Venskoske and Clinton Ritter, Jr. MINUTES - APPROVED The Chairman called the Meeting to Order and announced that • the first order of business was the approval of the Minutes of November 8, 1973. Upon motion made by Richard F. Madigan and seconded by Maurice W. Perry, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby approve the Minutes of November 8, 1973 as written. The above motion was passed unanimously. HOUSE NUMBERING SYSTEM RECOMMENDED APPROVAL Mr. H. Ronald Berg presented a map drawn by the Lord Fairfax Planning District Commission outlining the proposed house numbering system for Frederick County. Mr. Berg stated that there were three (3) basic ways in which such a system could be created. They are as follows: 1. A car with a special odometer could be driven along the highway numbering each house as it went along; 2. A Grid could be set at 10,000 square feet for each grid; or 3. A Grid could be established that would vary in widths. I FV • Mr. Berg stated that the Map drawn by the Lord Fairfax Planning District Commission was divided by Grids that .varied in width. He added that the system would be relatively easy to administer and that the Engineering Department would assign the numbers. Mr. Berg stated that the one big advantage about the pro - posed.system was that it would be uniform throughout the County. He added that once a house was numbered, it would be fairly easy to locate the residence. Mr. Berg futher added that both Stephens City and Middletown had been incorporated 1n the system, C. REGULAR MEETINGS - APPROVED Due to the work load that the Planning Commission has been • experiencing —in the past few months, the Members have decided to have regular MONTHLY meetings. Upon motion made by Richard F. Madigan and seconded by Keith Williams, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby set their Regular Meetings to be the first Thursday in every month commencing at 2:00 P.M. The above motion was passed unanimously. S U B D I V I S I O N S WOODCHUCK HEIGHTS - FINAL RECOMMENDED APPROVAL This subdivision is located on Route 654 (Woodchuck Lane) South of Route 50 West. 1. Contains two (2) lots. 2. The Health Department and Highway Department have not • signed the Final Plat, but have indicated that they will do so. 3. The Recreation Impact fee has been paid. The above motion was unanimously passed by roll call vote. NOTTAWAY - FINAL RECOMMENDED APPROVAL This is Section I of Nottaway Subdivision. 1. Contains sixteen (16) lots and sixteen (16) townhouses. 2. There are no approving signatures as yet on the Plat. 3. The Recreation Impact fee has been compensated for. 4. Will need a Bond to insure construction of streets, and water and sewer. • The Preliminary Plat had expired and had to be renewed. Upon motion made by Keith Williams and seconded by Richard F. Madigan, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of Nottaway Subdivision, sub- ject to the approving signatures and Bond, to the Board of Supervisors. The above motion was unanimously passed by roll call vote. This is Section E of Wakeland Manor. 1. Contains forty -three (43) lots. 2. The Highway Department has not approved it as yet. 3. The are no plans for roads and streets as yet. 4. The Health Department has signed the plats, but the Sanitation Authority has no plans for water and sewer. 5. A Bond needed for water and sewer and street construction. 6. Recreation Impact fee of $4300 has been received. Page 3 PF • Due to the lack of information, of Wakeland Manor was withdrawn. 0 ?� u the Final Subdivision Plat FOWLER CONDITIONAL USE PERMIT RECOMMENDED APPROVAL The Secretary read the application of Donald L. Fowler requesting a Conditional Use Permit for; -the property of Northern Virginia Marble Co., situated at Sunnyside, 3/4 miles North of Winchester City Limits on South side of Route 522 North, 300 feet North of Kwick Klean Refuse Company. The type of use and improvements proposed: 1. Cultured marble molding - this.is a casting operation that would turn out four (4) or five (5) bathroom vanities per day. 2. Would also have a showroom. There would be no pollution (water or air) The property is presently zoned Business, General (B -2) • with the surrounding area also zoned B -2. Mr. Madigan asked if this operation would be under roof. Mr. Berg stated that it would all be under roof and would combine a showroom and small molding operation. All parking will be on the premises, with two (2) to four (4) employees. Mr. Golladay asked about the water and sewer. He asked if it would be connected to the old Union 76 gas station. Mr. Perry stated that the gas station would still be in operation. He added that it was a Card Operated Service Station. Upon motion made by Richard F. Madigan and seconded by Manuel C. DeHaven, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval to the Board of Supervisors the application of Donald L. Fowler for a