FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Room, April 4, 1974
PRESENT: Keith Williams, Chairman; James W. Golladay; Manuel

ABSENT : R. Wesley Williams.
CALL TO ORDER
The Chairman called the Meeting to Order and announced
• that the first order of business was the Work Session.
WORK SESSION
The Chairman read the proposed Policy for Conditional
Use Permits.
A short discussion followed in which Mr. Berg clarified
items Number 1 & 2 of the proposed policy to the Members.
Upon motion made by Keith Williams, seconded by M. W.
Perry and passed unanimously,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby recommend the following policy for Conditional
Use Permits to the Board of Supervisors:
1. In A -1, A -2, B -2, R -1, R -3 areas where
Planning Commission review is not required
• by the Zoning Ordinance, the permits will
be acted upon by the whole Board, with zoning
approval required for passage just as it is
required on a building permit.
• 2. All M -1 and M -2 permits will be reviewed by
both the Planning Commission and the Board
of Supervisors.
3. The Staff is to interpret what the require-
ments for Conditional Use Permits are to be
for new uses and NOT for the expansion of
existing permitted uses, except where speci-
fically required.
SHOPPING CENTER PLANS
SUNNYSIDE
The Chairman announced that the next order of business
was the presentation of plans for a proposed shopping center
located at the intersection of Route 739 (Fox Drive) and 522 North.
Mr. Ronald Berg presented the proposed site plan to
the Members. He explained that the developer wanted the Planning
Commission to review the proposed shopping cn r eter and state their
• views and suggest recommended changes.

• DISCUSSION OF A -1 AND A -2 ZONING DISTRICTS
Mr. Snapp appeared before the Commission in opposition
to the one (1) acre zoning areas that are currently in Frederick
County for developing communities.
Mr. Snapp stated that by allowing one acre developments
along the highways and roads, it was creating a great hazard for the
following reasons:
1. Creates hazards for children in low -price housing.
The roads and highways would be the only play-
ground.
2. Takes good farm land out of production. These
one -acre housing developments are right up against
• the farm land.
3. With only one acre of ground for a housing develop-
ment, there was a good chance of contaminating the
wells.
4. Pets running over other peoples properties.
5. Places a tax burden on the County with this low-
income housing.
6. Creates problems of police and fire protection for
low- income housing out in the County.
Mr. Snapp concluded that he was opposing these one
(1) acre developments in the County. He added that it does create
a hazard to the farmers that are fruit growers and the like when
there are houses right next to their fields. He further added that
• it would take. farming land out of production. Mr. Snapp stated
that he was not opposing a house sitting on one (1) acre, but that
he was opposing one -acre developments in rural areas.

• Mr. John Pickeral appeared before the Commission and read
three (3) paragraphs from the Zoning ordinance for agricultural areas.
He stated that all the good farm land throughout the County allows
Residential areas. Mr. Pickeral added that he thinks the ordinance
should be rewritten to limit the agricultural areas that have heavy
residential development to a border area adjacent to developed areas
where there are some services.
Mr. Pickeral stated that residential areas should be
limited only to the areas where water and sewer is available or will
be available. He added that he would like the County to take this
problem under study and possibly rewrite the Zoning Laws.
Mr. Pickeral suggested that the County either take the
residential developments out of agricultural zones or create a buffer
• zone surrounding these residential areas that are being developed.
He further requested that the Board of Supervisors take emergency
action (a moritorium) at their next meeting to stop residential
development in agricultural areas.
Mr. Henry Brumback appeared before the Commission to
express his views on the issue on the floor. He stated that he
was trying to raise apples -with a group of these houses situated
out in the orchards which does create a considerable problem. He
stated that the main problem was with the need to spray the apples,
but was unable due to the closeness of the houses.
Mr. Brumback reiterated the comments made by Mr. Snapp
and Mr. Pickeral.
Mr. Madigan asked Mr. Brumback if he would like to see
• a buffer zone of 100 or 200 yards created around these developments
and the farm land.

Mr. Brumback stated that he couldn't see how a buffer
• zone could be created around the agricultural and residential areas.
Mr. K. Williams stated that the County could not just
eliminate the communities already established, nor could they
stop development of communities in the County.
CAR AND TRUCK WASH FACILITIES
Mr. James Smith appeared before the Commission to request
that a category be placed in the Zoning Ordinance for a car and
truck wash (Self- service Wash). He added that there would be no
man power required and that it would be operated 24: -hours a day.
It was decided by the Commission that the matter would
be discussed in a work session.

