CALL TO ORDER
The Chairman Called the Meeting to Order and proceeded to the Fiist Order
of Business.
MEETING MINUTES -- May 4, 1977 -- Approved as Submitted

Upon motion made by James Golladay, Jr., seconded by Frank Brumback and

BE IT RESOLVED, That the Planning Commission for the County of Fiederick,
• Virginia does hereby approve the Minutes of the Meeting of May 4, 1977 as
submitted.
L. F. P. D. C. COMPREHENSIVE PLAN
Mr. Berg itemized criticisms and comments that included:
I
(1) Income analysis on page 82: The section should be updated to show
the most recent data available.
(2) Future population section: The population projections should be
updated to reflect the most recent information from Tayloe- Murphy.

(3) Editorial Comment Objective E on page 173: Commercial areas should
please community as well as consumer.
(4) Agricultural Land Use - -page 182 - should mention agricultural
districts.
(5) Implementation Methods - page 194 - Section should include as
part of zoning, site plans regulations. Also this section should
state that the official map device is rendered very nearly worth-
less by the limitation in the Code.

(6) Under Frederick County on page 209 there is a list of four 1 (4)
conflicting recommendations. The last recommendation should be
• dropped since it conflicts with the three above it.
(7). The Frederick County section on page 210 should state that public
service costs are in 1973 or 1974 dollars.
The Chairman directed Mr. Berg to communicate the comments to the Lord
Fairfax Planning District Commission (LFPDC).
SITE PLAN
No. 010 -77 Miller Tool Service -- M -1 Stonewall Magisterial District. 16
acres on east side of Route 11, just north of Frederick Motor Company.
Action - Recommended Approval
Mr. Berg stated that the Land Disturbing Permit is in the process of
being issued. The area has been reviewed for potential flood plain and
is above the flood plain. The Health Department has found suitable sites
for septic systems. The Highway. Departments' comments are not required.
® The zoning requirements are met.
Mr. Russell D. Miller owner, appeared and stated he had been in the
machine shop business for quite a few years and has always tried to run a
clean business in about three locations in town. The present operation is
getting larger and he has plans for future expansion. There will be no
junky storage outside of the building. The balance of the tract will be

used for hay crop and will be kept clean. The roadway will have to include
a culvert, and it will be adequate even though it will not be blacktopped
yet. He will use 18 feet easement for the roadway. He is undecided which
route to use for future extension of the roadway but he would like to keep
that option open. He feels the business will be an asset to that location.
There is a total of 100 feet right -of -way - 40 feet utility right-of-

way and 60 feet usable easement for a private roadway.

The Commission discussed with Mr. Miller the location and possibility of
• his connecting to County water and sewer..
Upon motion made by Manuel DeHaven, seconded by Frank Brumback and approved
by the following vote: Chairman - ABSENTION

BE IT RESOLVED, That the Planning Commission for the County of Frederick,
Virginia does hereby recommend approval to the Board of Supervisors of the
Site Plan No. 010 -77 - Miller Tool Service.
SITE PLAN
No. 014 -77 Econo Lodge Motel -- B -2 Shawnee Magisterial District. Route 50
east, 24 unit addition to existing motel.
Action - Presented for Information of the Commission
Mr. Berg described a routine Site Plan that he had brought to the Commissioners
attention because of the great amount of citizen comment that had been received
during the rezoning proceedings. He said this application is in accordance with
plans that had been outlined at that time and required no action by the Planning
Commission unless the members so decided.
Fred Showalter (Howard Shockey & Sons, Inc.) appeared and statedithat there
would be 24 units added to the present building. It is a two story building -
six (6) units below and six (6) above.
The Chairman directed the Secretary to proceed with routine staff review
of this application.
GENERAL
The Chairman directed the Secretary to follow the Commission's consensus
to include location maps in their agendas for all Site Plans, Conditional
Use Permits, etc. Mr. Berg agreed to do so whenever he had available repro-
ducible copies.

CONDITIONAL USE PERMIT
• No. 005 -77 Battle of Cedar Creek Campground -- A -1 Opequon Magisterial District.
25 acres located on Route 11 South at Cedar Creek. A portion of this camp-
ground is in Warren County. I
Action - Tabled until Warren County Replies
Mr. Berg read the application for a recreational campsite area and showed
the location map. Mr. Berg said there is over 100 feet of Route 11 right -of-
way and 60 feet zoning setback to be observed. The staff feels the driveway
should be extended with traffic flow direction shown. His request for comment
on the portion in Warren County had not yet been answered. They had written
that their Planning Commission would review the proposal on May 11, 1977. Mr
King has reviewed and approved the highway entrance. Mr. Musick has made soil
evaluation and found that there are two or three sites for septic tank drain -
fields. Mr. Berg quoted the comments made by Middletown's council members on
• May 12, 1977. Mr. Maccubbin, Deputy County Engineer has reviewed and commented
that the high -water mark to the rear of the property is consistent with flood

