FREDERICK COUNTY PLANNING COMMISSION
• Held in the Board of Supervisors' Room, July 7, 1976

CALL TO ORDER
The Chairman called the Meeting to Order and proceeded to the First Order of
Business.
MEETING MINUTES - June 16, 1976 - Approved as Written
Upon motion made by James Golladay, Jr., seconded by Frank Brumback and approved
by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby approve the Minutes of the Meeting of June 16, 1976.as written.
• LAND USE PLAN Public Hearing Discussed
Joint Meeting with the Board of Supervisors to be planned & 100 copies to be printed
The Planning Commission discussed the following pros and cons:
a) How soon a Public Hearing should be planned.
b) Would a joint meeting with the Board eliminate duplication?
c) Would a joint meeting with the Board prevent separate problems being solved?
d) Should black and white or color maps be printed for distribution?
e) Amount and expense of the distribution copies.
Mr. Berg, upon inquiry, stated that black and white copies had been distributed to
the Board and Commission for their examination to save on expense. He said that full
color maps would take as long as thirty (30) days to be printed at a cost of five to
six dollars ($5 -$6) each compared to one to two dollars ($1 -$2) for black and white
prints. He suggested color printing be delayed until the Land Use Plan is adopted.
Mr. Berg also suggested that color prints be reproduced in large size for display
• at such places as the library, Chamber of Commerce and the County Administrator's
office. He said that the 1990 Land Use Plan map has to be done in large scale and
color. He also said that he saw no procedural problem with a joint Public Hearing

because the creative comment had..been taken.
Upon motion made by Frank Brumback, seconded by James Golladay, Jr. and approved
• by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback; Chairman - YES:
BE IT RESOLVED, That the Planning Commission fDr the County of Frederick, Virginia
does hereby direct the Secretary to make arrangements with the Board of Supervisors
for joint Public Hearings with the Board of Supervisors on the LAND USE CHAPTER of the
Comprehensive Plan.
Upon motion made2by Elmer Venskoske, seconded by Manuel C. DeHaven and approved
by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback; Chairman - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby direct the Secretary to have printed one hundred (100) black and white
copies of the LAND USE CHAPTER of the Comprehensive Plan for distribution sale and=
four (4) to six (6) large, color display maps to be placed where needed for public
review.
Mr. Brumback suggested extensive publicity would be very helpful.
SPECIAL ZONING ORDINANCE EXCEPTION STUDY COMMITTEE discussed
Postponed due to insufficient Commissioners available.
Mr. Berg stated, upon the Chairman's inquiry, that there is no urgency for this
• matter.
The Chairman directed the Secretary to put this item on an agenda for a future
meeting due to lack of members available for such a committee and the item's lack of
urgency.
SUBDIVISIONS
Dav -Mar Village ® II, Back Creek Magisterial District, Route 621, R -2 Zoning. Approved
by Frederick - Winchester Health Department and State Department of Highways and Trans-
portation. Staff review completed.*
Action - Recommended Approval
Mr. Berg stated that the Health Department had approved two (2) drainfield sites
for each lot, and the Highway Department had approved the roadway, as well as increased
drainage culverts on Route 629.
* Mr. Berg asked the Commissioners to notice the new agenda notation of "Staff
review completed" which will be continued and reflects on -site reviews by engineering,
• planning and administrative departments.
Mr. Jim Barnett appeared before the Commission and stated that Section I (located
on road frontage) has seventeen (17) lots, Section II has fourteen (14) lots, and

