MINUTES OF THE SPECIAL MEETING
• of the
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors Room, August 31, 1972
The Chairman called the Meeting to Order and stated all Members were present.
He then moved to the first order of business which was the Public Hearing on the rezoning
application of Jack K. and Polly J. Wampler to rezoned approximately two (2) acres of
land lying on the east side of U.S. Route 11 in Stonewall Magisterial District from
Agriculture (A -2) to Business (B -2).
The Secretary read the Application for Rezoning.
Mr. J. Randolph Larrick, appearing as counsel for petitioner, stated that
Mr. Wampler has operated businesses on a portion of the land, for which rezoning was
requested; and that these businesses were begun prior to extablishment of the Zoning
Ordinance; however, now Mr. Wampler wants to build a car wash and was unable to obtain
a Building Permit without the land being rezoned.
Upon a question from a Member of the Commission, Mr. Wampler stated that if
water ever leaves the Car Wash facility it will go across U.S. Route 11 into Hott Run
and then into a ponding area behind the Methodist Church. However, the Water Control
Board is not projecting any water leaving the property. He then said the ponding area
is not on his property and that he would pump the water into a 2,000 gallon tank truck
if the water were going onto other people's property.
Mr. Larrick then stated that Mr. Wampler is not planning to run water from
Car Wash into any drainage area at this time in that he has sand beds proposed and has
ordered a tank truck to haul excess water and that the Water Control Board has approved
his plan.
Mr. Wampler then submitted a copy of the Water Control Board approval for the
record. The approval was read by Mr. Madigan to the other Members of the Commission.
Mr. Blair Webber appearing in opposition stated that he was afraid the pro -
pesed car wash would create a nuisance if it were open seven days a week, twenty -four
hours a day.
Mr. Wampler stated his present plans were to operate from early morning to
midnite.
Mr. Webber then presented a letter in opposition, to the proposed car wash,
signed by twenty (20) residents of the area. He also submitted aerial photographs of
the area in question and the surrounding area for the Commission's consideration. He
continued stating that Mr. Wampler's existing businesses are operated properly but he
may not live forever.
Mr. Wamper stated that Water Control Board Approval for the facility is Void
if ownership is transferred.
Mr. Dave Fahnestock, appearing in behalf of Mr. Wampler, stated he was happy
with the area and with Mr. Wampler; continuing that Mr. Wampler will do what he promises
because he�is a "good Christian man, who teaches Bible class and is a tribute to the
Community."

Appearing in opposition with Mr. Webber were: Mrs. A. V. Dailey, Jr.,
• Kay.Bailey and Mrs. Betty Webber.
Upon motion of Mr. Williams, seconded by Mr. Perry and passed the Public
Hearing was closed and the Commission went into Executive Session.

After discussion, the Meeting moved into Public Session upon motion of
Mr. Williams, seconded by Mr. Shanks and passed.
Mr. Venskoske then moved that the Planning Commission recommend to the Board
of Supervisors that the application of Jack K. and Polly J. Wampler be approved as sub-
mitted.
The motion was seconded by Mr. Perry and passed.
The Chairman then recognized Mr. Robert Shumate, State Division of Planning
anc Community Affairs. Mr. Shumate told the Commission he has essentially completed
the Comprehensive Plan and at the request of the County has added a section on Recreation
which should enable the County to qualify for State and Federal Grants in this area.
After Mr. Shumate departed the Chairman announced he had received copies
of a proposed amendment to the Zoning Ordinance. He gave each Member a copy and stated
that a Joint Public Hearing on the amendment would be held on September 13, 1972 at
4:00 P.M. for the purpose of considering the same.
