CALL TO ORDER
The Chairman Called the Meeting to Order and proceeded to the First Order of
Business.
MEETING MINUTES - January 5, 1977 - Approved as Corrected
Upon motion made by James Golladay, Jr., seconded by Elmer Venskoske and approved
by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback; Chairman - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby approve the Minutes of the Meeting of January 5, 1977 as corrected.
POLICIES and PROCEDURES
• The Commission discussed precedent and intention of an applicant requesting a
change from heavy to light (and vice versa) zoning at the Public Hearing.
Upon motion made by Frank Brumback, seconded by James Golladay, Jr. and approved
by the following vote: DeHaven; Golladay, Jr.; Venskoske; Brumback; Chairman - YES:
. BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby initiate as a procedural policy that Zoning Map Amendment Petitions must
be re- submitted and re- advertised if the application is to be amended.
The Chairman asked the Secretary to include on an agenda for informational purposes
zoning applications to be heard at the following meeting.
OLD BUSINESS
RECONSIDERATION of Zoning Map Amendment Petition Number 023 -76 of DENNY'S INC., Rt.
7,.Box 81, Winchester, Va. requesting rezoning of 20.266 acres, more or less, located
South of Rt. 7 (behind the American Legion), now zoned Residential- Limited (R- 2),:to
Business - General (B -2). This property is designated as parcel Nos. 107(A), 41(A) on
tax maps 54, 55 and is in Stonewall Magisterial District. APPLICANT REQUESTING AMEND-
MENT of M -1 petition as originally filed.

Mr. Berg stated that the Board of Supervisors took no action on this petition at
their meeting of January 12, 1977, but had returned it to the Planning Commission
for re- consideration. He said that the applicant is now requesting M -1 zoning as
originally petitioned, withdrawing the B -2 petition.
Mr. J. Randolph Larrick appeared before the Commission as representative of D. T.
Cole of Denny's, Inc. He said that Mr. Cole does not.feel the property suitable for
business development because tlie;frontage.is limited. ,
A discussion followed of whether or not this re- amended petition should be re-
advertised.
Upon motion made by Manuel C. DeHaven, seconded by James Golladay, Jr. and approved
by the following vote: DeHaven; Golladay,,Jr.; Chairman - YES,
Venskoske; Brumback - N0:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby resolve to hear the re- amended Zoning Map Amendment Petition No. 023 -76
of DENNY'S INC. from Residential- Limited (R -2) to Industrial - General (M -1), rather
than,delay until another meeting date.
The following discussions then occurred:
a. What is meant by the word "near as it appears in the M -1
Statement of Intent in the Zoning Ordinance?
b. The permitted uses in M -1 zoning, and are they in the interest
of good planning for the area?
C. The surrounding and adjoining properties' zones.
d. Conditional Use Permit (contract zoning) is not enforceable.
e. Land Use Plan designation for this area of the County.
Mr. Berg stated that he had a theoretical concern about this petition for M -1
zoning; that the Route 7 interchange with Interstate 81 is one of the two best
commercial spots in the County, the other being Route 50 interchange with Interstate.
81. He said that the potential for the Route 7 interchange is as yet untapped, there-
fore, the danger exists of An activity occurring that would limit the attractiveness
and desirability of the area. As far as the road frontage of this property is con-
cerned, he said, there will eventually be enough activity occurring to combine
several tracts to gain frontage.

A motion by Manuel C. DeHaven, seconded by James Golladay, Jr., to recommend ap-
proval of the Zoning Map Amendment Petition No. 0 -76 of DENNY'S INC. from
Residential- Limited (R -2) to Industrial - General (M -1) was defeated by the following
• vote: DeHaven - YES, Golladay, Jr.; Venskoske; Brumback; Chairman - N0.
BUSINESS Z014ING (B -3) STUDY COMMITTEE
Upon motion made by James Golladay, Jr., seconded by Frank Brumback and approved
by the following vote: DeHaven; Golladay Jr.; Venskoske; Brumback; Chairman - YES:
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby form a committee to study B -3 business zoning feasibility for addition to
the Zoning Ordinance as a buffer between B -2 and M -1 zones, and to report at the next
scheduled meeting.
The volunteers, with the Chairman's sanction, were: James Golladay, Jr.

TRANSPORTATION PLAN DRAFT (Comprehensive Plan)
Changes that the Secretary had made to the Plan were discussed.
Mr. Brumback suggested separate maps for arterial and collector highway systems.
WATER and /or SEWER LINES in SUBDIVISIONS
Mr. Berg stated that where water service only is now available, the Sanitation
Authority will soon be providing sewer service. He said that individual wells would
• not be economicaly feasible, or necessary, for a developer.

It would almost never happen that a subdivision would have sewer and not water lines,
he said; and that water and sewer lines are not interchangeable in the Zoning Ordinance
• because of the area required for a drainfield. `
HOUSES POSITIONED ON LOTS
The Commission discussed the difference between City and County zoning laws and
development costs.
It was the Commission's consensus that it was comfortable with an eighty -foot lot.
Mr. Berg mentioned the difficulty that is created when houses are built in the
middle of a lot rather than to one side.
IDLE, REZONED PROPERTY
Mr. Brumback stated that he would like to see a review made of properties that
had been rezoned, but had remained idle for a number of years for the consideration
of re- classification.
BEAUTIFICATION COMMITTEE
• Mr. Berg summarized the progress.of the Beautification Committee.
COMMISSION MEMBERSHIP -- Elmer Venskoske Re- Appointed
The Chairman stated that he had received a letter from the County Administrator
stating that Mr. Venskoske had been re- appointed by the Board of Supervisors for
another four -year term on the Commission.
