MINUTES OF THE REGULAR MEETING
of the
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors Room, October 5, 1972
PRESENT: James W. Golladay, Charles E. Bass, Elmer Venskoske, George Shanks,
Manuel C. DeHaven, Richard F. Madigan. Also Don E. Krueger.
ABSENT : Maurice W. Perry and Keith Williams.
The Chairman called the Meeting to Order, announced a quorum was present and
stated the first order of business was a Public Hearing on the Rezoning Application
of Ralph S. Gregory to rezone from Agricultural (A -2) to Business (B -2) 0.639 acres
of land lying at the northwest corner of the intersection of Virginia Secondary Routes
647 and 641 in Opequon Magisterial District.
The Secretary read the application.
E. Eugene Gunter appearing as counsel for the applicant stated that the appli-
cation was filled out as completely as possible at this time. In answer to a question
from the Commission, Mr. Gunter further stated that there were no plans at this time
for any use of the property which would include the sale of alcoholic beverages and
in addition that sale of these beverages w a•a :. controlled by the Alcoholic Beverage
Control Board. Mr. Gunter next stated that there were other lands along Route 647
that had been zoned for Business (B -2) therefore the proper zoning for the property
in question was Business (B -2).
Mr. Gregory stated he had contacted three or four families in the vicinity and
they were not in opposition to his proposed use of the land. He further stated that
he would like to move his entire home improvement business to the site.
Mr. Gunter stated in conclusion, that Agricultural (A -2), as the land is presently
zoned, allows more offensive uses than does Business (B -2).
No one appeared in opposition.
Upon motion of Mr. Shanks, seconded by Mr. Madigan and passed it was decided to
recommend to the Board of Supervisors that the application of Mr. Gregory be approved.
Mr. Seymour Barr appeared before the Commission and stated that he had previously
appeared before the Commission to discuss the reason that the land of Shenandoah Brick
and Tile Company, which was being quarried, had not been zoned Industrial (M -2) when
the original (1967) zoning map was adopted. He further stated that the Commission had
indicated it would move to change the zoning to Industrial (M -2) when the new Zoning
Ordinance and Maps were adopted. Mr. Barr stated his Company was waiting for this
zoning but that he did not desire to submit an application for rezoning due to problems
that arose with an application previously submitted.
It was the consensus of the Commission and Mr. Barr was told that he would either
have to await the adoption of the new Zoning Maps or he could submit an application
for rezoning the land in question.
Mr. Madigan presented two amendments for consideration to adopt as a part of the
proposed Zoning OrdinAe. Also, submitted was a sample Ordinance controlling inoperative
and /or abandoned motor vehicles and vehicle junkyards.
It was agreed that Members would be provided with copies of these documents for
their review prior to the next Meeting to be held on October 26, 1972.
There being nothing further to come before the Commission, the Meeting was
adjourned.
