HomeMy WebLinkAboutPC_08-03-72_Meeting_Minutes5�Ll MINUTES OF THE MEETING of the • FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors Room, August 3, 1972 The Regular Meeting of the Frederick County Planning Commission was held in the Board of Supervisors Room of the County Office Building, Winchester, Virginia at 3:30 P.M. this day and was called to order by the Chairman. order. PRESENT: James W. Golladay, Charles E. Bass, Maurice W. Perry, Elmer Venskoske, Keith Williams, George Shanks, Manuel C. DeHaven, Richard F. Madigan. Also, Don E. Krueger. The Chairman announced that a quorum was present and called the meeting to Mr. Benjamin M. Butler appeared before the Commission to discuss the zoning along Route 11 North of Winchester as acted upon by the Planning Commission and Board of Supervisors and filed as Zoning Action Number 37. He stated that Mr. Paul Ensogna had owned a parcel of land that had been rezoned residential under the referenced action and that the new purchaser wanted to retain the nursery business which was on the property. Since Mr. Butler had stated that Mr. Ensogna had carried on the nursery business to a limited extenet the Commission was in agreement that the new purchaser could continue the business under the existing nonconforming use principles of the zoning Ordinance. Mr. Roger H. Alderman approached the Commission to present the County's • Staff Plan for a refuse point collection system for the County. After a lengthly presentation Mr. Perry offered the following resolution: BE IT RESOLVED, That the Planning Commission does hereby recommend to the Board of Supervisors that it adopt and put into operation a Refuse Collection Point System on a County Wide Basis to begin operation at the earliest possible date. The resolution was seconded by Mr. DeHaven and passed. A letter submitted by Mr. Shanks was read and is attached to these Minutes as an exhibit. Mr. Alderman answered Mr. Shanks letter for the County. Mr. Shanks then offered the following resolution: BE IT RESOLVED, That the Planning Commission does hereby express its gratitude to Mr. Roy Jennings for his services rendered and its dissatisfaction with the method in which the Board of Supervisors and County Administration handled this matter. The motion was seconded by Mr. Madigan. After discussion, Mr. Williams offered the following amendment, that all words after" ... rendered" be deleted. The amendment was seconded by Mr. Shanks and, - passed. • The amended resolution was passed. The Chairman then directed the Secretary to write Mr. Jennings concerning this action of the Commission. i 53 Each Member had been provided with copies of Minutes of Meetings held on October 6, 1971, December 1, 1971, December 20, 1971, February 2, 1972, February 23, 1972, • March 29, 1972, April 6, 1972, April 26, 1972, June 1, 1972, June 22, 1972. The Chair- man asked for additions and /or corrections to these Minutes. There being none, the Minutes of these Meetings were approved. adjourned. Golladay, Sr., Chairman Frederick.County Planning Commission 9 Court Square Winchester, Virginia 22601 Dear Mr. Chairman: A situation has arisen which troubles me a great deal and I feel compelled to bring this matter to your attention and air this grievance with you and the Planning Commission. • It is my understanding that on July 12, 1972, the Board of Supervisors at the request of the County Administrator transferred the administration of the Zoning and Trailer Ordinances from the Office of the Commissioner of Revenue to the Office of the County Administrator. At the same time, they authorized the County Administrator to assign the duties thereto to the proper staff agency or person. It is further my under- standing that a new County employee has been hired in a salaried capacity for the express purpose of serving as Zoning Administrator and that Roy Jennings has been relieved of these duties. As a.member of the Planning Commission; I must specifically object to the manner in which Mr. Jennings has been unceremoniously relieved of his job as Zoning Administrator. He was appointed to act as Zoning Administrator by unanimous vote of the Board of Supervisors on April 14, 1969. From that time until his dismissal, Roy Jennings attended Planning Commission meetings and other related governmental functions with an attendance record unequaled by most. He served ably and well in the capacity as Zoning Administrator and worked as effectively as could be expected under an ordinance which we all agree was and is a woeful piece of legal draftmanship. • He received no additional salary for these labors nor even the token payment of Commission members. If I am not mistaken, S,5' James W. Golladay,'Sr:, Chairman Page 2 August 3, 1972 t the present administration has not .,even had the courtesy to officially notify Mr. Jennings of'his, dismissal or the reasons therefor. I would ask you and the members of the Planning Commission to pass ,a resolution expressing our gratitude to Mr. Jennings for his services rendered and our dissatisfaction with the way the Board of Supervisors and County Administration have handled this matter.
