Langdon Gordon; Manuel DeHaven; R. Wesley Williams; J. William Riley, III; and H. Ronald Berg. ABSENT : Maurice Perry; James W. Golladay; and Clinton Ritter, Jr. CALL TO ORDER The Chairman called the Meeting to Order and announced that the first Order of Business was the approval of Minutes. MINUTES - APPROVED Upon motion made by Richard Madigan and seconded by Elmer Venskoske, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby approve the Minutes of November 7 and November 13, 1974 as written. The above motion was unanimously approved. JANUARY MEETING DATE SET It was brought to the attention of the Members that the regularly scheduled Meeting Date for January was set for the 2nd. Following a short discussion, it was decided that the meeding date would stay as scheduled. LAND USE PLAN - FINALIZED The Chairman stated that the next order of business was approval of the final draft of the proposed Land Use Plan. 0� 1 p Mr. R. Berg explained the changes that had been made in the Plan to the Members. Following a lengthy discussion in which several technical correc- tions were noted, the Members decided that copies of the proposed Plan should be sent to the Board of Supervisors. PROPOSAL - J. ROBERT RUSSELL The Chairman stated that Mr. Russell had suggested that a soils analysis be required from developers of subdivisions to help guide the Planning Commission and Board of Supervisors in making decisions. He added that this would give the Commission and Board a better idea of the present and future worth of the property for residential use. Mr. Venskoske stated that until there is a soils survey done of the County, then he didn't see how the Commission or Board could make the necessary decisions. Mr. Madigan stated that the Board of Supervisors should have the developer make a soils analysis of all lots before coming before the Commission and Board for approval. After a short discussion in which the Members discussed the pros and cons of a soils analysis, the following motion was made: Upon motion made by Manuel DeHaven and seconded by Elmer Venskoske, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby request the Board of Supervisors to enact an ordinance to enforce the developers of subdivisions to have a soils analysis made of the land for proposed subdivisions. The above motion was unanimously approved by roll call vote. P U B L I C H E A R I N G S AN ORDINANCE TO AMEND THE FREDERICK COUNTY ZONING ORDINANCE ADOPTED Page 2 NOVEMBER 1, 1973 TO AMEND SECTION 9 -1 -13 TO READ: SERVICE STATION: ANY PREMISES USED FOR SUPPLYING GASOLINE, OIL, TIRES, ACCESSORIES AND SERVICES FOR AUTOMOBILES AT RETAIL DIRECT TO THE MOTORIST CONSUMER, INCLUDING SUCH SERVICES AS LUBRICATION, WASHING AND MINOR REPAIRS (ENCLOSED WITHIN THE PREMISES) AND SUCH INCIDENTAL SERVICES AS ROAD SERVICE, SUPPLYING ROAD MAPS AND INFORMATIONAL SERVICE AND FOOD VENDING MACHINES, BUT NOT IN- CLUDING SUCH MAJOR REPAIRS AS: A. SPRAY PAINTING; B. BODY, FENDER, CLUTCH, TRANSMISSION, DIFFERENTIAL, AXLE, SPRING, AND FRAM REPAIRS; C. MAJOR OVERHAULING OF ENGINES REQUIRING REMOVAL THEREFROM OF CYLINDER -HEAD OR CRANKCASE PAN; D. Upon motion made by Richard Madigan and seconded by Elmer Venskoske, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend to the Board of Supervisors the above ordinance for passage. The above motion was passed unanimously by roll call vote. AN ORDINANCE TO AMEND THE FREDERICK COUNTY ZONING ORDINANCE ADOPTED NOVEMBER 1, 1973 TO ADD SECTION 10 -1 -37: CAR WASH: A BUILDING OR PORTION THEREOF CONTAINING FACILITIES FOR WASHING AUTOMOBILES OR LIGHT TRUCKS (UP TO 3/4 TON), USING PRODUCTION LINE METHODS OR HAND OPERATED SELF - SERVICE METHODS. Recommended Approval The Chairman read the proposed Amendment to the Members. Upon motion made by Richard Madigan and seconded by Elmer Venskoske, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of the above ordinance to the Board of Supervisors. The above motion was passed unanimously by roll call vote. S U B D I V I S I O N S Page 4 ' 1. College Park, Section 4 (Preliminary) - Contains 12 lots; will have central water and sewer; located off of Route 50 East and behind the Holiday Inn. Recommended Approval I �'1 Mr. R. Berg stated that all lots conform to the Zoning Ordinance. He added that preliminary approvals have been received from the Health and Highway Departments. He further added that the roads would be put in before the Final Plat was submitted. Upon motion made by Richard Madigan and seconded by Langdon Gor- don, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of this subdivision. The above motion was unanimously approved by roll call vote. 2. Braddock Hills Estates, Section 3 (Final) - Contains 13 lots; will have individual systems; all approvals have been received; located