Winchester, VA 22603 RE: APPEAL APPLICATION 412 -05 Dear Mr. Conrad: This letter is to confirm that the above- referenced appeal application was denied; by the Board of Zoning Appeals at their meeting on May 17, 2005. This denial was of your request 412 -05, to appeal the decision of the Zoning Administrator pertaining to permitted uses (operation of trucking) in the RA (Rural Areas) District. The subject property is located at 712 Dicks Hollow Road, and identified by Property Identification Number 441 -A-50A in the Gainesboro Magisterial District. The decision of the Board of Zoning Appeals may be appealed to the Circuit Court of Frederick County within 30 days of the Board's decision. Board of Zoning Appeals, I'm writing about the appeal for Donald Conrad for the property at 712 Dicks Hollow Road. There as been problems with this arrangement since day one with him and my mother who lives in the house next to him at 626 Dicks Hollow Road. I have spoke to him on problems in the past and he doesn't even care about any issue that you may have. It's always about him and what he wants and if it doesn't work for you, oh well. He will go out and run his trucks for HOURS at a time and the diesel smells are really bad. The trucks are parked right next to the fence that was put up to keep some of the odor away and for him to stop running his big trucks across our yard and grooving the ground which isn't his. The fence, which he also complained about, does stop his trucks, but since he parks them right next to it, does nothing for the fumes. He knows of this problem but shows no concern as he continues to do it. My mother who lives in the house and has since my father built it in 1975 has a lot of health problems, more than even I could start to list. The list may be shorter if I was able to tell you what she doesn't have. My family, which now is just my mother has lived there for 30 years and I do not think this trucking problem should be allowed. My great grand father, Freeman Boyce, owned all the land on both sides of Dicks Hollow Road in the area where these properties are for many turns along this road. This area as always been for the quiet families and as a Rural Area for all my life and then some. I hope that you will leave it as it is and not allow the trucks to be there and continue to cause the problems they do. I also hope the other people who have been complaining in the area will speak up. My mother suffers the most because she is the closest to him. Her health should also be a great consideration in making this decision. She should not have to make changes and live her life out in more pain and discomfort, or be asked to move somewhere else for better health and living conditions after she as already invested 30 years where she is. I'm sorry I had to be out of town this week and couldn't attend your meeting. I thank you for accepting my letter and I hope you will keep the land as it has been for many years. Since it is the last piece my great grand father owned, I with my family plan to live there in the future and we too would hope we didn't have these problems. Our health is good now, but who knows about later. I will close, and hope this letter and any other comments you may have heard will help save this land from being turned into everything you get from the "big city life ". Th s a ain, Richard L. Dump trucks I am appealing the decision of this office related to a complaint made 3/25/05. The complaint that was made was most likely the work of a nosey neighbor who was actually upset over a prior incident in which my stepdaughter was in her yard attempting to catch her dog after the last snow. This incident resulted in an argument and thus the reporting of my trucks which have never bothered her for the last year and a half. I I do not operate an illegal business and fully comply with State and Federal guidelines. I am an upstanding member of the community and hard - working small business owner. I am well known and have a good reputation in the construction industry which I feel could be damaged by your decision and this complaint. I am not interested in keeping a fleet of trucks here, only two. My prior experience with rerrulte storage of vehicles has convinced me that constant monitoring during non - working hours is crucial due to the ever - increasing costs of insurance, repairs from vandalism, fuel, high taxes and fees on everything possible. Solely, this is the machinery that is responsible for my family's well -being and prosperity. My company, family, and I have done nothing, but attempt to do good for our neighbors and community. As a hard - working businessman that helps our community thrive, l urge you to reconsider any further action. Thank you for your serious consideration in this matter.
