PC_01-18-73_Meeting_Minutes7` MINUTES OF THE SPECIAL MEETING ® of the FREDERICK COUNTY PLANNING COMMISSION' Held in the Board of Supervisors Room, January 18, 1973 PRESENT: James W. Golladay, Charles E. Bass, Manuel C. DeHaven, Maurice W. Perry, and Richard F. Madigan. ABSENT : Elmer Venskoske, Keith Williams. The chairman called the Meeting to Order and announced the first _order of business was the rezoning appplicationofRobert Solenberger, Be -Con, Inc. to rezone 81.2744 acres of land, situated in Stonewall Magisterial District; lying on the west side of Virginia Route 663, from Agricultural (A -2) to Residential (R -1). Mr. Tom Glass appeared in favor of the application. Mr. Glass stated that the Soil Conservation people did a study on the land and that they reported that the soil was all right - for-perculationr He also said that the land was mostly wooded area. Mr. Glass stated that the land would be used for residential purposes. He further stated that there would be individual wells and septic systems. No one appeared in opposition. • Mr. Madigan moved that the application of Robert Solenberger be approved >as requested. from Agricultural (A -2) to Residential (R -1). Mr. Bass seconded and was passed. The Secretary read the application of Robert Solenberger to rezone 17.6695 acres of land, situated in Gainesboro Magisterial District; lying on the south side of U.S. Route 522 North, now called Route 679, at Albin; from Agricultural (A -2) to Residential (R -1). Mr. Solenberger appeared on his own behalf. Mr. Solenberger stated that he will have septic. systems and wells. A soil survey has been taken and the report is very favorable. Mr. Tom Glass is doing the plans. Mr. Glass stated that there will probably be lots down one side.until the property widens and then have lots on both sides of the road. Lengthy discussion followed. No one appeared in opposition. Mr. Madigan moved that the application of Mr. Robert Solenberger be approved as requested from Agriculture (A -2) to Residential (R -1). Mr. DeHaven seconded and motion was passed. ® The Secretary then read the application of Ray E. Boyce to rezone approximately 1'� 1 acre of land, situated in Stonewall Magisterial District; located on the west side of U. S. Route 11 approximately .75 miles north of Winchester City Limits from Industrial ® (M -2) to Business (B -2). Mr. Boyce appeared on his own behalf. Mr. Boyce represents Shade Equipment Company. The property in question is the Jumpin - J Drive -Inn Restaurant. Shade Equipment Company owns the ground and Mr. Joe Smith owns the building. The proposed addition to the Restaurant will be 24 feet from U.. S. Route 11 Right - of -way. There will be sufficient room on either side of the addition for parking. No one appeared in opposition. Mr. DeHaven moved to recommend the application of Mr. Ray E. Boyce to the Board for approval. Mr. Madigan seconded and was passed. The Secretary then read the application of Lewis A. Boyer, et al to rezone approximately 19 acres of land; situated in Opequon & Back Creek Magisterial Districts; located on the east and west sides of U. S. Route 11, immediately north of the Town of Stephens City Corporate Limits; from Agricultural (A -2) to Residential (R -1). Mr. Boyer appeared on his own behalf. Short discussion followed. No one appeared in opposition. ® Mr. Madigan moved that the application be approved as requested. Mr. Bass seconded and the motion was passed. The S read the application of Lewis A. Boyer to rezone approximately 5 acres of land, situated in Opequon and Back Creek Magisterial Districts; located on the east and west sides of U.S. Route 11 immediately north of the Town of Stephens City Corporate Limits from Agricultural (A -2) to Residential (R -2). Mr. Boyer appeared on his own behalf. A letter and petition were received by Mr. Golladay from Mrs. Elsie L. Hovermale Mrs. Bessie M. Funk, Mrs. Blanche E. Gardner,Mrs. Henry Shryock, and L. V. Ridings requesting that their property be removed from the list of those being rezoned Residential (R-1). No one appeared in opposition. Mr. Madigan moved that the application of Mr. Boyer be approved as requested from Agricultural (A -2) to Residential (R -2). Mr. DeHaven seconded and the motion was passed. Mr. Arthur Webber appeared before the Planning Commission concerning a Residential zoning along U. S. Route 11 North. Mr. Webber wants to be sure of the Agricultrual zoning of his property. Lengthy discussion followed. • Mr. Madigan moved that this land be put on the new Zoning Map as Agricultural (A -2) instead of Residential (R -1) as it is presently zoned. Mr. DeHaven seconded and the motion was passed. The Chairman announced the next order of business was the application of variance for Linwood Riter and Frances Lages. Lengthy discussion followed. Mr. Bass moved that the application for variance of Linwood Ritter and Frances Lages be approved to the Board of Supervisors. Mr. DeHaven Seconded and the motion was passed. Boyer, et al, were not understood by us at the time we signed it, and since we wish our properties rezoned R -2, we the undersigned respectfully petition your Commission to remove our properties from the list of those to be rezoned R-1 and to remove our names from Air.
