MINUTES OF THE MEETING OF THE FREDERICK
COUNTY PLANNING COMMISSION - Held in the
Board Room, County Office.Building, on
May 21, 1969 - at 3:30 P.M.
Present: J. W. Golladay, Chairman; C. E. Bass; D. K.
Russell; M. W. Perry; C. L. Ritter; D. L. Baughman; Elmer
Venskoske; and J. A. Massie, Jr., Secretary.
The minutes of the meeting of April 9, 1969 were read
and approved.
The Chairman then called for the Public Hearing upon
the petition of Nannie 0. Choucleris, Millard G. Allen, Helen C.
Allen, Annie L. Kline and Safeway Stores, Inc. After reading of
the petition, examination of the plats by the Commission and the
presentation of evidence by the petitioners, a general discussion
was thereupon held concerning the same.
On motion by C. L. Ritter, seconded by M. W. Perry, the
following resolution was passed:
ID BE IT RESOLVED that the Frederick County Planning
Commission approve the petition of Nannie 0. Choucleris and others
to re -zone the land described in said petition, fronting on the
South side of Virginia Secondary Road No. 622, known as Cedar
Creek Grade from R -1 to B -2, to be used as a supermarket by
Safeway Stores, Inc., and that the same be reported to the Board
of Supervisors of Frederick County.
The Chairman called for the discussion of the petition
by Clarence F. Schenck and wife, and Schenck Foods Company,
Incorporated upon its petition for the re'= zoning of an area or
lot containing 32,683.2 squre feet fronting on the East side of
Virginia Secondary Route # 644 and the South side of Commerce
Street in Shawnee District, to be re =zoned from R -2 to M -1.
It was made to appear that there was a typographical
error in the advertisement, stating 23,683.2 square feet, but
otherwise pr.operly�-descr:ibingrthe_ lot. It then appeared that the
petitioners also desire to - -re -zone lots 2 and 4. adjoining the
aforesaid lot on the South, from $ -2 to M -1, and it was made to
appear that the advertisement did not cover these lots nor was
there a proper description of the same in the petition or a
plat accompanying the same. It further appeared that there were
several objectors present concerning the lots facing on Glaize

Avenue. They were T. L. Bucher, Luther White, Mrs. William
Jones, and Mrs. James Owens, who live next door to or across
the street from said lots. It was further pointed out
there may be restrictive covenants on said lots.
Mr. Lewis Costello represented the petitioners
and Mr. Clarence F. Schenck appeared in person. After further
discussion Mr. Schenck withdrew the application where it pertained
to lots 2 and 4 in Glaize Addition, and requested solely the
re- zoning of the aforesaid lot of 32, 683.2 square feet cornering
on Paper Mill Road and Commerce Street.
After discussion the Planning Commission entered into
executive session and then reopened the hearing. i
On motion by Baughman, seconded by Perry the following
resolution was adopted:
BE IT RESOLVED that the petition of Schenck Foods
Company, Incorporated and Clarence F. Schenck and wife for the
re- zoning of a lot cornering on Paper Mill Road and Commerce
Street, containing 32,683.2 square feet as shown in the ;plat
accompanying the petition be approved for changing the zoning from

R -2 to M -1, and

BE IT FURTHER RESOLVED that the petition for the
re- zoning of lots 2 and 4 in Glaize Subdivision, fronting on the
North side of Glaize Avenue and Paper Mill Road be not cbnsidered
at this time for the reasons that no plat accompanied the petition
and that Mr. Schenck agreed to withdraw the same from further
consideration, and
BE IT FURTHER RESOLVED that the Board of Supervisors
be so informed of this Commission's action.
The petition of Roy,R. Boyce and wife, and Robert E.
Kelso for the re- zoning of a lot on the East side of U. S. Highway
# 11 in Stonewall District, and the petition of Paul Ensogna and
wife for the re- zoning of a lot, and the plats accompanying the
same be reset for hearing on June 19, 1969.
A discussion was then held concerning the re- zoning of
the West side of Paper Mill Road, North of Boones Lane just South
of the lots of Blaine Wilson, Northwardly S 7-0 Weems Lane, from
R -2 to B -2.
It was thereupon decided to advertise this change on
June 19, 1969, and that a plat will be filed therewith.
