The site plan is approved for the construction of Berm B located on the Carmeuse Natural Chemicals Site in the Back Creek Magisterial District. Berm plantings shall be in conformance with sheet 4 of the site plan. All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including review agency comments from all relevant review agencies. I am providing you with five (5) copies of the approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction site throughout the development process. Once site development is complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or concerns. The archeological survey was conducted and completed by Dr, Gcicr who is a professor at Jaynes Madison University'. The work that was done exceeded the request of a Phase 1, including the digging of test pits and retrieving artifacts. To my know!edge. those artifacts have been removed and are currentiy witfi Dr. Geier at James ma(lisoa i. oiversty. From here- we understand there will be a further analysis of what- was observed at and rerwv d from the site. My general understanding of the work is that Dr. Geier was particularly interested in confirming previous writings which have Mated the events and movements of I-)01's t11at. NOV 1 4 2010 We have revised the plans per your comments as noted below. I have enclosed two sets of plans for your review and approval. 1)e ial Limited Power o Attorney Form. Please have the property owner sign the attached Special Is'mited Power ofAttorney Form prior to further review or approval This form should be notarized and completed to grant the applicant (you) with authorization to represent them far this site plan. Carmeuse has asked that this form not be signed until the County is prepared to issue the approved plans. 2) Berm Location. The coversheet indicates that the berm is on parcel 90-A-23; however, the key map has a proposed berm located on parcel 90 A -2 (appears to be part of Berm A). The detail on sheet 3 is also unclear where Berm B is actually located. On the key map, the berm location needs to be clarified (bubble the berm area) and the location of Berm A needs to be shown as well Sheets one and two have been updated as requested. 3) Prober4 Boundaries. The boundaties jorparrel90A -23 need to beprovided on sheet 2. Boundary information has been provided for the rezoned parcel. I have attached a copy of the plat for the rezoned area which shows the entire parcel (90 -A -23) which extends into Shenandoah County. 4) Soil Stockpiles. Indicate if the existing soil stockpile height has been reduced as required by proffer 2.3. Much of the existing stockpile will be used to construct Berm B. This will be completed prior to the 2013 deadline required in the proffer. 5) Landscgino Notes. On sheet 4, revise the landscaping notes to include the new code references. Notes have been revised to show the new reference. 6) Phase I Arrheological Surveq. Provide documentation that the Phase I archeological survey has been completed on parcel 90-A- 23. I have attached a copy of a letter from Carmeuse which was delivered to the County Planning offices on May 28, 2009. have also included the Department of Forestry, Inspections and Public Works comment sheets. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staff s comments listed below and prepare a revised site plan which adequately addresses each concern. Review Comments: 1) Special Limited Power of Attorney Form. Please have the property owner sign the attached Special Limited Power of Attorney Form prior to further review or approval. This form should be notarized and completed to grant the applicant (you) with authorization to represent them for this site plan. 2) Berm Location.
