Subject: Shenandoah /Oak Ridge Development - Route 522, Frederick County
The documentation within the application to rezone this property appears to have a
measurable impact on Routes 522, 636 and 277. These route are the VDOT roadways which
have been considered as the access to the property referenced.
VDOT is satisfied that the transportation proffers offered in the Shenandoah /Oak Ridge
Development Rezoning Application dated January 3, 2007 (revised April 19, 2007) addresses
transportation concerns associated with this request.
Before development, this office will require a complete set of construction plans
detailing entrance designs, drainage features, and traffic flow data from the I.T.E. Trip
Generation Manual, Seventh Edition for review. VDOT reserves the right to comment on all
right -of -way needs, including right -of -way dedications, traffic signalization, and off -
site roadway improvements and drainage. Any work performed on the State's right -of -way
must be covered under a land use permit. This permit is issued by this office and
requires an inspection fee and surety bond coverage.

SUBJECT: COMMENT LETTER - SHENANDOAH —OAK RIDGE PROPERTY
The comment I have relates to the Sewer Conveyance and Water Supply section of the
application. In that section, there is discussion about the Crooked Run Wastewater
Treatment Plant and its design and permit limits, which are accurate. However, it does
mention that, "Should future needs dictate an expansion of the treatment plant, it is possible
for the plant to be permitted to treat up to 600,000 gallons of water per day." This is only
partially true because, exceeding the 500,000 gallon per day threshold, will make this a
significant discharge facility; and, if I am correct in my interpretation of the Bay Regulations,
it would require that the treatment facility acquire nutrient tradeoffs or offsets to exceed its
present permitted amount of 250,000. This would be something that would have to be
considered in an expansion and the acquiring of the nutrient allocations, which could, in fact,
limit the size of expansion or if any expansion could occur without additional cost beyond
infrastructure.

Shenandoah -Oak Ridge Property; PIN # 85- A -273D
Dear Mr. Sowers:
Upon review of the proposed rezoning, it appears that the proposal does not significantly
impact historic resources and it is not necessary to schedule a fom7al review of the
rezoning application by the HRAB. According to the Rural Landmarks Survey, there are
no significant historic structures located on the properties nor are there any possible
historic districts in the vicinity. It was also noted that the National Park Service Study of
Civil War Sites in the Shenandoah Valley does identify a core battlefield within this area.

Therefore, under this Proffer Statement, all 160 single - family dwelling units could
be single - family, attached dwelling units.
3. With respect to Proffer 9.1, which provides for a minimum of two -
road access to Rachel Carlson Drive, it should be noted that the property which is the
subject of the rezoning does not front on Rachel Carlson Drive. In addition, the strip
of land located between Rachel Carlson Drive and the subject property is under
different entity ownership than the subject property. There is no information in the
proffers as to how access will be obtained, and whether the access will be by private
road or public road.
4. In Proffer 9.4, I would recommend that the proffered contributions
be for "design and/or construction of transportation improvements ... ".
5. As a clerical matter, it is noted that in the cover sheet of this Proffer
Statement the owner is identified as "Oakridge Properties, Inc. The proper corporate
name for the owner is "Oak Ridge Properties, Inc. ". The signature block at the end
of the Proffer Statement has the correct corporate name.
It should be noted that I have not reviewed the substance of the proffers as to
whether the proffers are suitable and appropriate for the rezoning of this specific
property, or whether other proffers would be appropriate, as it is my understanding
that that review will be done by the staff and the Planning Commission.

RE: Proposed Rezoning of the Shenandoah -Oak Ridge Property
Dear Patrick:
I have had the opportunity to review the draft rezoning application for the Shenandoah -
Oak Ridge Property. This application seeks to rezone 52.6 acres of land from the RA
(Rural Areas) District to the R5 (Residential Recreational Community) District. Staff's
review comments are listed below for your consideration.
I. Comprehensive Policy Plan. The site is not within the limits of any small area
land use plans. The Eastern Frederick County Long Range Land Use Plan
identifies the site as a rural area. The Comprehensive Plan specifically calls for
the preservation of rural areas. The plan does not identify the site for residential
use. The proposed rezoning for residential use is contrary to the Comprehensive
Policy Plan.
2. Comprehensive Policy Plan. The site is outside of the Urban Development Area
(UDA) and Sewer and Water Services Area (SWSA). The Comprehensive Policy
Plan confines urban development, such as this proposal, to the UDA. The
proposed development is outside of the UDA and is therefore not in conformance
with the Comprehensive Policy Plan. The applicant should first seek to have the
site brought into the UDA through a Comprehensive Policy Plan amendment
request. The assertions in the applicant's impact statement that "the UDA and
SWSA were established as the intended boundary for residential development by
the service area of the Opequon and Parkins Mill Wastewater Treatment Plants"
and "the SWSA/UDA concept does not apply to this rezoning application" have
no foundation. These assertions are never stated or even implied in the
Comprehensive Policy Plan.
3. Comprehensive Policy Plan. The policies in the Community Services and
Facilities Chapter of the Comprehensive Policy Plan reiterate the policies in the

Land Use Chapter. "The intention is that additional extensions of sewer and
water services will reflect the boundaries of the Urban Development Area. The
extension of mains into areas not included in sewer and water service areas
described by the facilities plan will require an amendment to the Comprehensive
Plan. In this way, the County will maintain an orderly process of development."