MINUTES - APPROVED
The Chairman asked the Members if there were any
corrections or additions to the Minutes of February 7, 1974 and
March 7, 1974.
Mr. Langdon Gordon stated that in the March 7th Minutes
on Page 8, the voting of the Manuel Subdivision was incorrect.
Mr. Gordon stated that correction should read:
"The motion was defeated by the following vote:
Mr. Venskoske, Mr. Madigan voting NAY with Mr. DeHaven
and Mr. Gordon voting AYE."

ANNOUNCEMENT
The Chairman read the announcement stating the cut -off
dates for Rezoning Applications, Site Plans and Conditional Use
Permits to the public.
After a short discussion, it was decided by the
Commission that Mr. Berg should draft a resolution which would
establish regular cut -off dates for these applications and site plans.

ORDINANCE ADOPTED NOVEMBER 1, 1973 TO READ:
"...One of the five (5) appointed members may

The Secretary read the whole section to.the Members as
it would read with the correction.

Board of Supervisors.
AN ORDINANCE TO AMEND THE FREDERICK COUNTY ZONING ORDINANCE ADOPTED

rubber, metal and glass.
Mr. R. Berg stated that this section was in conjunction
with the Rhinehart Rezoning.
Mr. Paul Rhinehart appeared before the Commission and
stated the current uses of his land. He stated that the operation
being proposed would be mostly under roof.
After a lengthy discussion on the location of the
property , the size of the property, and a possible conditional
use permit, the Commission decided to go into Executive Session.

Mr. Rhinehart appeared before the Commission in his own
behalf.
A lengthy discussion followed between the Members and
Mr. Rhinehart at the Commission's table.
No one appeared in opposition.
Upon motion made by James W. Golladay and seconded by
Langdon Gordon,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby table this rezoning until the next meeting
pending Mr. Rhinehart's inclusion of his other acreage; and,
BE IT FURTHER RESOLVED, That Mr. Rhinehart bring in a
plat showing the additional land; and,
• BE IT FURTHER RESOLVED, That this rezoning be tabled pending
legal counsel at the next meeting.
The above motion was passed with Mr. Venskoske, Mr. Gordon,

The question of drainage was raised by the Commission in
• which Mr. Butler explained the situation to the Commission. Mr. Kisner
then came forward and explained how he planned to eleviate the pro-
blem.
Mr. Kisner stated that the main problem would be the access
road to the interior lots which the Highway Department has suggested
be moved up one (1) lot. He added that this could possibly cut
out Lot #20.
Mr. Madigan asked Mr. Kisner how he planned to control the
flooding.
Mr. Kisner stated that he planned to put in swale ditches.
Mr. Golladay raised the question of a playground for the
children.
Mr. Kisner stated that Lot #8 may not pass for water and
is sewerage, in which case, this lot would be used (designated) as a
playground for the children.
Mr. Kisner explained to the Commission what types of
housing the people in the immediate area are now living in; and
stated that the subdivision would be a place for these people to
move into.
No one appeared in opposition.
Upon motion made by Manuel DeHaven and seconded by Langdon
Gordon,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby recommend approval of this subdivision to the
Board of Supervisors with the stipulation that it must comply to
the State Code and the State Health Department.
The above motion was passed with Mr. Gordon, Mr. DeHaven,
and Mr. Perry voting AYE; with Mr. Venskoske voting NAY; and with
Mr. Golladay abstaining.

M -2 DISTRICT
DISCUSSED
The Chairman brought up the question of Section 13 -4 and
13 -5 in M -2 zoning to establish rear yard requirements. He stated
that it specifies front and side yard requirements but not rear
yard. The Chairman added that this should be brought up in a
Work Session and that M -1 should also be considered for a rear yard
requirement.

MANUEL - PRELIMINARY
RECOMMENDED APPROVAL
• The Secretary stated that Manuel Subdivision was a Pre-
liminary Plat and is located on Routes 625 and 633 between Stephens
City and Middletown, Virginia and will contain 20 lots.
The Health Department has given approval on an individual
lot basis. The Highway Department has not approved the plat as yet.
The Secretary stated that this subdivision was tabled
from the last meeting.
Mr. R. Berg stated that there was a problem with drainage
on the site of the interior street (referred to plat).
Mr. Ben Butler, attorney for Mr. Ken Kisner, appeared
before the Commission.
A lengthy discussion followed in which the question of
subdivisions being approved at the discretion of the Planning
• Commission and the Board of Supervisors was brought up.