maps. The State Health Department will police sanitary facilities on the site.
Mr. Woodrow D. Cornwell (property owner) and Douglas Legge (land'surveyor)
appeared before the Commission.
Mr. Cornwell stated that he had made every attempt to follow state require-
ments through every planning stage. He also added that in the future he plans
to add 20 campsites per acre. There are 83 lots in the first section. Recreation
is available all along Cedar Creek, all along Route 11 in the vicinity of the
ravine, Lot 76 is a recreational area on top of the hill, and Cedar Creek is nice
for boating. He claimed the lime kiln dust is responsible for pollution of Cedar
Creek and that 90% of the trailers will be self contained, and the other 10% will
plan to use the bath facilities and dumping station. He has talked with Messrs.
• David Alexander and Millar of the State Health Department.

Mr. Legge remarked there would. about four (4) lots in Warren County.
® There are a total of 126 lots planned for the site. The entrance would have
to be paved back to the property line.
Mr. Williams told the Commission that the campground falls under the
jurisdiction of the Tourist Establishment Bureau which would make routine
inspections. He stated that he thought two (2) drainfields, would be
sufficient. If sink holes were evident, the department wouldn't locate
drainfield sites. Mr. Williams added that the Health Department does not
recognize a stream as a proper swimming facility. The State Water Control
Board would check the stream's water pollution only upon complaint or request.
OPPOSITION
Mrs. Eleanor (C. Ridgely) White (President of Belle Grove, Inc.) appeared
and told the Commission that she was concerned because the proposed campground
• adjoins a piece of property presently owned by Belle Grove, Inc. and Donald
Bayliss. There are no present plans for the property but in the future it
may be part of a historical zone. She is concerned about the natural beauty
and aesthetic value of the area and also the overcrowding of the proposed
campground. She expressed hope that the Commission would impose restrictions
to effect high standards and plentiful landscaping.
Mr. Berg said the Land Use Plan designates the area as reserved for
agricultural open space. There would be seven (7) or eight (8) lots in
Warren County.

approved by the following vote: DeHaven; Golladay, Jr.; Brumback;
Rosenberger; Chairman - YES
BE IT RESOLVED, That the Planning Commission for the County of Frederick,
Virginia does hereby state the letter of May 18, 1977 from Mr. Paul Popkins
of Winchester, Virginia, has been read and is located in the file.

Stonebrook Farms Section VII - 20 lots, Section VIII - 46 lots -- R -2 Back

Health and Highway departments have approved.
Action - Recommended Approval
Mr. Berg stated that the County Engineering Department had reviewed the
streets and drainage easements and found them to be correct and within the
ordinances. He showed the Commission the overall plan for the subdivision.

Mr. Berg stated there is no guide which determines how many septic systems
you can put in an area before it is saturated. He added there possibly could
be problems created in the future in this development.
Mr. Williams agreed with Mr. Berg, however, as long as the soil evaluation
per lot is in conformity with the Zoning Ordinance his Department would have to
pass it and this area does have good soil.

Mr. Glass maintained that it would be very difficult financially if a
• developer were not:to be allowed individual well and septic systems at this
point. He said that the development has a hill that is the second highest
elevation in Frederick County (965 feet) which would prevent central water
and sewer. He stated he had complied with all requirements since he had
presented his master plan. Due to finances it has been only possible to
develop one section at a time. There are 45 lots still remaining to be
developed.
The Chairman opined that Mr. Glass shouldn't be penalized at this stage
of his development without sound, legal reasons.
Upon motion made by Frank Brumback, seconded by Thomas Rosenberger and
approved by the following vote: DeHaven - NO

Memo on Signs
Mr. Berg reminded the Commission of the Public Hearing which has
advertised at 7:30 P.M., Tuesday, May 31, 1977.

GENERAL
Mr. Berg reminded the Commission of the joint meeting to be held with
the Board of Supervisors at 7:00 P.M., Monday, June 6, 1977.
Zoning Actions
Mr. Berg submitted an interim progress report containing 100 previous
zoning actions. Chairman stated consensus, accept that the Commission would
0 like the reports and requests to include approval dates.

Mr. Berg made the following recommendations to the Commission:
(1) Recommend Lot A to remain zoned business.
(2) Recommend Lot B be rezoned to residential.
Mr. James R. Wilkins developer, appeared and showed the Commissioners
an uncertified plot plan. He reiterated the arguments against any rezoning
the he had presented at the previous meeting of the Commission. He said
he had an obligation to the Frederick County Sanitation Authority of $21,500
to provide water and sewer connections.
There was a discussion held concerning the inconvenience.of "the subdivision

anticipated completion of the project by the middle of the summer. He is
willing to screen the rear of Lot A with trees, not to allow trash dumpsters
on the lot, and to screen the rear of the parking area with white pine trees.

congregation in the parking lot.

failed by the following vote: DeHaven; Rosenberger - YES