4. Legal Agreement. The legal agreement between the Frederick County Sanitation
Authority, the Frederick - Winchester Service Authority and Dogwood
Development Group LLC provided with this preliminary application, is of
interest, but is not relevant for this proposed rezoning. Through the agreement,
the three parties established a procedure for designing, constructing and financing
a water distribution system, a sewer collection system and a wastewater treatment
plant to serve Shenandoah and what has been called in the agreement the Crooked
Run Sewer Service Area. The site of this proposed rezoning is not in the
Shenandoah Development, nor is it in the Crooked Run Sewer Service Area.
Expansion of the Crooked Run Sewer Service Area would be a policy decision of
the Frederick County Board of Supervisors. Section 1 b of the agreement permits
the developer to expand the wastewater system to provide treatment capacity to
complete development of Shenandoah as currently planned and approved and as
the same may be enlarged and expanded in the future. This in no way guarantees
approval by the Board of Supervisors for any expansion of Shenandoah.
5. Comprehensive Policy Plan. The Comprehensive Plan calls for Level of Service
(LOS) Category C or better on roads impacted by new development. The Traffic
Impact Analysis (TIA) indicates that Level of Service C will not be maintained at
the intersection of Fairfax Pike (Routes 277) and Hudson Hollow Road (Route
636) and Fairfax Pike and Front Royal Pike (Route 522). While it may be true
that background traffic alone warrants these transportation improvements, the
County should riot be rezoning property that will exacerbate failing situations. It
is worth noting that much of the background traffic is from the Shenandoah
Development. This was rezoned in 1975 (Rezoning #173: Wheatlands) and no
transportation proffers are associated with that rezoning.
6. R5 Residential Recreational Community District. The purpose of the R5
District is to protect and preserve natural and historic resources and features and
protect and enhance the natural scenic value of the area to be developed. This
application in no way addresses these key factors.
7. RS Residential Recreational Community District. The Zoning Ordinance
( §165 -75) requires the submission of a master development with every rezoning

request to the R5 District. Please provide the Master Development Plan for
preliminary review.
8. Traffic Impact Analysis. The Traffic Impact Analysis (TIA) was based on 160
single family attached units. It should be based on 160 single family detached
units, as only the cap of 160 units is proffered. Since the housing type is not
limited, the housing type with the largest traffic generation should be modeled.
The TIA appears to show incorrect existing traffic on Hudson Hollow Road
(Route 636). The figure is too high; please verify. In addition, the background
traffic should include Cedar Meadows on White Oak Road.
9. Proffer Statement — The applicant has proffered a monetary contribution of
$1,000 per single family attached unit and $2,000 per single family detached unit
for transportation improvements. The total contribution may be as little as
$160,000. This is not enough to install one traffic signal. Given the
improvements needed as per page 17 of the TIA, the monetary contribution will
do little to affect the failing levels of service in this area and further fail to
adequately mitigate the impact of this development.
10. Proffer Statement — A minimum of two entrances are proffered on Rachel
Carson Drive. In the interest of good access management, a maximum of two
entrances would be more acceptable, and these should be lined up with existing
intersections on Rachel Carson Drive.
11. Agency Comments. Please provide appropriate agency comments from the
following agencies: Historic Resources Advisory Board Virginia Department of
Transportation, Frederick County Department of Public Works, Frederick County
Fire Marshall, Frederick County Department of Parks and Recreation. Frederick
County School Department, Frederick County Sanitation Authority, Frederick-
-- Winchester Health Department, Stephens City Fire and Rescue Companies and
the Frederick - Winchester Service Authority. The proposed proffer statement has
been forwarded by staff to the Frederick County Attorney. Once attorney
comments are received by the Planning Department, they will be forwarded to
your office. Attorney comments are required for acceptance of the rezoning
application.
12. Other. This application is missing a number of items — A plat, a list of adjoiners,
a copy of the deed verifying current ownership and a statement that taxes have
been paid. All of these must be included for the application to be accepted by the
Planning Department.

13. Fees. The fee for this application includes a $3,000.00 base fee plus $100.00 per
acre, and a $50.00 public hearing sign fee. This is based on fees as of January 27,
2005. Fees may change.