STONEBROOK - FINAL PLAT
RECOMMENDED APPROVAL

The Secretary stated that this was Section Ii of Stonebrook
Farms and will contain ten (1) lots of 3/4 acres or more.
This subdivision has been approved by the Health and Highway
Departments.
Recreation Department has recommended an Impact Fee of
$100 per lot.
Mr. R. Berg stated that this subdivision would be approved
under the old Zoning Ordinance.
Mr. Berg showed the exact location of the proposed section
to the Members of the Commission.

County does hereby recommend approval of Section II to the Board
of Supervisors.

C O N D I T I O N A L U S E P E R M I T S
EARL HAINES
RECOMMENDED APPROVAL
The property is located on Route 7 next to the American
Legion in Stonewall Magisterial District. The Secretary stated
that Mr. Haines plans to construct an Office Building and a Storage
Room.
Mr. J. W. Riley read the application to the Commission.
,• He stated that the property is zoned M -2. Mr. Riley added that
Mr. Haines had secured a Variance from the Board of Zoning Appeals
to construct the proposed building.

Mr. Haines appeared before the Commission and explained his
• plans for the building and storage room.
A short discussion followed in which Mr. Haines explained
the size of his property.
Upon motion made by M. W. Perry, seconded by Elmer Venskoske,
and passed unanimously,

County does hereby recommend approval of this Conditional Use Permit
for an Office and Storage Building to the Board of Supervisors.
H. RAY VANDYKE
(Forest Lake Estates)
RECOMMENDED APPROVAL
This is an application for a Mobile Home and Modular Home
Development in Opequon Magisterial District. It was tabled from
the March 7, 1974 Meeting of the Planning Commission.
This property is-located East of Stephens City and South
of Route 277 off Route 636. It is proposed that there will be
399 lots; the Conditional Use Permit is for 450 Lots. Central
water and sewage will be provided for all lots with discharge below
the dam.
Mr. R. Berg stated that the design would have to be altered
to provide access for Messrs. Ritenour, Thompson and Johnson (referred
to map) along the boundary line, and the entire subdivision would
have to conform to the ordinance.
Mr. Berg stated that the lake and recreation facilities would
be used by the residents of the park only. He further stated that
the Plant would be above the lake with discharge below the lake.
The Commission asked Mr. VanDyke why the plant would be
above the dam.

Mr. VanDyke stated that there were two (2) reasons for this.
• (1) - There is a natural drainage for the whole property by putting
the sewage treatment plant where it is located; and (2) - The Water
Control Board requires the maintenance of a 600 foot radius from the
treatment plant, and all boundary lines and no dwelling can sit
within that 600 foot radius. He added that the discharge lines
would go under the lake and come out at the end of the dam..
In answer to a question from the Commission, Mr. VanDyke
stated that the lake would be used for boating, fishing and
swimming. (He stated that swimming would be in the upper end of
the lake). Mr. VanDyke added that there would also be a Club
facility.
Mr. Madigan questioned fire protection.
Mr. VanDyke stated that at first the park would have to
rely on the County services, but that it was planned to have its
own fire hydrants with designated hoses on the hydrant.
A short discussion followed between the Commission and E.
Eugene Gunter, Esq., attorney for Mr. VanDyke in which Mr. VanDyke
added his comments on the impact study that had been sent to the
Commission.
Mr. VanDyke summarized the types of facilities which will
be made available for the residents.
Mr. Golladay asked if Mr. VanDyke would have Modular
Homes in the park.
Mr. VanDyke stated that there would be a section designated
in the park for double wide mobile homes.
• Mr. Golladay asked Mr.VanDyke if he intended to fence the
entire lake in order to keep children from accidentally going into
the lake area.

Mr. VanDyke stated that he did plan to fence the lake area
�. and that there would be a common entrance with a security guard. He
added that there would be security on the lake at all times.
Mr. Gunter read a letter from Esten 0. Rudolph, Jr. dated
August 10, 1973 in which the County Board of Supervisors had approved
Forest Lake Mobile Home Park in Opequon Magisterial District.
A lengthy discussion followed concerning the treatment
plant and its facilities.
OPPOSITION
Reverend Josiah Andrew, of the Fairview Methodist Church,
appeared before the Commission to state his views in opposition
to the proposed park. Rev. Andrew presented a petition from the
• people not able to attend the meeting in opposition to the park.
Reverend Andrew stated that the following were the reasons
for opposition:
1. Concerned about the educational impact.
2. Concerned about the population aspect - 450
trailers with 2 adults and 1 child per trailer.
3. Concerned about the tax problem.
4. Concerned with the energy crisis.
5. Worried about the possible traffic increase.
6. Concerned about the water supply - a possible
shortage might develop.
7. Concerned about the impact the development, such
as this, would have on the tourist trade.
Milton Apperson appeared before the Commission to state
his views in opposition to the park. He stated that he was requested
10 to present a policy of the Tax Payers Assocation.