Conditional Use Permit. N E W B U S -I N E S S • SMITH'S TRANSFER CONDITIONAL USE PERMIT RECOMMENDED APPROVAL Page 4 A F , rkk i • The Secretary read the application of.Smith's Transfer Cor- poration located on Route 522 South. The type of improvement proposed is an addition to the terminal dock building. The property is zoned Industrial, General (M -2) with the surrounding property zoned as follows: North B -1 East M -2 South M -2 West M -2 Mr. Joe Monroe came forward to speak to the Commission on behalf of Smith's Transfer Corporation. Mr. Monroe referred to the map and explained the exact location to the Commission. He stated that there were presently 59 people employed and that the corporation had 31 pieces of equipment (20 of which were over - the - road, and 11 were local). The request is for an extension of the dock. the map. A short discussion followed in which Mr. Monroe referred to Mr. Monroe stated that Smith's Transfer was on the City water and sewer system. Mr. Golladay asked how big the extension would be. • Mr. Monroe stated that.the extension would be 50 feet wide and 80 feet long. Upon motion made by Richard F. Madigan and seconded by Keith Williams, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of the extension to this building to the Board of Supervisors. The above motion was passed unanimously by roll call vote. INQUIRY PHILLIP GLAIZE Mr. Glaize stated that he would like to build a facility for migrant workers, located on Route 627 just passed the intersection of 758,. West of Middletown. Mr. Glaize would be supplying housing for six (6) to eight (8) weeks, for seasonal employees to work in the apple orchards. The dormitory -type buildings would house approximately 40 such workers. He added that there would also be a building for the manager. • Mr. Madigan made the following suggestions: 1. Furnish a Plat. 2. Furnish a sketch showing what the building would look like. Page 5 PF • 3. Furnish any other information the Staff might find necessary. 4. Check with R. Wesley Williams of the Health Department for any necessary regulations. Upon motion made by Richard F. Madigan and seconded by Manuel C. DeHaven, BE IT RESOLVED,, That the Planning Commission of Frederick County does hereby request Mr. H. Ronald Berg to look into the possibility of this to be added with a Condtional Use Permit in A -1 and A -2 districts and that it be on the Agenda for future meetings. The above motion was passed unanimously by roll call vote. PUBLIC HEARING The Chairman announced that the next order of business was the amendment to the Zoning Ordinance. AN ORDINANCE TO AMEND THE FREDERICK COUNTY ZONING ORDINANCE ADOPTED NOVEMBER 1, 1973. PURSUANT-TO SECTION 15.1 -493 OF THE CODE OF • VIRGINIA, (1950), AS AMENDED, THE FREDERICK COUNTY PLANNING COMMISSION PROPOSES THE FOLLOWING AMENDMENTS: The Secretary read the amendments in full in which the Planning Commission approved as follows: 2 -3 -2. The setback line shall be located sixty (60) feet or more 3 -3 -2. from any highway, street or road right -o£ -way which is fifty (50) feet or greater in width, or eighty (80) feet or more from the center line of any street with a right - of -way less than fifty (50) feet in width and parallel or concentric to the center line. Upon motion made by Richard F. Madigan and seconded by Manuel C. DeHaven, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of Section 2 -3 -2 and Section 3 -3 -2 to the Board of Supervisors. Perry, BE IT RESOLVED, That.the Planning Commission of Frederick County does hereby recommend approval of Section 12 -4 -2 and Section 13 -4 -2 to the Board of Supervisors. The above motion was unanimously passed by roll call vote. ® AMENDMENTS TO MAPS 1. Correct and close boundary on Route 11 North Quarry. Mr. Berg explained that when the maps were drawn, that the boundary for this quarry was only three (3) sided. That the fourth side had not been closed in. Mr. Berg showed this boundary on the map to the Commission. Upon motion made by Richard F. Madigan and seconded by Manuel C. DeHaven, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval to the Board of Supervisors to correct and close boundary on Route..11 North Quarry. The above motion was unanimously passed by roll call vote. 2. Remove A -2 boundary line from around the Clearbrook Park. Mr. Berg explained that the Clearbrook Park was in A -2 zoning and that the line around the park made it redundent. Upon motion made by Richard F. Madigan and seconded by • Maurice W. Perry, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of this change to the Board of Supervisors. Correct the A -2 district designation on the small tract of land in the lower right of Map #9 to correspond with the R -2 district on Map #10. Mr. Berg explained that the R -2 designation on Maps #9 and $10 did not match. Upon motion made by Keith Williams and seconded by C. Langdon Gordon, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of