(10) Buyer agrees that within two years it will break ground for the relocation of a terminal building on the property, having one face toward the new road. Should Buyer not do so, or not complete said terminal within a reasonable period of time thereafter, it will reconvey the property to Seiler at no expense to the Seller, other than the repayment of $148,000.00 to Buyer by Seller. This reconveyance shall be subject to Federal Aviation Administration approval. (11) Seller agrees to dedicate a 50 foot right -of -way for a transition road from present Bufflick Road to the new road adjacent to northwesterly line of subject property. The Buyer agrees to dedicate sufficient road for the turning -3- • • (B) One Hundred Forty -Seven Thousand Dollars ($147,000) shall be paid at the time of the closing. (3) The parties agree to cooperate togethei to obtain necessary subdivision, zoning, and other regulatory approval for the sale of the property. (4) Delivery of the deed, the balance of the purchase price, and the possession of the property shall take place within 60 days of the obtention of subdivision and other regulatory approvals necessary for the sale of the property, and the contingencies contained in this agreement. (5) Buyer shall have the right to have the title to the above - described real estate examined at his own expense. If any defect in title is found which will prevent the title from being marketable and /or insurable, and such defect is not cured by Sellers within ninety (90) days after written notice from Buyer or Buyer's attorney, Buyer shall thereupon have the right to void this contract and have the deposit immediately returned to the Buyer. Sellers agree to convey to Buyer the subject real estate by a good and sufficient deed with General Warranty and English Covenants of Title, prepared at Sellers' expense, with the Sellers paying the State transfer tax. Upon written notification to the Sellers by the Buyer, the Sellers agree to deliver a deed to Winchester Regional Airport Authority, as assignee of Buyer's rights hereunder.
