Held in the Board of Supervisors Room, July 6, 1972
A Special Meeting of the Frederick County Planning Commission was held in the
Board of Supervisors Room of the County Office Building, Winchester, Virginia at 2:00 P.M.
this day and was called to order by the Chairman.
PRESENT: James W. Golladay, Charles E. Bass, Elmer Venskoske, Manuel C.
DeHaven, Richard F. Madigan. Also, Don E. Krueger.
ABSENT : Maurice W. Perry, George Shanks and Keith Williams.
The Chairman announced that a quorum was present and stated the first order
of business was a Public Hearing on the rezoning application of M.W. & G.E. Perry.
The Secretary read the application which requested rezoning of approximately 158 acres
of land lying west of U.S. Route 11 in Back Creek Magisterial District from Agricultural
(A -2) to Industrial (M -1). No one appeared either in favor or in opposition to the
petition.
The Chairman announced that the next order of business was a Public Hearing
on the rezoning application of Fort Collier Farms, Inc, and Mary Helen Stine Ives to
rezone 43.345 acres of'land in Stonewall Magisterial District from Agricultural (A -2)
to Industrial (M -2).
Mr. I. Fred Stine appeared on behalf of the petitioners and presented a map
showing the location of the property with respect to U.S. Route'll and the land of
Shockey's Concrete operation. Mr. Newlin also appeared as a prospective purchaser of
a parcel of the land in question and stated his use of the land would be as a storage
site for sand, gravel and flagstone. Mr. Henry Whiting, appearing as counsel for
petitioners, stated that the activities surrounding most of the land are M -2 in nature
and that he had advised his clients to request zoning for the entire property since
the Planning Commission had continuing supervision of the uses of the property under-
Section 12 -2 -1 of the existing Zoning Ordinance.
No one appeared in opposition.
The Chairman announced the next order of business was the Public Hearing on
the rezoning application of Leslie A. Mogle to rezone 123.61 acres of land in Opequon
Magisterial District from Agricultural (A -2) to Industrial (M -1).
Mr. James L. Bowman appeared and stated he and Fred L. Glaize, III were
purchasing the property and had no specific plans for the property at this time.
Mr. Herbert Shackleford appeared in oppostion to the request, stating he
represented some 38 homeowners in the area who were opposed to industry locating so
clsoe to his Lakeside Estates Subdivision.
Mr. Bowman stated he did not agree with Mr. Shackleford representing anonymous
property owners in as much as they are able to appear themselves. He further stated
that he did not envision traffic coming from the Interstate Route 81 Interchange at
Kernstown past Mr. Shackleford's Subdivision but rather from the Stephens City Interchange.
, The Chairman then moved to the next order of business which was the rezoning
application of James L. & Mary J. Bowman to rezone four (4) separate parcels of land
located in Opequon Magisterial District.

Mr. Bowman appearing on his own behalf stated the land requested to be zoned
M -2 contained his existing truck terminal which under the present ordinance was permitted
in M -2.
The second parcel contains 2.762 acres and is located at the intersection of.
Virginia Routes 277 and 1018. Rezoning requested was from Agricultural (A -2), to
Business (B -2), 1.958 acres and Residential (R -2), 0.804 acres.
The third parcel contains 18.362 acres and lies on the north side of Virginia
Route 277. Rezoning requested was from Agricultural (A -2) to Residential (R -2).
Mr. Bowman stated that the land had access from Virginia Route 277 and adjoined
land of Fredericktowne Company on the Northwest, which was recently rezoned to R -2.
The fourth parcel contains 0.307 acres situated on the west side of U.S.
Route 11 and is more specifically defined as Lot 10, Beverly Subdivision. Rezoning
requested was from Agricultural (A -2) to Business (B -2).
No one appeared in opposition to the rezoning request of these parcels of land.
The Chairman announced there were no further Public Hearings scheduled and
and entertained a motion to close the Public Hearing and move into Executive Session.
The motion was made by Mr. Bass, seconded by Mr. DeHaven and passed.
After short discussion and upon motion of Mr. Madigan, seconded by Mr. Venskoske
and passed the Planning Commission moved out of Executive Session.
Mr. Madigan then moved that:The Planning Commission recommend to the Board
of Supervisors that the rezoning request of M.W. and G.E. Perry be approved. The motion
was seconded by Mr. Bass and passed.
Mr. Venskoske moved that: The Planning Commission recommend to the Board
of Supervisors that the rezoning request of Fort Collier Farms, Inc, and Mary Helen Stine
Ives be approved. The motion was seconded by Mr. DeHaven and passed.
Mr. DeHaven then moved that: The Planning Commission recommend to the Board
of Supervisors that the rezoning request of Leslie A. Mogle be disapproved. The motion
was seconded by Mr. Venskoske and passed.
The following Members made and seconded, respectively, motions to recommend to
the Board of Supervisors that the rezoning request of James L. & Mary J. Bowman be
approved:
Parcel #1 - Mr. Bass, Mr. Madigan
Parcel #2 - Mr. Venskoske, Mr. Madigan
Parcel',13 - Mr. DeHaven, Mr. Madigan
Parcel #4 - Mr. Bass, Mr. DeHaven
All of the above motions passed.
There being nothing further to come before the Commission the Meeting was
adjourned.

and 641. Rezoning requested was

(B -2), 2.312 acres
and Industrial (M -2), 1.305.
Mr. Bowman appearing on his own behalf stated the land requested to be zoned
M -2 contained his existing truck terminal which under the present ordinance was permitted

Mr. DeHaven then moved that: The Planning Commission recommend to the Board
of Supervisors that the rezoning request of Leslie A. Mogle be disapproved. The motion
was seconded by Mr. Venskoske and passed.
The following Members made and seconded, respectively, motions to recommend to
the Board of Supervisors that the rezoning request of James L. & Mary J. Bowman be
approved:

Parcel #2 - Mr. Venskoske, Mr. Madigan
Parcel',13 - Mr. DeHaven, Mr. Madigan

There being nothing further to come before the Commission the Meeting was
