This letter serves to confirm action taken by the Frederick County Board of Supervisors at their
meeting of May 14, 2008. The above - referenced application was approved to rezone property to the
RA (Rural Areas) District as follows: 0.21 acres of 1.29 acres, PIN 464- A -39A, from MI (Light
Industrial) District; 21.11 acres, PIN #64- A -40B, from Ml District; and, 15.92 acres of 229.05 acres,
PIN 464 -A -79, from R4 (Residential Planned Community) District. The properties are located on the
north side of the Winchester Airport and on the south side of the Airport, adjacentto Airport Road (Route
645) and Bufflick Road (Route 776), in the Shawnee Magisterial District.

Planning Commission and the Board of Supervisors to assist them in making a decision on this
application. It may also be useful to others interested in this zoning matter. Unresolved issues
concerning this application are noted by staff where relevant throughout this staff report.

PROPOSAL To rezone property to the RA (Rural Areas) zoning classification as follows: 0.21 acres of
1.29 acres, PIN #64- A -39A, from MI (Light Industrial) District; 2l .11 acres, PIN 464- A -40B, from M1
District; and, 15.92 acres of 229.05 acres, PIN #64 -A -79, from R4 (Residential Planned Community)
District. A total of 37.4 acres is to be rezoned to the RA District.
LOCATION These properties are located on the north side of the Winchester Airport and on the
south side of the Airport, adjacent to Airport Road (Route 645) and Bufflick Road (Route 776).

Planning & Zoninff:
I ) Site History
The site for which the rezoning is being requested is the location of the Winchester Regional
Airport. The Winchester Regional Airport is specifically recognized as a permitted use within
the Rural Areas zoning district as it has been in operation at this site since before the Frederick
County adopted its first Zoning Ordinance. Over time, the Winchester Regional Airport has
grown consistent with the growth of the community. To accommodate this growth, the
Winchester Regional Airport Authority has purchased additional property and portions of
property from the properties surrounding the facility. This is expected to continue in the future.
Several areas of land that has been purchased by the Winchester Regional Airport contain a
different zoning classification than the majority of the land owned by the Winchester Regional
Airport. It is the desire of the Winchester Regional Airport to have a consistent zoning
designation for their property and to ultimately consolidate their multiple properties into their
main parcel. The land containing the different zoning classifications was previously part of
several projects whose rezoning was approved by the Board of Supervisors. These include
Govenor's Hill, Airport Business Center, and Wilson's Industrial Project.
2) Comprehensive Policy Plan
The Frederick County Comprehensive Policy Plan is an official public document that serves as
the community's guide for making decisions regarding development, preservation, public
facilities and other key components of community life. The primary goal of this plan is to
protect and improve the living environment within Frederick County. It is in essence a
composition of policies used to plan for the future physical development of Frederick County.

Land Use
The site is located in the Sewer and Water Service Area (SWSA) and outside the Urban
Development Area (UDA). The site is within the limits of the Eastern Frederick County Long
Range Land Use Plan. The plan shows the majority of the rezoning within the Airport Support
Area. The Winchester Regional Airport is specifically recognized as a permitted use within the
Rural Areas zoning district. Further, the Airport Support Area is designed to specifically
recognize and support the unique characteristics of the area encompassing and surrounding the
Winchester Regional Airport.
The rezoning of this property will further ensure its protection as the Winchester Regional
Airport site and provide for the consistent administration of the property owned and operated by
the Winchester Regional Airport.,
Potential Impacts: No impacts are anticipated. This is an extremely positive rezoning request
that minimizes potential future impacts, promotes the permitted land use of the property as the
Winchester Regional Airport and addresses the Comprehensive Policy Plan.

STAFF CONCLUSIONS FOR 04/02/08 PLANNING COMMISSION MEETING:
The land use proposed in this application is consistent with the Comprehensive Policy Plan, as
described in the Eastern Frederick County Long Range Land Use Plan. Other elements that make this a
positive rezoning include: the ability to have a consistent zoning classification for the Winchester
Regional Airport, and the designation as a specific permitted use within the rural area zoning district.
The rezoning proposal supports the Airport Support Area, as well as further supporting operations of the
Winchester Regional Airport within the County.
PLANNING COMMISSION SUMMARY AND ACTION OF THE 04/02/08 MEETING
The Executive Director /Manager of the Winchester Regional Airport, Serena "Renny Manuel, stated
that this rezoning application represents a desire of the airport to have a consistent zoning designation
for their property, and ultimately, to consolidate into one contiguous property. She said the rezoning
will provide the airport with more development room because future construction of hangers would
require less of a setback from the road.
No one came forward to speak during the public comment portion of the hearing.
Commission members asked the staff if the rezoning would create any impacts to adjacent businesses,
such as requiring additional buffers and screening. Staff replied that no impacts to adjacent businesses
would be generated.
The Planning Commission unanimously recommended approval of the rezoning. (Note:
Commissioners Triplett and Kriz were absent from the meeting.)
STAFF UPDATE FOR 05 /14/08 BOARD OF SUPERVISORS MEETING:
The land use proposed in this application is consistent with the Comprehensive Policy Plan, as

