Dear Ron:
The Frederick County Department of Planning and Development administratively approved the
above referenced site plan on September 29, 2011. This site plan is approved for the construction of
a Sheetz Gas Station and Carwash (demolition and rebuild) at 1683 Berryville Pike (Route 7) in the
Stonewall Magisterial District. Required site improvements include the following:
• Construction of the following: 6,561sf convenience store, 16 gasoline pumps under two
canopies and an 892sf carwash.
• Construction of a parking lot with 61 spaces (including three handicap accessible), including
curb and gutter, striping and handicap access.
• Relocated entrances on Route 7 and Regency Lakes Drive.
• Construction of sidewalks along Route 7 and Regency Lakes Drive.
• One screened dumpster area.
• Buffers, landscaping and lighting as shown on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with eight
(8) copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved
copy must be kept on the construction site throughout the development process. Once site
development is complete, the owner(s) should contact this office to schedule an on -site inspection.

Dear Ron:
Planning Staff has reviewed the above - referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff s comments listed below and prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Zoninlz District Buffer. On sheet 8, the zoning district buffer needs to be extended to incorporate
the portion of the property that was added to the Sheetz propery through a BLA. The fence also
needs to be shown on sheet 6.
2) Dumpster Details. On sheet 12, there is a note about the trash enclosure having slats for screening;
this is not permitted. The enclosure must be constructed with an opaque board -on -board fence or
masonry wall (or similar material).
3) Photometric Plan. The photometric plan needs to be revised as follows:
• Provide notations that all lighting fixtures are full cut -off fixtures.
Provide a detail for each lighting fixture that is shown in the luminaire schedule (catalog cuts
and illustrations by manufacturers can be submitted in lieu of showing the fixtures on the site
plan sheets).
a Show the property boundary on the photometric plan and ensure that the lighting levels do
not exceed 0.2 at the property boundary shared with the residential use.
The lighting levels for the canopy area cannot exceed an average maintained lighting level of
twenty (20) foot - candles — the plan shows an average of 30.
After you have revised the site plan, please resubmit two copies so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan
for approval. Comment sheets are required from the following agencies: the Virginia Department of
Transportation, the Frederick County, Inspections Department, the Frederick County Engineer, the Frederick
County Fire Marshal, and the Frederick County Sanitation Authority.

We have revised the Site Plan per your comments of April 26, 2011. I have attached two copies
here. Specific responses to each comment are as follows:
1. Special Limited Power ofAttorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to approval of this site plan. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them
for this site plan.
The Special Limited Power of Attorney is attached.
2. Photometric Plan. A photometric plan needs to be provided with this submission. Please
note that all outdoor lighting for this site needs to conform with x'165- 201 -07.
A photometric plan has been added to the plan set.
3. Sidewalk. A five foot sidewalk is required along the Route 7 frontage of the site and along
Regency Lakes Drive. Crosswalks also need to be shown for all entrances.
A 5' sidewalk and crosswalks have been added to the plans.
4. Existing Sign. The existing freestanding sign along Route 7 does not conform to the adopted
sign regulations and must be removed from this project. The site is permitted to have one
freestanding monument sign (25 feet in height /150 sf in size.)
As the use is not changing, we believe the sign may remain. All new signage shall comply
with current regulations.
5. Relocated Shed. The relocated shed along Regency Lakes Drive needs to be moved out of
the front setback area and out of the active distance buffer.
The shed has been relocated.

6. Parking Setbacks. The parking setback is ten feet off of the ROW.
The parking setback has been revised to 10' along the right -of -way.
7. Route 7 BRL. The BRL along Route 7 needs to show 50 feet.
The BRL along Route 7 has been revised to show 50'
8. Travel Aisle Width. Provide the travel aisle width as indicated on sheet 6 (from the end of
the parking spaces to the pump parking area.)
Travel aisle widths have been added to the plan.
9. Disturbed Area. Update the disturbed area to reflect the site plan application.
The disturbed area has been updated.
10. Carwash. Provide the total square footage of the carwash building.
The square footage of the carwash is now noted on the plan.
11. Parking Space Number. The total required parking number should be 33 spaces (unless a
breakdown of the building reflects a lesser number)
The parking tabulation has been revised. The wall was removed with a previous plan
iteration.
12. Inactive Buffer. The retaining wall is not permitted within the inactive buffer area; only
underground activities are permitted.
The label for the retaining wall has been removed.
13. Planting Schedule. On sheet 8, there are 34 trees shown on the site plan.
The tree quantities have been adjusted.
14. Evergreen Screening. Evergreen parking lot screening shrubs need to be provided as
indicated on sheet 8.
The parking lot screening has been revised to match what was proposed on sheet 8.
15. Zoning Ordinance Reference. On sheet 8, revise the Zoning Ordinance reference to reflect
the current,format.
The note has been revised.

16 Dumpster Details. The site plan shows dumpster gate details on sheets I1 and 12 (same
detail, different label); it appears that one can be removed. A detail for the dumpster
enclosure needs to be provided (masonry wall, etc.)
The extra gate detail has been removed from the plans; however the trash enclosure detail
was located on the top of sheet 12.
