RE: Shenandoah - Oak Ridge Rezoning Application.
Dear Patrick:
On June 26, 2007, you submitted the above referenced rezoning application to this
department. As you were aware, this request was incomplete based on Section 165 -75 of
the Frederick County Zoning Ordinance which requires the submission of an MDP with
the rezoning. This incomplete application was returned to you and a refund check in the
amount $8,310.00 was also returned to your office. The refund check was issued by the
Frederick County Treasurer on July 7, 2007.
On August 10, 2007, you provided this office with a revised proffer statement for the
Shenandoah — Oak Ridge rezoning application and a revised Master Development Plan
for the Shenandoah project. Based upon this Office's review of the information
submitted, the rezoning application remains incomplete. The Zoning Ordinance states
that in order to have land rezoned to the R5 Residential Recreational Community District,
a master development plan, meeting all the requirements of Article XVIII of the Zoning
Ordinance, shall be submitted with the rezoning application. It is important and
necessary to provide a Master Development Plan, including application and fees, that has
been reviewed and approved by all of the reviewing agencies, including Planning and
Development, and meets all of the requirements of the County's Ordinances. The Master
Development Plan submitted may be accepted as a condition proffered for the rezoning.
The check that you submitted to this office on September 7, 2007 in the amount of
$8,310.00 is being returned to you with this letter as the rezoning application is still
incomplete. Please feel free to contact me if you have any questions or need any

department. A more detailed review of your submission has highlighted that this request
is incomplete based on Section 165 -75 of the Frederick County Zoning Ordinance which
requires the submission of an MDP with the rezoning. The MDP requirement was pointed
out, among other items, in the initial review by Susan Eddy, Principal Planner.
This incomplete application is being returned to you and has been removed from the
upcoming Planning Commission agenda. A refund check in the amount $8,310.00 is
being processed and will be returned to your attention. I apologize for not recognizing
that this was not a complete application earlier.
