of which are hereby acknowledged, the Grantors do grant unto the Grantee, with general
warranty of title, all that certain lot, situate in Stonewall District, Frederick County,
.Virginia, on the East side of U. S. Route ry11, and being more particularly described in
a plat and survey made by 'Walker Yee. Bond September 29, 1947, which plat and survey are
hereto attached and made a part of this deed.
This is a part of the same tract of land of which Isaac
Stine died seised and possessed and which passed by his last will and testament, of record
in the office of the Clerk of the Circuit Court of Frederick County, Virginia, in Will
Book 43, at page 139, to hunter M. Stine for life, and then to the .children of hunter M.
Stine in fee. bunter M. Stine is dead, and the Grantors are all of the children of
hunter E. Stine. For a further description of said property reference is made to the
attached plat and said will.
The Spouses join in this deed for the purpose of relin-
quishing their rights to dower and curtesy therein, and to that end do grant and convey
unto the Grantee all of their right, title and interest in and to said lot.
This conveyance is made subject to the following re-
strictions, which restrictions are made covenants real running with the land, and are for
the benefit of the remaining land of which the Grantors acquired possession under the said
will of Isaac Stine, and which is located along U. S. Route 11, part of which land has
.heretofore been conveyed in lots, and the remainer of which is still held by the Grantors.
For the purpose of binding herself, her heirs, executors and assigns to these restrictions,
the Grantee ,joins in this deed.
1. The lot hereby conveyed, and all buildings erected
thereon, shall be used only as a private dwelling for one family, and such buildings as

may be erected thereon shall not be used for boarding houses, apartment houses, tenement
;houses, or for any business purposes, except that of operating a tourist house. This
;covenant shall not prevent the owner of this lot from erecting and using such:detached
;buildings as are customarily used in conjunction with a private dwelling, such as a garage.
2. before the lot hereby conveyed may be used for
;residential purposes, a septic tank for sewage disposal shall be erected and maintained
thereon, such tank to meet the Virginia State requirements.
3. No dwelling may be erected upon the lot hereby con
;veyed unless the cost thereof shall be more than $5,000.00.
4. No livestock, except poultry for home use, and
domestic pets such as dogs and cats, may be kept on the lot.
5. Not more than one dwelling shall be erected on this
lot.
6. This lot shall not be occupied, sold, leased or
rented to any negro or person of negro descent.
7. No building shall be erected and located on said lot
within 75 feet of the property line along U. S. Route #11.
The Grantors covenant that they have the right to con
vey said lot to the Grantee; that the Grantee shall have quiet possession thereof, free
from encumbrances; that they have done no act to encumber the same and that they will
execute such further assurances of title as may be requisite.
