�11tt THIS DEED OF BOUNDARY LINE ADJUSTMENT, made and dated this
'T1 of September, 2005, by and between BLUR RIDGE ASSOCIATRS,
a Virginia General Partnership, hereinafter referred to as
"Blue Ridge ".
R E C I T A L S:
A. Blue Ridge is vested with fee simple title to that
certain lot or parcel of land, containing 73.12 acres, more or
less, situate on the South side of Route 7 (Harry Byrd
Highway / Winchester - Berryville Turnpike), in Red Bud Magisterial
District, Frederick County, Virginia; and being a portion of the
property conveyed to Blue Ridge Associates, a Virginia
Partnership; by Deed dated September 30, 2003, of record in the
('Clerk's Office of the Circuit Court of Frederick County,
.Virginia as Instrument No. 030022941. Tax Map No. 55- A -174C
( "Blua Ridge Parcel #1").
B. Blue Ridge is also vested with fee simple title to that
certain lot or parcel of land, containing 8.0092 acres, more or
less, situate South of Route 7 (Harry Byrd Highway/Winchester-
Berryville Turnpike) , in Red Bud Magisterial District, Frederick
iCounty, Virginia; and being a portion of the lands (Tract Five)
acquired by Blue Ridge Associates, a Virginia General
Partnership, by Deed dated June 20, 2000, of record in the
aforesaid Clerk's Office in Deed Book 968, at Page 1064. Tax
Map No. 55- A -174A ( "Blue Ridge Parcel #20).
C. Blue Ridge intends to adjust the boundary lines
between Blue Ridge Parcel #1 and Blue Ridge Parcel #2 in
'accordance with that certain plat titled "Plat Showing Boundary
Line Adjustment of the Properties of Blue Ridge Associates"
dated April 20, 2005, updated July 7, 2005, drawn by Cory M.

Haynes, L.S., a copy of which is attached hereto and
incorporated herein by reference as if set out in full (the "BLA
Plat^), so as to establish the boundary lines of Blue Ridge
Parcel #1, containing 62.6275 acres, and Blue Ridge Parcel #2,
containing 18.5017 acres, as more fully set forth hereinafter.
NOW, THEREFORE, WITNESSETH: That for and in consideration
of the premises conveyed, and other good and valuable
consideration deemed adequate at law, the receipt and
sufficiency of which is hereby acknowledged, the parties do
agree as follows:
1. The Recitals are incorporated herein and made a
material part hereof as if set out in full.
2. Blue Ridge hereby adjusts and confirms the boundary
lines of Blue Ridge Parcel #1, containing 62.6275 acres, as more
particularly set forth on the attached BLA Plat.
3. Blue Ridge hereby adjusts and confirms the boundary
lines of Blue Ridge Parcel #2, containing 18.5017 acres, as more
particularly set forth on the attached BLA Plat.
4. This adjustment of the boundary lines of Blue Ridge
Parcel #1 and Blue Ridge Parcel #2 is made subject to all
easements, rights of way and restrictions of record affecting
the subject properties; provided, however, that the foregoing
shall not be deemed in any way to reinstitute or republish any
restrictions of record that may have expired or lapsed.