Section III would have eighteen (18) lots. He said that Section I will "soon be com-
pleted, and that all the lots average approximately one (1) acre each.
• Mr. Barnett stated the following facts:
a) The homes average $70,000 to $130,000 in sales price range.
b) Some of the lots in Sections I and II have 1 -1� acres, depending upon the lay of
the land.
c) The percentage of land area in Section III is somewhat larger with more roadway
area.
d) All lots have individual wells and septic tanks.
e) Striving for a superior subdivision; so, using 50 -foot setback rather than 35 -foot.
f) Majority of the inquiries are from local people, with a few from out of town.
g) The well depth average per lot is 125= to 150' and 135= to 160', with one only at
a depth of 400'.
Mr. Barnett continues that, yes, it would be possible to put in one central water
system, but it was his understanding that it would be quite involved for this area;
even though he felt it would indeed be ideal.
He stated that he had purchased this 60 -some acre-tract approximately 3 to 4 years
ago.
Mr. Brumback, who lives in the::area of the proposal, expressed his concern about
• who would bail out the lot purchaser should the septic systems fail, with no backup
systems planned.
In response to inquiry, Mr. R. W. Williams (Frederick- Winchester Health Department)
stated that he knew of no gauge to determine how much density would create a septic
system saturation problem, but that soil contamination is possible whenever using
septic systems and drainfields. He said that the area contains no known caverns, so
his department had no- alternative but to approve the proposal.
The Commission discussed having recommended denial on similar requests because of
soil contamination, etc., that are possible with 40,000- square foot lots versus the
areawide trend in the vicinity of the - proposal.
Upon motion made by Manuel C. DeHaven (because.of the tax -based house proposed even
though the lot size averages one acre), seconded by James Golladay, Jr. and approved
by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback; Chairman - YES:
• BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby recommend approval to the Board of Supervisors of said County of the Dav-
Mar Village Subdivision § II, Back Creek Magisterial District, Route 621, R -2 Zoning.

Mr. Berg stated that the Senseny Heights Subdivision - Blocks C & D, Final Plat of
June 25, 1976, Shawnee Magisterial District, R -3 Zoning, off Senseny Road and served
• by Massie Drive, E. L. and Ruth E. Peters (owners) had been removed from the agenda
because only part of the subdivision will be served by Winchester water and sewer and
more information is needed from the Sanitation Authority of Frederick County, as well
as the matter of staff inspection.
Mr. Berg stated that the Albin Acres Subdivision - Lots 8 -19, Gainesboro Magisterial
District, Route 679, R -1 and A -2 Zoning, Fruit Hill Orchards, Inc. (owner) for single-
family dwellings had been removed from the agenda because it was not yet completely
prepared for review.
SITE PLAN
Alvin & Frank Tavenner (Mobile Trailer Court) Site Plan Application No. 31 to add
twelve (12) spaces to existing seventy (70) spaces that would total eighty -two (82).
Approved by Frederick - Winchester Health Department and State Department of Highways
and Transportion..

Mr. Berg stated that the Health Department had inspected the drainfield sites, and
that the twelve (12) proposed additional spaces exceed ordinance requirements with
recreation and play areas to be provided at the rear of the new lots.
Mr. Alvin Tavenner appeared before the Commission and stated that the plans are to
put in ten (10) new spaces now and the other two (2) in approximately a year or more.
He said that the total of eighty -two (82) is all the spaces they want -- no more.
He stated that they have a contract to surface the road; that the.density is approxi-
mately 3 per acre; there would be three (3) chlorinated water wells (central system)
and one (1) septic system per each two (2) trailers (individual system); and a lot of
trees.
Upon motion made by Elmer Venskoske, seconded by Frank Brumback, and approved by
• the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby recommend approval to the Board of Supervisors of said County of the Site
Plan Application No. 31 by Alvin and Frank Tavenner for an additional twelve (12)
spaces to their trailer court. /

PUBLIC HEARINGS
An Ordinance to amend the Frederick County Zoning Ordinance adopted November 1, 1973
• to AMEND Section 10 -1 -23 to read:

does hereby recommend approval to the Board of Supervisors of said County of the amend-
ment as above to Section 10 -1 -23.
An Ordinance to amend the Frederick County Zoning Ordinance adopted November 1, 1973
to DELETE Sections:
2 =7. Special provisions for Mobile Home Subdivisions
2 -8. Frontage regulation