Regional Airport, and the designation as a specific permitted use within the rural area zoning district.

recommended approval of the rezoning.
Following the required public hearing, a decision regarding this rezoning application by the
Board of Supervisors would be appropriate. The applicant should be prepared to adequately
address all concerns raised by the Board of Supervisors.

® The rezoning request from the Winchester Regional Airport Authority is a down zoning
request. Once approved, the Airport's property would require lower standards for
development in the area and reduce traffic to the area impacted. As such, we request a
waiver to the requirement for an Impact Analysis Statement.

PROPOSAL To rezone property to the RA (Rural Areas) zoning classification as follows: 0.21 acr
1.29 acres, PIN 464- A -39A, from Ml (Light Industrial) District; 21.11 acres, PIN 464- A -40B, frorr
District; and, 15.92 acres of 229.05 acres, PIN 464 -A -79, from R4 (Residential Planned Commu
District. A total of 37.4 acres is to be rezoned to the RA District.
LOCATION These properties are located on the north side of the Winchester Airport and on tl
south side of the Airport, adjacent to Airport Road (Route 645) and Bufflick Road (Route 776).

Planning & Zoning:
1) Site History
The site for which the rezoning is being requested is the location of the Winchester Region
Airport. The Winchester Regional Airport is specifically recognized as a permitted use with
the Rural Areas zoning district as it has been in operation at this site since before the Frederi(
County adopted its first Zoning Ordinance. Over time, the Winchester Regional Airport h;
grown consistent with the growth of the community. To accommodate this growth, tI
Winchester Regional Airport Authority has purchased additional property and portions i
property from the properties surrounding the facility. This is expected to continue in the Putur
Several areas of land that has been purchased by the Winchester Regional Airport contain
different zoning classification than the majority of the land owned by the Winchester Region
Airport. It is the desire of the Winchester Regional Airport to have a consistent zonir
designation for their property and to ultimately consolidate their multiple properties into the
main parcel. The land containing the different zoning classifications was previously part t
several projects whose rezoning was approved by the Board of Supervisors. These inclu(
Governer's Hill, Airport Business Center, and Wilson's Industrial Project.
2) Comprehensive Policv Plan
The Frederick County Comprehensive Policy Plan is an official public document that serves <
the community's guide for making decisions regarding development, preservation, publ
facilities and other key components of community life. The primary goal of this plan is 1
protect and improve the living environment within Frederick County. It is in essence
composition of policies used to plan for the future physical development of Frederick Count
[Comprehensive Policy Plan, p. 1 -1]
Lund Use
The site is located in the Sewer and Water Service Area (SWSA) and outside the Urbe
Development Area (UDA). The site is within the limits of the Eastern Frederick County Lor
Range Land Use Plan. The plan shows the majority of the rezoning within the Airport Suppo
Area. The Winchester Regional Airport is specifically recognized as apermitted use within if
Rural Areas zoning district. Further, the Airport Support Area is designed to specifrcall
recognize and support the unique characteristics of the area encompassing and surrounding tI
Winchester Regional Airport.
The rezoning of this property will further ensure its protection as the Winchester Region
Airport site and provide for the consistent administration of the property owned and operated h
the Winchester Regional Airport.
Potential Impacts: No impacts are anticipated. This is an extremely positive rezoning reque
that minimizes potential future impacts, promotes the permitted land use of the property as th
Winchester Regional Airport and addresses the Comprehensive Policy Plan.

STAFF CONCLUSIONS FOR 04/02/08 PLANNING COMMISSION MEETING:
The land use proposed in this application is consistent with the Comprehensive Policy Plan,
described in the Eastern Frederick County Long Range Land Use Plan. Other elements that make this
positive rezoning include: the ability to have a consistent zoning classification for the Wincheste
Regional Airport, and the designation as a specific permitted use within the rural area zoning distric
The rezoning proposal supports the Airport Support Area, as well as further supporting operations of th
Winchester Regional Airport within the County.
A recommendation by the Planning Commission to the Board of Supervisors concerning this
rezoning application would be appropriate. The applicant should be prepared to adequately
address all concerns raised by the Planning Commission.
