• MINUTES OF THE MEETING
OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the County Office Building, October 7, 1970
The Regular Meeting of the Frederick County Planning Commission
was held in the Supervisor's Room of the County Office Building, Winchester,
Virginia, this day and was called to order by its Chairman, James W. Golladay,
at 3:00 p. m.
PRESENT: James W. Golladay, Charles Bass, Maurice W.
Perry, Elmer Venskoske, Grover Teets, Jr., Donald L. Baughman, R. W.
Williams, Roy Jennings and Benjamin M. Butler, Secretary.
ABSENT: Keith Williams.
The Chairman announced that a quorum was present and the
meeting continued.
The first order of business was the petition of the Farmers
and Merchants National Bank to rezone a tract of land containing three (3)
acres, more or less, located on the North side of Senseny Road, Route 657,
in Shawnee Magisterial District, Frederick County, Virginia, and bound
on the West by Interstate 81, just East of the City of Winchester, Virginia,
from R -1 to B -2. Appearing for the petitioner was F. L. Largent, Jr.,
attorney for petitioner, and Wilbur N. Feltner, President of the Farmers
and Merchants National Bank:
In opposition appeared Billy G. Phillips, Denny W. Whitmire,
Irma B. Whitmire, John E. Andersen, Ken Fuhrmann, Susan S.
Phillips Janet P. Wyndham and Harold G. Palmer.
Mr. F. L. Largent, Jr. presented the case for the Farmers
and Merchants National Bank and filed a plat of the proposed area to be
rezoned and also a picture of the proposed building. Mr. Largent stated
that the Bank felt that this was an excellent location for a branch bank and
that it would be a public service to have -same there. He stated that the Bank
felt that Route 657 would increasingly develop in the future. He further
stated in answer to the spot zoning question, that because of the location
beside Route 81 and Senseney Road, the same would not be spot zoning in
the illegal sense of the word. Mr. Feltner stated that there had been
numerous requests made to the Bank to place a branch bank in the pr.opbsed.z.
area to be rezoned.

Speaking against the proposed rezoning were John E. Andersen,
Susan Phillips. Ken Fuhrmann, Harold Palmer, Janet Wyndham, all of whom
felt that the Bank itself would not be a particularly bad industry, but feared
a creeping paralysis of the entire area along Senseney Road into a general
business district. They all stated that they had invested much money into
their homes and in the case of persons living in Green Acres, it had been
represented to them by James R. Wilkins, the developer, that the area would
also be residential and not business.
The Chairman then announced to all participants of the procedure
followed by the Planning Commission and that a vote would be taken later in
the day on each of the matters before the Commission, which vote would be
done in public.
The next order of business was the petition of the Union O il
Company of California o f 10.466 Acres, locatedi.in Opequon Magisterial
District, on State Route 277 and State Route 1012, from A -1 to B -2. Appearing
for Union Oil Company of California was Henry Whiting, their attorney. No
objectors appeared on this petition. Mr. Whiting stated that this land is on
an interchange and the same will be used for a filling station and not for large
scale mechanical work.
The next order of business was the petition of Shenandoah Ga s
Company and Boyd J. Hamman to rezone 12 Acres of real estate, located
behind the present Shenandoah Gas property from A -2 to B -2. Appearing for
Shenandoah Gas Company and Boyd J. Hamman was Henry Whiting, Attorney.
No objectors appeared on this petition.
Mr. Whiting stated that the proposed use of the building would be
by the C & P Telephone Company to construct an operations station which would
physically look like the building presently occupied by Shenandoah Gas Company.
He further stated that he felt that such a building could possibly fall within the
permissible use under §3 -1 -27 of the Frederick County Zoning Ordinance
allowing such an operation in general agricultural, but because of the amount of
money to be invested, it was decided to bring the matter before the Planning
Commission.
The Chairman then requested the Planning Commission to go into
Executive Session, which it did, and after some short discussion, the meeting
wastthen turned open to the public.
WHEREUPON, discussion was had on the petition of the Farmers
and Merchants National Bank.
On motion by Donald L. Baughman, seconded by Grover Teets, Jr.,

® BE IT RESOLVED, that the Planning Commission recom-
mend to the Board of Supervisors not1to approve the petition
for rezoning of approximately 3 acres, more or less, of
Farmers and Merchants National Bank from R -1 to B -2, and
further for the stated reason that this would be an encroach-
ment into existing residential area, which residential was of
the highest class.
Said mot ion was passed unanimously.
Abstaining vote on the aforesaid petition were Maurice W.
Perry, James W. Golladay, and Charles Bass.
Public discussion was next had on the petition of Union Oil Company
of California, and on motion by Charles Bass, seconded by Maurice W. Perry,
BE IT RESOLVED, that the Planning Commission recom-
mend to the Board of Supervisors to approve the petition of
rezoning of 10. 466 Acres, fronting on Route 277 and Route
1012, from A -1 to B -2.
Said motion was passed unanimously.
® Public discussion was next had on the petition of Shenandoah Gas
Company and Boyd J. Hamman, and on motion by Elmer Venskoske, seconded
by Grover Teets, Jr. ,
BE IT RESOLVED, that the Planning Commission recom-
mend to the Board of Supervisors to approve the petition of
rezoning of approximately 12 Acres, more or less, of
Shenandoah Gas Company and Boyd J. Hamman, from A -2 to
B- 2.
Said motion was passed unanimously.
The Chairman then read a letter expressing the sentiments of the
Frederick County Planning Commission in response to the questionnaire of
the Frederick County Sanitation Authority concerning the Commission's com-
ments as to how the Authority's project fitted the master plan for the County.
The gist of the letter was that there was nothing in the McNair, Simmons and
Kline report of March 10, 1970 which conflicted with any local regional planning.
The Secretary was directed to post a copy of the letter in the Secretary's file.
The Chairman then read a letter from Sidne Q Dewberry, of
Dewberry, Nealon and Davis, dated September 16, 1970, stated that that firm
® has, by mutual agreement, discontinued its relationship with Lake Ho liday
Estates Golf and Country Club, Incorporated, and with Donald L. Bayliss,
President of the said Company. The Secretary was requested to file the letter
with the Secretary's file.

® It was the general consensus of the Commission that the Secretary
should write a letter to the Board of Supervisors stating their displeasure at
permitting Lake Holiday Estates to continue without approval of the water
control board.
Mr. Charles Bass reported on the progress being made in the
development of the County Zoning maps and indicated that it was hoped to be
completed by the first of 1971.
There being nothing further to come before the meeting, the same
was thereupon adjourned at 5:20 p.m.