this correction to the Board of Supervisors. The above motion was unanimously passed by roll call vote. 4. Correct B -1 designation to B -2 for Route 50 and 522 Inter- sections; Route 656 and 657 Intersections; Armel Trailer Sales on Route 50 West; Fort View Furniture on Route 522 South; and Route 7 East - Business strip. Mr. Berg showed the Commission the locations on the map, in which a short discussion followed between the members. • OPPOSITION Mr. Shirley Carter came forward to Commission in opposition of the proposed B -2 50 and 522 Intersections. Mr. Carter stated the area would like the area at Route 50 and from the Town and Country Department Store g Springs Road. speak to the Planning designation for Route that the residents of 522 to remain B -1, ping East to Sulphur Mr. Carter stated that if the area was zoned back to B -2 that it would be wide open to any type of business. Mr. Carter added that he had a petition signed by 45 landowners and residents of the affected area, requesting that the portion remain in B -1. Mr. Golladay stated that it might be wise for the Planning Commission to table this particular section - The area East and adjacent to Town and Country Retail Store and extending Eastward to Sulphur Springs Road and that it remain zoned B -1 as set forth in the Zoning Ordinance of November 1, 1973. It was brought to the attention of the Commission Members that there were several violations of the Old and New Zoning Ordinance in the B -1 designation on Route 50 East. • ' A short discussion followed in which Mr. Golladay asked Mr. Berg how the businesses.had come about. OEM i' Mr. Berg stated that over .the years the businesses were 8`l erected and that the County did not have the control it should have had. Upon motion made by Keith Williams and seconded by Richard F. Madigan, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval to the Board of Supervisors to correct the B -1 designation to B -2 for Route 656 and 657 Inter - sections; Arme1 Trailer Sales on Route 50 West; Fort View Furniture on Route 522 South; and Route 7 East — Business Strip. The above motion was passed unanimously by roll call vote. 5. Correct Sunnyside R -3 boundary to extend East and include the land of Carlin Smith presently in the M -1 district. Mr. Berg explained to the Members the proposed removal of M -1 line and replace it with R -3. Upon motion made by Keith Williams and seconded by Richard F. Madigan, • BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of the motion as written to the Board of Supervisors. The above motion was unanimously passed by roll call vote. 6. Extend R -5 boundaries to include all land owned by Marjec, Inc. and all land owned by Lake Holiday (The Summit) Inc. Mr. Berg showed the Members the location of the land on the map. Upon motion made by Richard F. Madigan and seconded by Keith Williams, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of the extension of the R -5 boundaries to include all land owned by Marjec, Inc. and all land owned by Lake Holiday (The Summit) Inc. The above motion was passed unanimously by roll call vote. • POE CONDITIONAL USE PERMIT TABLED The Secretary read the application of Ralph W. Poe to con- struct DBA /Hidden Valley Campground located one (1) mile West of Winchester and 1/4 mile South of Route 50 West. Page 9 • I The exact legal description: Deed #2175, recorded in Frederick County, Virginia, on the 1st day of August 1972, in Record Book 394, Page 121. The type of uses and improvements proposed: Travel trailer park campground with all facilities in- cluding fishing lake, recreation building, comfort station with laundry room, swimming pool, office and store and Large Rally facilities (which would involve additional trailer and spaces). New buildings to be constructed: Everything has already been completed or is presently under construction except the swimming pool and it's attached bath house area. Buildings are as follows: is 41 Completed or under construction. Large barn with store/ office and recreation room, bath house (comfort station) with laundry room, and shelter for picnics or square - dancers. Water, electricty & sewer hookups are under construction. Well is completed and some Health Depart- ment sewer work is completed. The zoning of the property is Agricultural, General (A -2). The surrounding area is zoned: East - R -3; on North, West and South - A -2. The Secretary read into the Minutes numerous correspondence that took place between Mr. Poe and Mr. J. William Riley concerning this campground (Attached). Mr. Blair Webber came before the Commission and explained how his department was involved in the matter. He stated that he had received a number of telephone calls concerning the proposed campground. Mr. Webber further stated that he had explained to the people calling that he could not do anything until a building was under