MINUTES OF THE MEETING
of the
FREDERICK COUNTY PLANNING COMMISSION
Held in the County Office Building, February 2, 1972
The Regular Meeting of the Frederick County Planning Commission was held
in the Supervisors Room of the County Office Building, Winchester, Virginia this
day and was called to order by the Chairman James W. Golladay at 3:30 P.M.
All Members were present.
As the first order of business the Chairman read a draft letter to the Board
of Supervisors on possible methods of expediting zoning applications, a copy of
which is attached.
Upon motion of Mr. Perry, seconded by Mr. Bass and passed the Chairman was
authorized to sign the final letter and forward same to the Board of Supervisors.
At 3:45 P .M. the Ch airman requested the Secretary to read the application
of Harry S. White Jr. requesting rezoning of 0.8035 acres mom.or1less fncm
Agricultural (A -li to Industrial (M -1) as the first step of the Public Hearing.
After the reading of the application, Mr. White appeared on his own behalf presenting
a prepared statement, a map of the area in which the property desired to be rezoned
is located, photographs of the building involved and a petition signed by persons
living in the vicinity who were not opposed to the rezoning - -all of which are a
part of the record of this action.
Mr. Chet Litton appeared for the petitioner and gave a personal recommendation
to the quality of Mr. White's welding work and a statement of the need for a weld-
ing facility in the area proposed.
Mr. Douglas Swift appeared as Attorney for property owners in the vicinity of
the proposed rezoning who are in opposition. Mr. Shift stated that due to the
small size of the parcel this was spot zoning and that the stated use of the land
on the application could not be counted on as any permitted use in the Industrial
(M -1) Classification would be allowed on the land sbmAldtthe application be approved.
Mr. Swift futher stated that the petition submitted by Mr. White indicates the
persons signing state they "do not oppose" the rezoning but does not state that
they are in favor. Mr. Swift closed by stating that the main criteria for refusing
the application should be spot zoning.
After discussion and questions by the Commission, Mr. Harold Patton, an
adjoining property owner to Mr. White, was recognized. Mr. Patton state that he'�
had originally signed a petition opposed to the proposed rezoning but that he
could appreciate both sides of the argument and that a welding shop would 'not be
detrimental to the area.
There being nothing further to be presented by those either in favor or those
opposed, the Planning Commission closed the Public Hearing upon the approved
motion of Mr. Shanks, seconded by Mr. Vensposke.

After a lengthy session and upon motion of Mr. Bass, seconded by Mr. Madigan
and passed the Executive Session Closed.
Mr. Shanks reluctantly moved that the Planning Commission recommend to the
Board of Supervisors tbat the rezoning application of Harry S. White, Jr. be dis-
approved.
The motion was seconded by Mr. Bass and approved with Messrs. Perry and
DeHaven abstaining.
The Chairman then read a report he had presented to the Board of Supervisors
on January 10, 1972 outlining the activities of the Planning Commission for Calendar
Year 1971 stating that he had taken the action on his own.
Upon motion of Mr. Shanks, seconded by Mr. Madigan and passed the Ch airman 's .
report was ratified.
The Chairman then read a copy of an editorial which had been broadcast over
radio station WINC at the time the proposed new Zoning Ordinance was going to be
considered at Public Hearing.
There being nothing further to come before the Commission the Meeting adjourned
at 6:40 P.M.

Recently during several Public Hearings on Rezoning Applications
statements have been made by developers and realtors to the effect that
some outside interests are hesitant to consider locating in the County
due to the long delay in their scheduling caused by the cumbersome
rezoning procedure.
In an effort to streamline this procedure the Planning Commission
recommends the following changes to the existing format:
a. When a Rezoning Application is received by the Executive
Secretary make it an administrative action for him to

refer it to the Planning Commission rather than ho
it for the next Board of Supervisors' Meeting to do
the same thing.
b. After the Planning Commission has made its recommendation
make it an administrative action of the Executive Secretary
to schedule a Public Hearing fitting into the Regular
Board of Supervisors Meeting Dates rather than hold it
for the next Regular Meeting to bring it before the Board
and then have it scheduled for Public Hearing.
In extreme situations it has taken up to four (4) months from the
time an application has,been submitted to the time final approval/

disapproval has been given. By instituting these two administrative
actions it is believed the extreme time frame could be reduced by
at least a month and in the majority of cases by one and one -half
(1z) to two (2) months.
