RE: Landscape screen agreement for REZONING #11 -07
Dear Mr. Lewis
During our phone conversations I expressed concerns about the landscape screen for my property to alleviate
headlight glare from the proposed pharmacy driveway. Then I returned your landscape screen agreement with
these same concerns written on the document addressing the wording "general conformance ". My request is
that in place of the words "general conformance" in the landscape screen agreement I would like the following
concerns listed in the document. First, the placement of the landscape screen must be far enough away from my
sewer line in order to avoid any problems with the plants' root systems growing into the sewer line. Second, the
installation of the screen must not disturb my existing flower garden in placement or during the planting of the
screen. Third, the height of the plant should be determined if and when the need for the screen arises. I would
prefer the height of the plant used to be the minimum needed to screen from the headlights. And last, the plant
must not contain berries or have a smell. I want to make sure that if the need for this screen arises I have these
conditions listed in the document to avoid any difficulties in obtaining the installation.

Dear Ms. Kerns:
I have made revisions to the screening plan to reflect our recent telephone conversation. At-
tached, you will find an exhibit titled "Kerns Landscape Screen ", dated 12/13/07. Your sug-
gestion that the screen be installed only after an evaluation of the impact from headlight glare
from the proposed commercial development across Greenwood Road is a good idea. In the
event that this rezoning is approved and the project moves forward, I will put a note on the
site plan for the commercial development that gives you the right to have the screen installed
upon your request. This request must be made within 12 months of the date of the opening of
the store. T he screen will be installed in general conformance with the attached exhibit.
If this agreement is acceptable to you, please sign in the appropriate location. I have included
two copies of this letter so that you may keep one for your files. I will provide a signed copy to
Frederick County Department of Planning and Zoning for their permanent file.

RE: 1932 SENSENY ROAD REZONING APPLICATION
Dear Mike:
In response to the planning commissions' decision to table this project at the November 7
meeting, I am forwarding to you two exhibits: 1) the architect's rendering of the proposed
building elevations, and 2) the site layout and crossing plan for Senseny Road. I believe that
the reasons for the tabling of the project were requests to review the architectural finish of the
building and the arrangement of the pedestrian crossing on Senseny Road. If I am mistaken
about the reasons for the tabling, please let me know.
It is my understanding that the realtor who represents Ervin Development Corporation is ar-
ranging a meeting with members of the Planning Commission for December 4. If this meet-
ing doesn't occur, I will be back in touch with you to arrange other meeting dates.

Dear Michael,
I am in receipt of your letter informing property owners of the November 7, 2007
meeting in regard to Rezoning Application 11 -07. I am the managing agent for Tom Glass
who owns Country Park Shopping Center at 1855 Senseny Road. Mr. Glass was out of town
and I had a Frederick County School Board meeting which prohibited us from attending this
meeting.
Mr. Glass does not oppose this rezoning application. However, he is concerned that
additional traffic at this intersection could have an impact on his frontage on Greenwood
Road. BB &T wished to add an additional drive -thru window at his center and was told by
Mark that they could not build because of the planned widening of Greenwood Road with a
right -hand turn lane. This was new to both Mr. Glass and myself. He has lost possible rental
income as a result of this statement.
After reviewing my letter, I would appreciate a call to discuss what exactly is planned
for Greenwood Road.
