PC_02-23-72_Meeting_Minutes3, MINUTES OF THE SPECIAL MEETING of the FREDERICK COUNTY PLANNING CCMMSSICN Held in the County Office Building, February 23, 1972 A Special Meeting of the Frederick County Planning Commission was held in the Supervisors Room of the County Office Building, Winchester, Virginia, this day and was called to order by the Chairman James W. Go]laday. All Members were present. The Chairman stated the reason for the Meeting was to conduct Public Hearings on the rezoning applications of Smith's Terminal Corporation and Wilson Terminal Corporation. Mr. J. Randolph Larrick appeared as Attorney for both applicants, No one appeared in opposition. Mr. Larrick stated that the property of Smith's Terminal Corporation was Industrial (M -2) when a Building Permit was issued in 1968. However, when a new building permit was sought the land was zone Business (B -2). Mr. Larrick stated that the proposed zoning Industrial (M -2) was in line with the recent rezoning of the land of J & P Properties which lies on the other side of US Route 522. . Upon motion of Mr. Bass, seconded by Mr. Perry and passed the Commission does recommend to the Board of Supervisors that the Applications of Smith's Terminal Corporation and Wilson Terminal Corporation be approved. Mr. and Mrs. Arthur Weber who own land on Route 11 next approached the Com- mission concerning their land which had been rezoned from Agricultural (A -2) to Residential (R -1). Mr. and Mrs. Weber stated they were aware that land was to be rezoned however they understood the rezoning to R -1 was to be for a depth of 400 feet from the Route 11 Right -of -Way line but that they now find their entire property was rezoned to R -1. They further stated that they did not disagree with the R -1 classification to a depth of 400 feet from Route 11 but they would desire to havethe remainder of the land remain zoned A -2 so they could carry on their nursery activities and graze cattle. Continuing, they stated that the rear of their land was not conducive to a residential purposes due to a railroad bordering the rear of the property and power line runnin across the property. After general discussion the Commission agreed that when the new zoning ordinance and map are proposed for adoption the Commission would do everything it could to change the R -1 zoning of the Weber land to that area lying on U.S. Routea71 to a depth of 1100 feet.
