N' The Regular Meeting of the Frederick County Planning, Commission
W - was held in the Supervisor's Room of the County Office Building, Winchester,
a- Virginia this day and was called to order by its Chairman, James W. Golladay,
4 at 3:32 p. m.

- PRESENT: James W. Golladay, Chairman, Charles E. Bass,
0 Elmer Venskoske, Grover Teets, Jr., Keith�Williams, and Donald E.
O Baughman.
ABSENT: Maurice W. Perry, and Benjamin M. Butler, Secretary.
Donald E. Baughman served as Secretary for the meeting.

The first order of business was the Petition of T exaco , Inc. to

rezone 7. 8 Acres. Appearing for Texaco, Inc. were: Carle F Ger
Jr., Attorney for Texaco, Inc., Willia m_M._Garthune,_Jr.. , a local sales
representative, H_ arry Brown, real estate representative, and Carvel L.

Lucas construction engineer.
After discussion on the aforesaid petition, on motion by Charles
E. Bass, seconded by Elmer Venskoske,
BE IT RESOLVED, that the Planning Commission recommend
to the Board of Supervisors to approve the petition for the
rezoning of 7. 8 Acres of land owned by Texaco, Inc., and

located on the East corner of the intersection of Virginia
Secondary Highway No. 647 and Virginia Highway No. 277,

from A -1 to B -2.

Said motion was passed unanimously.

The next order of business was the appearance before the
Planning Commission of Mr. Mike Kilpatric, of the Poto Ed ison Company.
Mr. Kilpatric's appearance was for the purpose of asking questions concerning

procedures for rezoning requests and specifically in regards to the Stine

rezoning.

The next order of business was the reading of the Minutes of the
a meeting
of April 1, 1970, with amendment. The minutes as read and

amended were thereupon approved.

. The next order of business was the presentation of five. (5) new
petitions for rezoning. The letter of E. Eugene Gunter, County Attorney,
was read by Mr. Golladay in connection with the five (5) new petitions.
After discussion concerning the A. Ni,B.Shin Pe the
petition was tabled until consultation with Benjamin M. butler, Secretary
of the Planning Commission. The following petitions were discussed:
Willia msburg tits. Petition, Monte Vista Petition, Schenck Petition, Stine
Petition, and Ratliff Petition.
On motion by Donald E. Baughman, seconded by Keith Williams,
BE IT RESOLVED, that the A. N. B. Shingleton Petition. i
be tabled until Mr. Butler can confer with the attorney
in question to discuss the potential problem of spot zoning.
After discussion, the petitions of Williamsburg Hts. , Monte
Vista, Schenck, and Stine were set for public hearing on June 3, 1970, at
3:00 p. m. and the Secretary was directed to advertise the same.
After discussion, the petition of Herbert T. Ratliff was set for
public hearing if it is determined that the same has been properly referred
by the Board of Supervisors. If the Board of Supervisors has not acted on
the petition in question, the same will be referred to them for proper
handling and the Secretary was directed to make inquiry concerning this
question.
Chairman Golladay then read the letter from the State Planning
Department. A Special Meeting has been set for May 27, 1970, at 3:30 p. m.
with Mr. B. C. Leynes of the State Department, to discuss the problems
of the present Zoning Ordinances.
There being no further business to come before the meeting, the
same was thereupon adjourned.
