PC_09-07-77_Meeting_Minutes • MINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Room September 7, 1977 PRESENT: C. Langdon Gordon, Chairman; Frank Brumback, Vice Chairman; Manuel C. DeHaven; James Golladay, Jr.; W. French Kirk; Thomas Rosenberger; Elmer Venskoske ABSENT: R. Wesley Williams CALL TO ORDER The Chairman called the Meeting to Order and proceeded to the First Order of Business. Minutes of the Meeting -- August 17, 1977 -- Approved as Submitted BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia does hereby approve the minutes as submitted for the meeting of August 17, 1977. • Upon motion made by James Golladay, Jr., seconded by Frank Brumback and approved by the following: Kirk; DeHaven; Golladay, Jr.; Venskoske; Brumback; Rosenberger; Chairman - YES Request from the LFPDC Mr. Berg told the Commission Mr. Thomas Christoffel from the Lord Fairfax Planning District Commission'was supposed to give a presentation but he had asked to have it postponed for a month. Mr. Berg briefed the members, telling them there was to be a study of the rural subdivision. He stated that he had told the LFPDC that Frederick County's main concern was for the large lot sub- divisions. A discussion was carried on by the Commission about the large lot subdivi- sions. It was decided to discuss this subdividing with :the Board of. Supervisors at • ,their joint meeting. 309 (P /C 09/07/77) p 2 • Mr. Berg announced that the joint meeting of the Planning Commission and the Board of Supervisors would be held on September 14, 1977. Mr. Berg presented a memorandum that he had prepared for the Board of Supervisors informing them of the work program of the Planning Commission for the coming year. The Commission's consensus was to i the memorandum with the Board agenda so that they would have time to consider the items on the list. WORKSESSION Mr. Berg reminded the Commission at the last meeting they had talked about the four (4) business zones and decided to start the maps to go along with the districts. Mr. Berg told the Commission he had taken the Stephens City Map and coded it three different ways and now he needed to know which one they wanted to • consider. - The Commission members discussed the maps and decided it would be better . to talk it over with the Board of Supervisors at the joint meeting to find out their preferences. It was also decided to find out some tax figures on different properties and see if the properties were being taxed according to their zoning. BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia does hereby table the zoning maps until the joint meeting with the Board of Supervisors on September 14, 1977. Upon motion made by James Golladay, Jr., seconded by Frank Brumback and approved by the following vote: Kirk; DeHaven; Golladay, Jr.; Venskoske; Brumback; Rosenberger; Chairman - YES The Chairman called a recess until 3:00 PM for the Public Hearings. The Chairman called the meeting back to order. • 310 ■ (P /C 09/07/77) p 3 • PUBLIC HEARING Zoning Map Amendment Petition No. 012 -77 of JIC, Ltd., 32 E. Main Street, Berry- ville, Virginia hereby requests that 10.00 acres more or less, located on Route 91728 just off Route 50 now zoned Industrial - General (M-2) be rezoned: Industrial - Limited (M -1). This property is designated as parcel No. 80 on Tax Map 64 and is in Shawnee Magisterial District. Action - Recommend Approval Mr. Berg told the Commission the property to be rezoned consisted of two parcels of five (5) acres each. He said the ten (10) acres under consideration were part of twenty (20) acres which were rezoned M -1 to M -2 in 1974; and the other ten (10) acres were rezoned back to M -1 in June 1977. Mr. Berg stated one of the five (5) acre tracts (Tract 114) was to be put to the following use:' tire storage warehouse, rental warehouse, office, mechanical repair building with repair bays, truck and farm tire repair shop with canopy, retread shop, equipment company, and retail tire store. Mr. Berg said the following buildings would be • constructed in the near future: one building of approximately 12,800 square feet for warehousing, one building of. approximately 6,000 square feet for office and mechanical repair building plus 1,000 square feet of canopy. He stated 15,000 square feet is being planned for future buildings. Jean Clark, representing JIC, Ltd., appeared before the Commission and told them the one five (5) acre tract was under contract with Tire Distributor. Mr. Charles Rinn, representing Tire Distributors, Inc., appeared before the Commission and told them they hoped to start building within thirty (30) to sixty (60) days and finish in early Spring. He showed the Commission members the plans for the projected buildings. Mr. Rinn said they would eventually have about twenty -two (22) employees. 311 1 J o (P /C 09/07/77) p 4 • BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia does hereby recommend approval to the Board of Supervisors of the Zoning Map Amendment Petition 11012 -77 of JIC, Ltd. Upon motion made by Frank Brumback, seconded by W. French Kirk and approved by the following vote: Kirk; DeHaven; Golladay, Jr.; Venskoske; Brumback; Rosenberger; Chairman - YES Request from the City Planning Commission The Chairman read a letter from Mr. Reed T. Nester, Winchester Planning Director, asking for comments on a rezoning since a portion of the rezoning and a portion of the Future Land Use Map being reviewed were adjacent to the City- County boundary. The letter was in regards to the rezoning of the south side of Amherst Street between Route 1137 and Merriman's Lane. The letter stated the Commission would also be considering whether or not any changes should be made to the Future Land Use Map portion of the Winchester Comprehen- • sive Plan on the north side of Amherst Street between Route 1137 and Myrtle Avenue. A discussion was held and although in the past the Planning Commission for the County had only thanked the City Planning Commission for informing them of the rezonings which affect both jurisdictions the following motion was made: BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia does hereby recommend to the City that until we have a further plan in the County and the City on the future use of the land surrounding the cloverleafs of Route 37, that this rezoning should be denied. Upon motion made by Thomas Rosenberger, seconded by Elmer Venskoske and approved by the following vote: DeHaven - NO Kirk; Golladay, Jr.; Venskoske; Brumback; Rosenberger; Chairman - YES Upon further discussion the following action was taken: BE IT RESOLVED, That the Planning Commission for the County of Frederick, - • Virginia does hereby recommend that a study group be appointed to make a recommendation to both Commissions. \ 312 (P /C 09/07/77) p 5 Upon motion made by Frank Brumback, seconded by James Golladay, Jr. and • approved by the following vote: Kirk; DeHaven; Golladay, Jr.; Venskoske; Brumback; Rosenberger; Chairman - YES Adjournment Upon motion made by James Golladay, Jr., seconded by Elmer Venskoske and approved unanimously, BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia does hereby adjourn its meeting; there being no further business.
