utilized along the building (minimum 6 ").
Response: The parking lot curb has been altered so that there are only accessible parking
spaces adjacent to the flush curb.
5. Comment: Parking Space Size. There is a bay of parking spaces that measure 9'x 18' (162st); a
minimum of 180 sf is required for each parking space.
Response: All parking spaces are 9x20'.
6. Comment: Dumuster Screening. A detail for the dumpster screening needs to be provided
(minimurn 6' enclosure required).
Response: A detail for the dunepster screening has been added to the detail sheet The
screening is greater than 6' in height.

Comment: Loading Space. One loading space needs to be provided (this can be shared by 5D
and 5C).
Response: A 12'x 45' loading spaces has been added to the west side of the restaurant.
8. Comment: Landscaping Plan. The revised plan shows the removal of 13 trees; these trees need
to be accounted for on this site plan as they are required plantings. Also, these trees are required
to be deciduous and cannot be substituted for evergreen as proposed.
Response: The number and type of trees has been changer/ to nmtch the previously approver/
site plan (Tilia Cordata and Amelanchier Arhorea). The location of the trees has been
inmdified The evergreen trees are no longer being proposed.
Comment: Photometric Plan. The photometric plan sheet needs to be scaled and included with
the final site plan submission (approval sets).
Response: A photometric plan has been included and has been signed and sealed
10. Comment: Building 5C Site-The site for future Building 5C needs to be labeled as a future pad
site (since the revised plan doesn't show a building). A notes needs to be shown that states a
future site plan will be required for this pad site. The PIN number for this lot also needs to be
provided (PIN# 43- A- 100.1).
Response: A note has been added stating that a future site plan will be required_ for this pad
site. The PIN it tunber jor this lot has been provided as well (PIN# 43- A- IOOJ).
Five copies of the final site plans are included with this letter for approval along with the agency
comment sheets from the following agencies: the Frederick Counq, Inspections Department. the
Frederick County Frngineer, the Frederick County Fire Marshal, and the Frederick Countyy Sanitation
Authority.

Dear Mr. Waghorn:
Planning Staff has reviewed the above - referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied until
the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staff's comments listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments
1. Signed Application. The site plan application submitted with the plans was not signed or
dated; this needs to be completed prior to final approval.
2. Plan Sheets. It appears that many of the original site plan sheets submitted with this site plan
are unnecessary. This submission can consist of a new coversheet, the revised sheets and the
photometric plan, and can reference the original site plan for the additional details (appears
that only 1 I sheets are required for this submission).

10. Building 5C Site. The site for future Building 5C needs to be labeled as a future pad site
(since the revised plan doesn't show a building). A note needs to be shown that states a
future site plan will required for this pad site. The PIN number for this lot also needs to be
provided (PIN# 43- A- 100J).
After you have revised the site plan, please resubmit one copy so that 1 may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for approval. Comment sheets are required from the following agencies: the
Frederick County Inspections Department, the Frederick County Engineer, the Frederick County
Fire Marshal, and the Frederick County Sanitation Authority.
