of the
FREDERICK COUNTY PLANNING COMMISSION
Held in the County Office Building, July 12, 1971
A Special Meeting of the Frederick County Planning Commission
was held in conjunction with the Regular Meeting of the Board of
Supervisors in the Supervisors' Room of the County Office Building,
Winchester, Virginia, this day and was called to order by Chairman
James W. Golladay at 3:35 P.M.
PRESENT: James W. Golladay, Charles E. Bass, Donald L. Baughman,
Maurice W. Perry, Elmer Venskoske, Keith Williams,
Roy Jennings and Don E. Krueger, Acting Secretary.
ABSENT: Grover Teets, Jr. and Roy W. Williams.
The Chairman noted a quorum was present and the Meeting
continued.
The business at hand was the corrected petition of C. D. Hylton
which had been acted upon at the Regular Meeting conducted on May 5,
1971. Mr. Joseph A. Massie, Jr., Counsel for Petitioner stated that
the Commission had approved the original petition at a prior meeting
and at that time had noted an incorrect State Route Number on the
accompanying plat and that subsequent to the Commission's recommen-
dation to the Board of Supervisors it was noted that the original
petition and accompanying plat were in error with respect to the
location of the tract within a Magisterial District. Further,
Mr. Massie requested approval of petition by both bodies meeting
since the Commission had recommended approval of the original
petition to the Board of Supervisors in the meeting referenced.
No one appeared in opposition.
On motion of Mr. Keith Williams, seconded by Mr. Perry:
BE IT RESOLVED, That the Planning Commission recommends the
Board of Supervisors approve the revised petition of C. D. Hylton
to rezone 29.26 acres of land in Gainesboro Magisterial District,
bounded on the North by U. S. Route 522, on the East by Unger and
the Darlington Subdivision, on the South by Miller and on the West
by a lane and other land of C. D. Hylton from Residential R -2 to
Business B -2.
The motion passed.

Mr. Baughman noted to the Chairman of the Board of Supervisors
that he desired to be replaced on the Planning Commission since he
is not pursuing reelection as a Supervisor and he is unable to
attend many of the Planning Commission Meetings. In lieu of appoint-
ment of a replacement the Chairman of the Board of Supervisors magna -
minously offered to replace Mr. Baughman at the Planning Commission
Meetings, pending receipt of sufficient prior notice from Mr. Baughman.
This was followed by Supervisor Brumback's similar offer.
There being no further business the Special Meeting adjourned
at 4:00 P.M.
