Dear Jeremy:
The above - referenced site plan was approved on November 29, 2010. The site plan is approved for
the construction of a new 2,205 square foot daycare facility located at 4489 Martinsburg Pike in the
Stonewall Magisterial District. Required site improvements include the following:
• Construction of a parking lot with 14 spaces (including one handicap accessible), including
curb and gutter, striping and handicap access.
• A fenced outdoor play area.
• A ten foot paved bicycle path along Martinsburg Pike.
• Buffers and screening as indicated on sheet 4.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with
seven (7) copies of the approved site plan. Please forward these copies to the appropriate
representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference,
and an approved copy must be kept on the construction site throughout the development process.
Once site development is complete, the owner(s) should contact this office to schedule an on -site
inspection. Do not hesitate to contact me if you have any questions or concerns.

Dear Ms. Perkins:
We are in receipt of the comments dated November 9 "i, 2010 and offer the following responses:
Comments from Frederick County Planning
Comment 1: Setbacks. The side and rear setbacks shown on the coversheet are incorrect.
Response: Revised as noted.
Comment 2: Bike Path. The bike path needs to be shown as constructed on the site, not designed
by others and bonded.
Response: Revised as noted.
Comment 3: Zoning District Buffer. The existing building is located approximately 25 feet from
the southern property line. While the new building may be placed in the same area where the
existing structure is located, the parking area cannot infringe on the inactive buffer area.
Response: Revised as noted. Please note this comment had resulted in a redesign of the
parking lot configuration which in turn altered the grading concept. Per Frederick
County Zoning Ordinance Section 165- 202.0l.D.3.b we are implementing LID design
technique had have been approved by both Frederick County Public Works and the
Zoning administrator.
Comment 4: Curb and gutter. Curb and gutter (CG -6) needs to be provided; CG -2 is not
permitted.
Response: CG -2 with still be utilized on a portion if the front parking and around the building.

Comment 5: Lighting. Indicate if there will be any building - mounted lighting on the new
structure.
Response: Typical Residential Wall Latern's will be provided at each door way. See detail on
sheet 5.
Continent 6: Buffer Fence. The buffer fence needs to be extended as indicated on sheet 4.
Response: Revised as noted see detail sheet 5.
Comment 7: Buffer Plant Number and Location. It appears that the buffer distance is 2271f
and, therefore, 68 plants are required. The tree located in the bike path needs to be relocated.

Comment 8: Hedge Row. Evergreen shrubs need to be provided as indicated on sheet 4.

Thank you for the prompt response...... as you are correct LID is not being utilized for the front parking area due to the
design intent, the water is pitching away from the curb sheet flowing north into the grass swale on the opposite side of
the travel way , therefore the curb (CG -2) is only needed. If we put CG -6 (curb with standard Gutter) the water will not
drain properly, we would have to use a CG -6R design which is a reverse gutter pan, which really serves no purpose.
As for the rear parking were are utilizing concrete bumpers(wheel stops) along the perimeter of the asphalt area as
shown on the plan view and per the trench detail, this is in lieu of having to put the concrete bumpers (whieel stops) in
each parking stall.
Further I just want to clarify, If you still require the CG it will have to be a CG -6R and I just want to confirm that you are
only asking for it along the perimeter of the front parking, meaning in front on the building we can still utilize CG -2
correct?

Jeremy,
In response to your voicemail, the curb and gutter requirement along the front parking area cannot be waived. LID is
not being utilized in this area and it is inside of the SWSA, therefore a waiver is not possible (CG -6 is required). I spoke
with Mark and he only recalls talking about the rear portion of the parking area. Waiving the curb and gutter in the rear
is possible due to the infiltration trench being utilized — please note that wheelstops need to be installed along the
parking spaces. I should complete my review of the revised plan today and will let you know if I have anymore
comments.

Dear Jeremy:
Planning Staff has reviewed the above - referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staff's comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments
1. Setbacks. The side and rear setbacks shown on the coversheet are incorrect.

and bonded.

After you have revised the site plan, please resubmit two copies so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for approval.
