MINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING
COMMISSION HELD IN THE BOARD ROOM OF THE FREDERICK COUNTY
OFFICE BUILDING ON OCTOBER 8, 1969, AT 3:30 P. M.

The Chairman called the meeting to order, and the Secretary
read the advertisement for the public hearing on its proposed rezoning
of Lots 1 -8 on the west side of the Paper Mill Road, 2nd Addition to
Milton Valley Subdivision, from R -2 and M -1 to B -2.
Mr. Blaine Wilson appeared and objected to changing his Lots
' 7 and 8 for zoning from M -1 to B -2. He did say that he'would have
retail sales on his property. His new buildings on Lot 7 would be
leased to the C & P Telephone Company, which use is permitted in B -2.
His business on Lot 8 would be permitted under B -2, but if it were not,
it was determined to be an existing non - conforming use.
There were other persons present who were property owners or
adjoining property owners effected by the rezoning and who voiced an
objection to the zoning of the area to M -1, as suggested by Mrl. Blaine
Wilson.
The meeting then came to an end, and on motion duly made and
seconded, the Planning Commission went into executive session,, and
a general discussion was held concerning the proposed rezoning,
whereupon, the executive session was then concluded, and the meeting
was open again to the public. After some further discussion, the
following resolution was made by C. E. Bass and seconded by C. L. Ritter:
RESOLVED that the Frederick County Planning Commission
recommend to the Board of Supervisors that Lots 1 -6 of
the 2nd Addition to Milton Valley Subdivision on the
west side of and abutting Paper Mill Road be rezoned from
R -2 to B -2, and that Lots No. 7 and 8 therein be rezoned
from M -1 to B -2, and all of said area fronting on the west
side of Paper Mill Road designated as Route 644 and extending
between Weems Lane on.!the north and Boones Lane on the
south.
The motion was passed unanimously.

The Planning Commission then again considered the Petition
of James R. Wilkins and James L. Bowman for rezoning of certain
Frederick County lots in Madison Terrace Subidivion. It appearing
to the Commission upon its own investigation as the petitioners
did not appear at the meeting, that the plat for the subdivision
has just recently been recorded in Frederick County, Virginia and
since the last meeting of the Planning Commission, thereupon,
it appearing that there is no just reason why the petition should
not be approved, a final resolution was adopted on motion of C. L.
Ritter, seconded by C. E. Bass.
BE IT RESOLVED, that the Petitions of Wilkins and Bowman
for the rezoning of their Frederick County lots in Madison
Terrace Subdivision from R -1 to R -2 and as shown on the plat be
and the same is hereby recommended to the Board of Supervisors
of Frederick County, Virginia.
Motion was passed

Whereupon, the petition of B. C. Kinchloe for the
rezoning of a tract or parcel of land on the west side of U. S.
Route #522, at Armel, in Opequon Magisterial District, Frederick
D County, Virginia, was received and after some discussion, upon
motion duly made and seconded, it was RESOLVED that this petition
be set for public hearing on November 12, 1969.