off Route 522 West near Silver Lake. Recommended Approval Mr. R. Berg stated that this was the third time this Plat has been before the Commission. He stated that it was initially approved in 1971; then it came back again last summer and was reapproved but was unable to have the roads put in; now it is completed. Mr. DeHaven asked how large the lots were. Mr. Berg stated that all the lots are one (1) acre or more. He added that the lots are 100 feet wide and were platted under the old ' ordinance. Upon motion made by Richard Madigan and seconded by Manuel DeHaven, BE IT RESOLVED, That the Planning Commission of Frederick County Page 5 ' does hereby recommend that the plat was presented be not accepted until it conforms to the current Zoning Ordinance. The above motion was unanimously approved by roll call vote. 3. Lake Holiday, Section 12 (Final) - Contains 267 lots; will have central water and sewer; final approvals have not yet been received. Recommended Approval Mr. R. Berg stated that this Final Plat has been approved by the Frederick County Sanitation Authority. He added that the Highway Depart- ment has not approved the Plat since it contains private roads. Mr. Berg further stated that the Health Department has not yet given their approval. He stated that all lots do conform to the Zoning Ordinance. Mr. R. Wesley Williams of the Winchester - Frederick County Health Department stated that when more than 40,000 gallons of water was in- volved, then the local Health Department could not give Final Approval. Upon motion made by Richard Madigan and seconded by Langdon Gor- don, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of this subdivision to the Board of Supervisors. Discussion Harold Moss Mr. Harold Moss appeared before the Commission and presented an impact statement for The Summit on projected Tax Revenues. He explained the amount of revenue the County would receive from The Summit through the Year 1980. Mr. Moss stated that this impact statement was based on an over -all development. Vote The above motion was unanimously approved by roll call vote. Page 6 10 ' REQUEST RALPH WAKEMAN Mr. Berg stated that Mr. Wakeman had made a request at the last Regular Meeting of the Planning Commission that they consider reducing the acreage requirements for the R -5 Zoning District from 500 acres to 300 acres. Following a short discussion, it was decided by the Members that it would not be feasible to reduce the acreage requirement in the R -5 District. DEFINITIONS PUBLIC GARAGE The Chairman stated that the next order of business was discussion of a Public Garage. ' Mr. Berg read the proposed definitions to the Members. He stated that these definitions had been discussed at the last meeting and that they were redrafted for the Commission's approval. Mr. Madigan stated that screening of operations in Section 12 -1 -2 should be required in his opinion. Mr. Berg stated that this condition could be placed on the opera- tions at time of approval. Upon motion made by Richard Madigan and seconded by Elmer Venskoske, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby move to advertise the following definitions for Public Hearing: 23 -30. GARAGE, PUBLIC: A building or portion thereof, other than a private garage, designed or used for servicing, repairing or equipping motor - driven vehicles; but not including service ' stations or auto sales and /or service. 12 -1 -2. Automobile assembling, painting, up- holstering, repairing, rebuilding, reconditioning, Page 7 M f (b� ' body and fender work, public garage, truck re- pairing or overhauling, tire retreading or tire recapping. 10 -1 -18. MOTOR VEHICLES SALES AND /OR SERVICE: A building or space used for commercial purpose and used for sales, hire, storage or repair of motor vehicles, but shall not include storage of dismantled or wrecked motor vehicles or a service station. The above motion was unanimously approved by roll call vote. SIGN ORDINANCE The Chairman stated that it had come to his attention that a Sign Ordinance was needed for the County. Following a short discussion, it was decided that this would be discussed at the next Work Session. ROLLER SKATING RINK ECOMMENDED APPROVAL Mr. Berg showed the exact location of the proposed Roller Skating Rink to be located adjacent to Clarke Chrysler - Plymouth on Route 7 to the Members. He stated that there would be approximately 20 square feet of building space. He further added that a holding tank is being pro- posed until water and sewer is expanded to include that portion of Route 7. Upon motion made by Richard Madigan and seconded by Manuel De- Haven, BE IT RESOLVED, That the Planning Commission of Frederick County does hereby recommend approval of this Site Plan subject to approval of the appropriate agencies.