construction. Mr. Webber stated that one November 20, 1973, he was in- formed that a building was being constructed. The building permit had not been applied for at the that time. Mr. Webber continued that Mr. Berg and he had nailed up a STOP WORK Order on November 21, 1973. Mr. Webber stated that the only work that had been done since the. STOP WORK Order had been put up was the application of black paper to the exposed areas. Mr. Webber went on to say that on November 23, 1973 the owner's agent came to his office and applied for a building permit. permit. Page 10 �J • Keith Williams asked how many buildings were on the site that would have required a building permit. Mr. Webber stated that there were two (2) buildings. The first was a barn which was approved, and the second was the bath- house which was in violation for not having a building permit. Mr. Ralph Poe came before the Commission to speak in his own behalf. Mr. Madigan asked Mr. Poe if this was a Permitted Use under the Old Zoning Ordinance in A -2. Mr. Poe stated that in his opinion, it was a permitted use; basing his opinion on the letter dated September 19, 1973 from Mr. Riley. Mr. Madigan asked what the total acreage of this land was. Mr. Poe responded that it was 622 acres. Mr. Madigan then asked how many acres would be taken by the Route 37 By -pass. Mr. Poe stated that 13.6 acres would be taken. Mr. Poe • added that 4.6 acres would remain on the East side after the Route 37 By -pass was taken. Mr. Madigan quoted the Old Zoning Ordinance, Section 3 -1 -26 which stated: "Mobile Home Parks in agreement with a Conditional Use Permit and conditions contained herein were permitted." Mr. Poe stated that that deals with mobile homes in a mobile home park and that there would not be any mobile homes in his campground. Mr. Williams quoted from the Old Zoning Ordinance the definition of "Mobile Home." A short discussion followed in which Mr. Poe and Members of the Commission explained the definition of MOBILE HOME. Mr. Poe stated that the longest travel trailer was 31 feet which was exceptional and that it weighed 5,000 pounds. He added that the average travel trailer was 13 feet and weighed 800 pounds. Mr. Madigan asked what type of sewer system was going to be used on the property. Mr. Poe stated that he had a permit to install a sewage - .disposal system; that one of them was extremely elaborate for the comfort station and bath -house. Mr. Madigan asked if there would be more than one (1) septic system. Page 11 r �� • Mr. Poe stated that there would more than one (1) septic system. He added that he had a system to be used for individual hook -up. be. Mr. Madigan asked what the capacity of the sewer system would Mr. Poe described the proposed septic system for the develop- ment and stated that it would be more than adequate to handle the facilities. Mr. Madigan.asked how many baths, showers, toilets, etc. would be located on-the property. Mr. Poe stated that there would be six (6) for females and six (6) for males. Mr. Madigan asked what type of water system would be used. Mr. Poe stated that a well (one) would be used by all. Mr. Madigan asked what type of uses would be used on this property. Mr. Poe answered that overnight.campers and tents only. • Mr. Madigan raised the question of how many campsites could be available at peak periods. Mr. Poe stated that he is proposing 75 to 90 campsites; with three (3) people per site. Mr. Madigan stated that there would be approximately 360 people on the 31 acres; with the average length of stay to be two (2) or three (3) days. Mr. Madigan asked what type of recreational facilities would be provided for the children and adults. Mr. Poe stated that he would have the following: Juke Box Two (2) pool tables Ping Pong tables Pin Ball machines Presently constructing a lake for fishing Proposes to build a swimming pool Will have dancing. Mr. Madigan asked about alcoholic beverages. • Mr. Poe stated that there would not be any alcoholic beverages sold on the premises. Mr. Madigan asked when there would be more than 90 trailers. Page 12 l ql • Mr. Poe stated that maybe once -every three (3) years. Mr. K. Williams asked about the possibility of mobile homes. Mr. Poe stated that there would definitely be no mobile homes in the campground. Mr. R. Williams asked if there was a specified length of time in which a trailer would be permitted to stay. Mr. Poe stated that he had no specified length of time. Mr. Golladay asked how many feet apart these trailers would be. Mr. Poe stated that they would be 30 feet apart. Mr. Madigan raised the question of security protection. Mr. Poe stated that there was generally no problem con- nected with campers. Mr. Golladay asked when all activities (such as square dancing) would stop. • Mr. Poe stated that 11 P.M. would be the QUIET hour. Mr. Golladay referred to Mr. Poe's letter of October 24, 1973, paragraph 3 in