My firm represents BPG Properties, Ltd., in connection with the rezoning from RA
to B -3 of TM #'s 33 -A -109 and 33 -A -110. This case is schedule for a public hearing
before the Frederick County Planning Commission on August 6, 2008.
We have spoken to Eric Lawrence, Director, Department of Planning and Development,
and understand that the Planning Commission's packet for the August 6 th meeting has been
dispatched. BPG has been in discussions with various County officials, and pursuant to those
discussions, has agreed to modify the Proffer Statement. Pursuant to Mr. Lawrence's
recommendation, we are enclosing a clean version of a Proffer Statement with a revision date of
July 21, 2008, and a blackline version of the Proffer Statement reflecting the changes made to the
Proffer Statement dated June 19, 2008.

we have sent to the County which Eric has now received.
The blackline shows our changes to the original proffers dated June 19, 2008, submitted with
the application.
We are also sending these proffers to each individual Planning Commission Member.
We will not be changing the proffers further between now and the Commission's meeting on
August 6th.
The changes to the version you last received are to address comments we received regarding
sharing in the cost of relocating the entrance to the site.

Enclosed please find a signed Proffer Statement associated with the above referenced
case dated June 19, 2008, with a revision date of July 3, 2008. We are submitting these pursuant
to the request of Mr. Ruddy and the Department's standard practice.
Also enclosed is an unsigned Proffer Statement dated June 19, 2008, with a revision date
of July 21, 2008. I have also enclosed a blackline version of the Proffer Statement reflecting the
changes made to the enclosed signed Proffer Statement. BPG Properties, Ltd. has agreed to
share in the costs associated with constructing the future entrance to the property that would
align with Branson Spring Road. Proffers 3.3 and 3.4 have been revised accordingly.
We are going to wait to submit another signed Proffer Statement until just prior to the
Board hearing because, as you know, there may be a need to further revise the Statement.

E. Sewage Conveyance and Water Supply
The I -81 Distribution Center site exists within the designated SWSA of Frederick
County (see Figure 5). The FCSA has confirmed that they will provide water and
sewer service to the site.
A newly constructed 6 -inch sanitary forcemain has been installed along the easterly
side of Route 11. An on -site sanitary pumping station will be constructed for direct
connection to the forcemain. There are no known limiting factors for the conveyance
of sewage and sewage treatment from this property. Capacity and daily usage will be
addressed at the time of site plan submission.
Potable water and fire protection will be supplied via the 12 -inch water line located
along the easterly side of Route 11.
The impact of the additional use created by this rezoning is acceptable and
manageable. Figure 6 shows the locations of utility infrastructure planned in this
phase of development.
