MINUTES OF THE REGULAR MEETING
• of the
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors Room, December 7, 1972
PRESENT: James W. Golladay, Charles E. Bass, Elmer Venskoske, Manuel C. DeHaven,
Richard F. Madigan, Maurice W. Perry and Keith Williams.
The Chairman called the Meeting to order and announced the first order of business
was the resignation letter from George W. Shanks. _
Upon motion of Mr. Venskoske and seconded by Mr. Perry it was moved that the
letter of resignation from Mr. Shanks be accepted and that a letter of thanks be
sent to Mr. Shanks from the Secretary.
The Secretary read the rezoning application of J. Richard Michael, Jr, to
rezone 4.67 acres of land, situated in Back Creek Magisterial District, lying on
the North side of Virginia Route 652; from Residential (R -1) to Residential (R -2).
Mr. Michael appeared on his own - behalf. In answer to a question from the
Commission, Mr. Michael stated that he plans to tie onto County water and sewer.
He further stated that he plans to build 15 to 20 townhouses and that he plans to
rent.them.
Mr. Golladay asked Mr. Michael 'who plans to maintain the streets. Mr. Michael
• said that he plans to maintain the streets himself according to the State Regulations.
Mr. Golladay then suggested that Mr. Michael go before the State and ask them to
take over the roads. Mr. Golladay also stated that the State can only do so when
there are at least three residents.
No one appeared in opposition.
The Chairman announced the next order of business was the rezoning application of
Naomi W. Crabill to rezone 19.5214 acres of land, situated in Shawnee Magisterial
District, lying on the West side of U.S. Route 11 and to the South of proposed
Route 37 at the Kernstown Interchange; from Agricultural (A -2) to Business (B -2).
Mr. Roger Alderman showed the proposed plans to the Commission. A lengthy
discussion followed.
Mr. Thomas Glass appeared in favor.of the application.
Mr. Glass stated that he plans to use the land for commercial use only, since
it would be on the new Route 37 Interchange. He further stated that there would be
no subdivision work. Mr. Glass also stated that he plans to use County water and
sewer.
No one appeared in opposition.
The _Chairman announced the next order of business.was the rezoning application of
Harold and geba Cooper to rezone apEroximately 300 acres of land, situated in Back
• Creek Magisterial District, lying West of Virginia Route 621; from Agricultural (A -2)
to Residential (R -1).
The property in question is situated across the road from Dav Mar Village Development

Mr. Glass and Mr. Nelson appeared in favor of the application.
The Chairman asked Mr. Glass what he plans to do with the property, Mr. Glass
stated that he plans to develop one acre lots and that he plans to have a 15 acre
Recreation Area. Mr. Glass further stated that the lots may be smaller in some
areas. He also plans to put state roads in the development.
Mr. Glass stated that he plans to build at least 15 lots a year. He also said
that he plans to sell only lots now and that he may sell houses later.
Lengthy discussion followed.
No.one appeared in opposition.
Mr. Bass moved that the application of J. Richard Michael, Jr. be sent to the
Board of Supervisors for approval as requested. Mr. DeHaven seconded. Mr. Williams
abstained. The motion was passed.

Mr. Madigan moved that the application of Naomi W. Crabill be sent for approval
to the Board as requested. Mr. Venskoske seconded. The motion was passed.
Mr. Williams moved that the Commission send the application of Harold and Reba
Cooper to the Board for approval as requested. Mr. DeHaven seconded and was passed.
Mr. Bass moved that the Planning Commission Minutes of the 6, August 3,
August 31, September 13, October 5, October 26, November 6, be approved as written.
Mr. DeHaven seconded and was passed.
O Mr. Carl Hammons from the Lord Fairfax Planning District Commission talked to
the Planning Commission on land use in Frederick County.
There being nothing further to come before the Commission, the Meeting was
adjourned.

Frederick.County Planning Commission
Dear Mr. Chairman:
It is with considerable regret that I must tender
my resignation as a member of the Frederick County Planning
Commission. I will shortly be withdrawing from the practice
of law and moving from the area in order to take a full time
position on the Staff of Senator Harry F. Byrd, Jr. A public
announcement to this effect will be made shortly. These
circumstances will, of course, make it impossible for me to
serve the people of my District and this County.
• I can say without reservation that I have enjoyed
working with all the members of the Planning Commission, who
have earned my respect for their dedication to the continued
healthy growth of our County.
If I can ever be of any assistance to you in the
future, I hope that you will not hesitate to call upon me.