which Mr. Poe stated that he was aware that "I may ride and I. may allowed my children and their guests to ride... ". Mr. Golladay asked if this meant Mr. Poe's own personal guests and not the camping guests. Mr. Poe stated that this was correct. He added that he was referring to motocycles and snow mobiles. OPPOSITION Mr. Bob Mitchell, attorney for the landowners of Merriman's Estates, came before :the Commission in opposition of the Hidden Valley Campground. Mr. Mitchell presented a petition to the Commission signed by the surrounding property owners in opposition of the campground. Mr. Mitchell stated that the initial objection to the pro- posed campground was that the Planning Commission was being presented with an Accomplished Act. • Mr. Mitchell stated that under the Old and New Zoning Ordinance that a CONDTIONAL USE PERMIT must be obtained before con - structing a travel trailer campground. He added that this permit had not been applied for under either the Old or New Zoning Ordinance. Page 13 i • Mr. Mitchell stated that he was also objecting to the mini - bikes and snow mobiles, which, to his understanding, do not need trails. He added that the people were objecting to the noise that would result from these mini -bikes being the property lines. Mr. Mitchel] went on to say that the residents of the area were greatly disturbed about the increase in traffic in the area, not to mention the lights from incoming and outgoing cars.. He further added that the residents felt that the campground would impair and hamper the aesthetical value of their property. - He further added that the residents would be running the risk of fire, due to the campfires and also the risk of trespassers. WILBUR C. STIVERS Mr. Stivers appeared before the Commission to reiterate the same views that Mr. Mitchell had previously stated. MRS. LINDA WHITE Mrs. White stated that she had been in numerous trailer parks and camps along the East Coast, and that she had never seen a trailer camp or park this close to a residential area. Mrs. White added that since this was a residential area, that a campground would not be • feasible. She wanted to know if there was not a better place for one to be located. MR..SCHENK Mr. Schenk appeared before the Commission and expressed his views. He stated that he lived at the far end of Merriman's Lane. He added that the campers would be needing supplies and that they would be travelling Merriman's Lane to acquire these supplies. He stated that his main concern was the amount of traffic. MR. POE Mr. Poe came back before the Commission for rebuttle. He stated that the campers would be strangers in town and that the closest, if not obvious, way into town would be on Route 50 and that they would not be taking their trailers with them when shopping. Mr. Poe stated that the bath house had been moved 35 feet from its original designation so that Mr. Stivers would not be able to see- it in the winter. Mr. Ritter, attorney for the Commission, asked Mr. Poe if he would have any objections to seeding the buffer strip with a • "natural" blind, such as white pine, that would be there year round. Mr. Poe stated that he would not have any objections. Page 14 • EXECUTIVE SESSION Upon motion made by Richard F. Madigan and seconded by Keith Williams, BE IT RESOLVED, That the Planning Commission of.Frederick County does hereby move into Executive Session to discuss a legal point concerning this application. I was surprised to receive your letter after our discussion on the 'phone until I continued to read and found that you had sent copies to the two complainants. For that reason, I an replying with enclosures for Mr. Stivers and Mr. White. Please forward their copies on to then. I have not and do not plan to construct any type of racetracks or rental trails for any type of motorized vehicles anywhere, and definitgly not on the property that is being developed into a camp- ground. I am aware of the laws requiring permits for construction of whatever venture one may wish to enter. I shall always take • the proper steps and in the proper order before investing, con- structing, or purchasing. This can save a lot of problems for all. However, I am aware that I may ride, and allow my children or guests to ride, bikes or snacmiobiles anywhere and at anytime onthe property of my farm land. .There will be no charge for this and it will be strictly for leisure and recreation. I have no intentions of sanctioning any kind of activities nor will I condone any type of indulgenent 4minco veniencing or harrassing anyone with these occoaaional pleasure rides. I want to be a good neighbor and to bring a much needed new business enterprise to thh Winchester area. You shall have my complete cooperation in this matter. Once again, Tease allow me to reiterate, I am not and have not even been re- motely interested in constimcting a track or trail for commercial purposes.