Upon motion made by Elmer Venskoske, seconded by Manuel C. DeHaven and approved by
the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback - YES:
• BE IT RESOLVED; That the Planning Commission for the County of Frederick, Virginia
does hereby recommend approval to the Board of Supervisors of said County of the amend-
ments as above to Sections 2 -7, 2 -8, 2 -9, 3 -7, 3 -8 and 3 -9.
An Ordinance to REPEAL the Ordinance adopted December 26, 1973 to regulate the location,
construction and operation of trailer camps in Frederick County, Virginia.
Upon motion made by Frank Brumback, seconded by Elmer Venskoske and approved by
the following vote: DeHaven; Golladay, Jr.; Venskosek; Brumback - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby recommend approval to the Board of Supervisors of said County of the amend-
ment as above to REPEAL the Ordinance adopted December 26, 1973 to regulate the location,
construction and operation of trailer camps in Frederick County, Virginia.
CONDITIONAL USE PERMITS
Theodore H. Sisk CUP Appl. No. 67, Shawnee Magisterial District, R -2 Zoning, located
North side of Route 50, just West of Perry Engineering Company, to use existing garage
(26'X50') as an antique shop with additions to include a 20'X50' section now and a
20'X24' addition in the future.
Action - Recommended Conditional Approval
• Mr. Berg described the proposal's location and stated.that the Frederick - Winchester
Health Department had made no comment.

Mr. Berg quoted the following review comment by Mr. R. C. King, Virginia Department
of Highways and Transportation of July 1, 1976:
• "It appears from Mr. Sisk's letter that there will not be enough activity at this
location to require the construction of a commercial entrance at this time. The existing
entrance may be used if no improvement is made. If improvement is attempted it will be
necessary to construct a commercial entrance to meet our current standards."
Mr. Berg stated that the staff suggests the permit expire with the sale of the
property.
Miss Sharon Sisk (applicant's daughter) appeared before the Commission and stated
that the proposal would be a family business only of which seventy percent (70 %) would
be wholesale. She stated that the plans are for the first addition to the building to
be used for storage (to the rear) with a later addition to the left -hand side to be
used for refinishing.
Upon motion made by Frank Brumback, seconded by Elmer Venskoske and approved by
the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby recommend approval to the Board,.of Supervisors of said County of the
• Conditional Use Permit Application No. 67 by Theodore H. Sisk, with the following
conditions:
a) Permit would expire upon property sale.
b) Permit would expire upon termination of the proposed use.
c) A commercial entrance would be constructed to meet standards of the Virginia
Department of Highways and Transportation upon sufficient increased activity
and /or improvement of the proposal that would make such a commercial entrance
necessary.
SECOND PLANNING COMMISSION MEETING OF JULY CANCELLED
•
The Commission discussed the cancellation of the Board of Supervisors meeting cancel-
lations for July 28, 1976 and August 11, 1976 in relation to the normal flow of business
from the Commission.
The Chairman announced the Commission's consensus of opinion that the next July
meeting (July 21, 1976) is cancelled and the next meeting would be the first regular
meeting in August (August 4, 1976).

STUDY COMMITTEE - Development Data and Costs
Assigned: Frank Brumback, H. Ronald Berg & Supervisor invited to serve.
• Mr. Brumback suggested that the following information would be helpful to the Com-
mission in calculating development costs:
a)
Number
of
children per mobile home.
b)
Number
of
mobile home parks in Frederick County, Virginia.
c)
Number
of
residential areas and developments in Frederick County, Virginia.
d)
Cost per
child for one year of education.
e)
Number
of
zoned residential lots.
f)
Number
of
residentially zoned land.
The Chairman, following a discussion, appointed Frank Brumback and Ronald Berg to
serve on this committee, and asked Mr. Berg to invite a Supervisor to also serve.

BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby adjourn its meeting; there being no further business.
