PC_10-11-68_Meeting_Minutes� MINUTES OF THE MEETING OF THE PLANNING COMMISSION OF FREDERICK COUNTY, VIRGINIA Held October 11, 1968, at 4:00 P. M. The meeting was held at the Frederick County Court House, being removed from the Board of Supervisors' room, and was called to order by J. W. Golladay, Chairman. Present: J. W. Golladay, Chairman; Donald L. Baughman, Charles E. Bass, N. Belmont Fout, Elmer M. Venskoske, Joseph A. Massie, Jr., Secretary and R. W. Williams, Sanitarian The Chairman requested that the minutes of the last meeting be read which was done, and they were approved. The Chairman then called for a public hearing on the petition of Fred L. Glaize, III and E. E. Bayliss, Jr. for rezoning of approximately seven (7) acres on Senseny Road from R -1 to R -2 in order to permit the construction of a three -story apartment building. Mr. Berry, Attorney for the petitioners, then called on C. Thomas Cooper, Jr., architect for the petititioners, to present the building plans and described the project. Mr. Cooper then presented a model of the proposed project and described the same. Persons present in connection with the public hearing were Mr. and Mrs. Temple Homar and Mrs. Sours. They considered the construction of a swimming pool on the property, its location and the type of apartments. Mr. Cooper informed the public hearing that the swimming pool would not be on the property line unless it were along Senseny Road; that 10% of the total project would consist of three - bedroom apartments; 25% of two - bedroom apartments, 40% of one - bedroom apartments and 25% of efficiency apartments. There was no objection by anyone present to the petition for rezoning. The Planning Commission then considered the question of rezoning land fronting on U. S. Highway No. 522 at the southwest corner of Fox Drive and said Highway and considered also the question of rezoning the entire area from Va. Route 37** and its intersection with U. S. 522 eastwardly to the City Limits, and after some discussion, the following motions were thereupon made in open session. 2 0 e3 Upon motion duly made and seconded, the petition of Fred L. Glaize, III and E. E. Bayliss, Jr. for the rezoning of the aforesaid seven -acre tract from R -1 to R -2 be, and the same is hereby approved for the construction of garden apartments, and the same is recommended to the Board of Supervisors Upon motion of Mr. Baughman, seconded and passed, BE IT RESOLVED, that the Planning Commission make a study of the area from Route 371,E at its intersection with 522 eastward to the City Limits along both sides of same, and that it be rezoned by changing from R -1 and R -2 to B -1 and B -2. Upon motion of Mr. Baughman, seconded and duly passed, BE IT RESOLVED, that the Planning Commission on its own motion, recommends to the Board of Supervisors that the southwest corner of the intersection of U. S. 522 and Fox Drive (Route 753) be rezoned from A -1 to B -1, as shown on the plat of Lee A. Ebert, dated October 19, 1966 for 1.1008 acres. Upon motion duly made and seconded, the following resolution was passed: BE IT RESOLVED, that the Planning Commission of Frederick County recommends to the Board of Supervisors of Frederick County, that it pass an ordinance adopting the requirements of the Code of Virginia for plumbing and sewer construction and for a building inspector for enforce- ment of the same. The following resolution was then duly made, seconded and passed: BE IT RESOLVED, that the Planning Commission of Frederick County recommends to the Board of Supervisors of Frederick County, Virginia, that it pass an ordinance requiring all petitioners for rezoning to pay a minimum fee of $30.00 to cover the costs of advertising and other expenses. Mr. Golladay, Chairman of the Commission, reported that he had received a check from the Federal Home Administration in the sum of $12,500.00 for the grant requested by the Commission for study of the County for water and sewer, to be conducted by John McNair and Associates, and that the Chairman has paid to John McNair and Associates $11,250.00, leaving a balance to be paid of $1,250.00, which will be paid upon the completion of the changes recommended by the Commission in the report of John W. McNair and Associates. The Commission then met with Mr. Steve Carnes, of John McNair and Associates, and informed him of the necessary changes which he said would be completed. It was thereupon agreed that a public hearing would be held on November 6 1968 upon the recommendation of the Planning Commission that ® I Oy Route 522 be rezoned and upon the recommendation for rezoning of the land at the southwest intersection of 522 and Fox Drive, provided the advertising could be completed in time.
