PC_12-02-70_Meeting_Minutes/Vo MINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the County Office Building, December 2, 1970 The Regular Meeting of the Frederick County Planning Commission was held in the Supervisor's Room of the County Office Building, Winchester, Virginia, this day and was called to order by its Vice - Chairman, Charles Bass, at 3:00 p. m. PRESENT: Charles Bass, Donald L. Baughman, Elmer Venskoske, Roy W. Williams, Keith Williams, Roy Jennings, and Benjamin M. Butler, Secretary. ABSENT: James Golladay, Grover Teets, Jr. and Maurice W. Perry. The Vice - Chairman, Charles Bass, announced that Mr. James Golladay was ill and unable to attend. The Vice - Chairman stated that he,would act as Chairman of the meeting. The Chairman announced that a quorum was present and the meeting continued. ®` The first order of business was the petition of Lake Holida Estates, Inc. by Donald L. Bayliss, President, to amend the Frederick County Subdivision Ordinance to provide for lot sizes where public water and /or sewer is available; requirement of central water and /or sewer system; cul -de -sacs; and to amend the Zoning and Subdivision Ordinance to include a provision for the uniform and equal enforcement of the said Ordinances in all districts of Frederick County under proper penalties for violations. The Secretary read the petition as filed and as advertised. Mr. Harold Moss President of. Lake Holiday Estates, Inc., requested permission ­ to the Commission. Mr. Moss informed the Commission that the petition was not a proposal by Lake Holiday Estates, Inc. but rather a proposal of Donald L. Bayliss, citizen of Frederick County. Next, Mr Eu Ba yliss requested the floor and informed the Commission that liis brother, Donald L. Bayliss, was ill and could not be present today to speak in person. He stated that the petition was by Donald L. Bayliss, citizen, taxpayer of Frederick County, and not Lake Holiday Estates, Inc. Mr. Bayliss then amended the petition previously filed to reflect that the same was filed by Donald L. Bayliss, individually. Mr. Bayliss then read a release of Mr. Donald L. Bayliss into the record. The same was marked Exhibit A and filed by the Secretary in the Planning Commission file. A A-W ® Mr. Eugene Bayliss summed up his address with the statement that Mr. Donald L. Bayliss wanted his petition considered with the over -all plan which the Frederick County Planning Commission is considering at this time. Mr. R. Williams questioned Mr. Eugene Bayliss closely on 8. 1 (b) [of the petition] and 2 (c); also, he questioned Mr. Bayliss on whether the County should have R -5 (multiple family dwelling) provision. Mr. Bayliss said that his comments were reserved for their plans which contemplated one dwelling per lot. He did not elaborate further on multiple family dwellings. The Press then asked Mr. Bayliss what "Subdivision" was referred to on page 2, last paragraph of the release. Mr. Bayliss stated that he was speaking in generalities and not with specific one in mind. Mr. Leonard Ellis, spokesman for the Frederick County Taxpayers Associatioa then stated that that organiation supported Mr. Donald L. Bayliss' petition. WHEREUPON, on motion by Donald Baughman, seconded by Keith Williams, "BE IT RESOLVED, that the Frederick County Planning Commission study the petition of Donald L. Bayliss ". Said motion was passed unanimously. The - Chairman then requested the Planning Commission to go into Executive Session, which it did upon motion duly made and seconded, and after some short discussion, the meeting was then turned open to the public upon motion duly made and seconded. The Chairman then announced that the next order of business was the ratification of the Chairman, James Golladay, and other officers' authorization of Wednesday, November 25, 1970, to E. Eugene Gunter to release the statement agreed upon in connection with the Lake Holiday Estates, Inc. The Commission was informed by the Secretary of the chronological correspondence with the officials of Lake Holiday Estates, Inc. since the Executive Meeting of November 20, 1970 with those officials. Said correspondence was marked Exhibit C and filed in the Planning Commission file. The Secretary then read the proposed draft of thetnews release and filed a copy of the same as Exhibit B in the Planning Commission file. J 142 It was further stated by the Secretary that the news release was made with the understanding that Lake Holiday Estates, Inc. , Donald L. Bayliss, and Joseph A. Massie, Jr. , would execute a release to the Frederick County Planning Commission and its officers. Upon motion of Keith Williams, seconded by Elmer Venskoske, "BE IT RESOLVED, that the Frederick County Planning Commission approve and ratify the action of its officers in releasing the statement heretofore marked "Exhibit B "; and that the Secretary send a copy of said release to the Board of Supervisors as recommended in said statement ". Said motion was passed unanimously. Supervisor, Donald Baughman, then requested the Secretary to forward a copy of the minutes of the Planning Commission to the Chairman of the Board of Supervisors so that the Board might better be kept informed of the Planning Commission's actions. The Secretary replied ih;the affirmative to such request. The Secretary then read the minutes of the last Regular Meeting, October 7, 1970, and the same were approved as read.
