MINUTES OF THE MEETING OF THE FREDERICK
COUNTY PLANNING COMMISSION, HELD IN THE
BOARD ROOM OF THE FREDERICK COUNTY OFFICE
BUILDING, on March 12, 1970, at 3:00 P. M.
The meeting was called to order by James W. Golladay, Chairman,
after due notice given to all the members.
Members present: James W. Golladay, Chairman; Charles E.
Bass; Donald L. Baughman; Elmer Venskoske and Joseph A. Massie., Jr.,
Secretary, and T. Roy Jennings, Zoning Administrator.
The minutes of the previous meeting were read, amended and
then approved. The Chairman announced that the first order of business
would be the public hearing called for this date to consider the
rezoning of both sides of Route #11 north of Winchester, from the
intersection with Interstate 81 north to the old Charles Town Road or
Secondary Route #761. Five interested persons appeared and joined in the
discussion, namely: W. C. Hostetler, A. Nydam, Wm. E. Sandy, Robert R.
Rexrode and Mrs. Carl Williams.
After some c6nsi-deration of the matter, it was decided that
Vonin mendments should be made to the proposed changes and for that reason, the
Administrator should note the changes on the plat and the matter
should be re- advertised for a further public hearing, and the following
resolution was adopted:
BE IT RESOLVED, that the Planning Commission of Frederick County
recommend to the Board of Supervisors that all properties in the following
area fronting on both sides of Route #11 north of Winchester, or as other-
wise shown on the plat in red outline with a minimum.depth in the right of
way of U. S. Route #11 of 400 feet and extending from the intersection of
Route #11 and Interstate 81 northwardly to Virginia Secondary Route #761
on the east and the first two residential lots on the south end of the
Henry Shirley farm on the west, be rezoned.from A -2 to R -1, subject to
a further public hearing.
Mr. B. C. Leynes, Jr., Engineer Planning Director from the State
Department of Economic, Conservation and Development attended the meeting
and advised the PlanningCommission that his Department stood ready to
assist the Planning Commission in its endeAvorsr�to perform its proper
service to the public.
He recommended that the County first have the State Tax
Department make a land map of Frederick County. This may take five years.
His Department will provide assistance to the Planning Commission and assist
in re- designing the Frederick County Zoning Ordinance to meet more specific
! � needs if the Board of Supervisors will by resolution ask for assistance of his
Department and if the Planning Commission will set up regular meeting dates

with his Department and their planner, and if the Zoning Administrator
will also be present and assist his Department.
The Planning Commission accepted these terms and stated that
the Chairman would consult with the Board of Supervisors in this matter.
Upon motion, duly made, seconded, it was RESOLVED that a- public hearing
on all zoning matters now pending or coming before the Board of
Supervisors be set for April 1, 1970, at 3:00 P. M., they being as
follows: The zoning of both sides of Route #11 north; the rezoning
request of Donald L. Bayliss; the zoning request of C. D. Hylton and the
rezoning request of Fredericktowne Company.
Whereupon, just prior to the closing of the meeting, Joseph
A. Massie, Jr. tendered his resignation as Secretary of the Planning
Commission, for reasons of conflict of interest that might develop in
future zoning now pending or to become pending before the Planning
Commission and the Board of Supervisors. The Chairman of the Planning
Commission accepted with regret the said resignation.
There being no further business to come before the meeting
the same was thereupon adjourned.
