Dear John:
The above - referenced site plan was approved on September 29, 2010. The site plan is approved for the
construction of a new trailer parking area for the Kohl's Distribution facility located on Admiral Byrd
Drive in the Airport Business Park in the Shawnee Magisterial District. Required site improvements
include the following:
• Construction of a trailer parking lot with 312 spaces, including curb and gutter, and striping.
• Landscaping and lighting as shown on the plan.
• Paving of the trailer parking area previously approved with Site Plan 462 -07.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to
contact me if you have any questions or concerns.

Re: Review Comments for Site Plan #13 -10; Kohl's Distribution — Trailer Storage

Dear John:
Planning Staff has reviewed the above - referenced site plan to determine if administrative approval can be granted.
At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as
well as all issues of the other review agencies, have been adequately addressed. Please review Staff's comments
listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
i
1) ✓Special Limited Power of Attorney Form. Please have the property owner sign the attached Special
Limited Power of Attorney Form prior to further review or approval. This form should be notarized and
completed to grant the applicant (you) with authorization to represent them for this site plan.
2) dBLA. The Boundary Line Adjustment (BLA) needs to be completed before the site plan can be approved.
3) Notes. The following notes need to be provided: (1) All outdoor lighting must be shielded to prevent
glare onto adjoining properties and road right -of -ways; and, (2) All utilities must be underground.
4) Approved Site Plan. On the coversheet under general notes, change SP 431 -99 to 403 -01.
5) Previous Site Work. Please note that the previously installed trailer storage spaces that were approved
with SP462 -07 need to be paved in conjunction with the new trailer storage expansion.
6) Alternate curb location. Sheet 2 shows both alternatives, which is confusing. The preferred
configuration should be shown on the main site plan on sheet 3 and the alternate in a separate location
(possibly in a box at the top of sheet 3).
7) Lighting Height. Sheet 12 shows the proposed pole lighting to be 39 feet in height. The Zoning
Administrator may allow lighting in the M 1 district to be up to 45 feet in height provided that additional
security is needed. If only trailers are intended to be stored (and no product), it is unclear why a higher
pole height is necessary. Also, indicate if the six foot light base has been added into the proposed pole
height.
8) Photometric Plan. A detail of the site lighting fixture needs to be provided on the photometric plan.
9) Existing Easements. Provide the legal reference for all existing easements.
10) Islands. Indicate on sheet 3 that the islands at the end of the parking are striped islands.
11) Landscaping Plan. The Landscaping plan needs to show one deciduous tree per 20 feet, not 40 feet.

After you have revised the site plan; please resubmit one copy so that I may verify the information contained on the
plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: the Frederick County Inspections Department, the
Frederick County Fire Alai-shut, and the Frederick County Sanitation Authority.

FYI- I've spoken with John Lewis regarding Kohl's trailer parking lot. After our extended discussions, they are submitting
a site plan with asphalt parking. A single row of evergreen trees will be provided along the southern parking lot to
complement the ZDB against the RP (credit is given for the MDP environmental corridor and distance). And a deciduous
tree will be planted every 20 ft on the west and north edge of the parking lot. The northern edge tree planting will be
filling the gaps that might exist from previously planted trees. See me with questions. I have not discussed any
deviation from C /G. Thanks.