Mr. Apperson stated that he personally opposed any type of
•
high density population in Frederick County because of the high
taxation. He stated that if this pattern was set, that it would
be carried out in the rest of the County.
Mr. Apperson read the policy of the Frederick County Tax
Payers Association to the Commission Members.
Mr. Michael Kilijian appeared before the Commission and
presented his views on the possible fire hazards of mobile homes.
He added that a mobile home coming in from out -of -state might not
comply with the electrical codes of this state.
REBUTTLE
Mr. H. Ray VanDyke appeared before the Commission in rebuttle
to the opposition. He stated that he had been in contact with the
Frederick County Sanitation Authority concerning public water to
the proposed development and that he was told that this was a definite
possibility. He added that he was definitely considering this
possibility.
Mr. VanDyke stated that the tax figures dealt with stick-
built homes versus mobile homes

In summary, Mr. Gunter stated that the figures presented

to the Commission with respect-to-taxes and children were actual
"facts and figures" based on actual respected sources. He stated
that this land was already zoned A -2 which allowed mobile homes and
mobile home parks and that Conditional Use Permits had been issued
before and that this was in actuality a continuation of Conditional
Use Permits already issued.

Mr. Gunter summarized the aspects of the mobile home park
• and the impact it would have on the people in the County.
Upon motion made by Langdon Gordon and seconded by Manuel
DeHaven,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby recommend approval of Forest Lake Subdivision to
the Board of Supervisors subject to the State Water Control Board
approval and the design changes necessary to conform with local
ordinances.
The above motion was passed with Mr. Gordon, Mr. Perry,
and Mr. DeHaven voting AYE; with Mr. Venskoske and Mr. Golladay
voting NAY.
DEWEY GILLESPIE
DEFERRED
This is an application for a mobile home park located on
Route 7 in Shawnee Magisterial District.
Mr. R. Berg stated that the property is located on the
South side of Route 7 East, 22 miles from Winchester. Mr. Gillespie
is applying for a Conditional Use Permit for ten (10) spaces with
the property being zoned A -2 and surroudning property zoned A -2.
The Health Permit states that there will be one (1) septic
tank for every two (2) trailers; there will be three (3) wells for
the entire park.
A short discussion followed in which Mr. Berg showed the
exact location of the proposed park to the Members.
Mr. Gillespie appeared before the Commission. He stated
that there were now three (3) wells on the existing park with three
(3) more wells being palnned. He added that there would be a total
• of ten (10) new locations. Mr. Gillespie further stated that Greenwood
Fire Department would provide fire protection.

Mr. Gillespie stated that hopefully there would eventually
• be central water and sewer in the park.
The Application of Dewey Gillespie was deferred until further
information could be acquired.
MIKE AND SUSAN KILIJIAN
RECOMMENDED APPROVAL
This Conditional Use Permit is for part -time free -lance
commercial photography and art. It is to be located on Lot #7,
Section 4 of Green Acres Subdivision. This property is zoned
R -2 with surrounding areas zoned R -2.
Mr. Kilijian appeared before the Commission in his own
behalf. He stated that no additional help would be needed or hired.

MARSHALL RITTER
RECOMMENDED APPROVAL
This Conditional Use Permit is for a two (2) space mobile
home park (family) located on Route 642 in Shawnee Magisterial
District. The property iszoned A -2 and contains 18 acres.

This Conditional Use Permit is for a mobile home park

George Whitacre and Thomas Lineberg.
The zoning is A -1 and consists of approximately 70 acres.
Mr. Riley showed the Members the exact location of the
property in question.

RECOMMENDED APPROVAL
This Conditional Use Permit is for two (2) mobile homes
for Mrs. Anita Myers, located in Stonewall Magisterial District
approximately 1/4 miles off Route 672 on Route 667.
Mr. Riley showed the exact location of the mobile home
court to the Members.
Upon motion made by M. W. Perry, seconded by Manuel DeHaven
and unanimously passed by roll call vote,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby recommend approval of this Conditional Use Permit
to the Board of Supervisors.

• Road across from Senseny Road Elementary School.
Mr. Berg stated that the property for the bank is zoned
property (B -1) and contains .949 acres with a bank building of
32' x 38'. He stated that the bank would continue to use the
existing septic facilities until central water and sewer is available.
Upon motion made by Elmer Venskoske and seconded by M. W.
Perry,
BE IT RESOLVED, That the Planning Commission of Frederick
County does hereby recommend approval of this Site Plan to the
Board of Supervisors.
The above motion was unanimously passed by roll call vote.
