OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Room June 21, 1978.
PRESENT: C. Langdon Gordon, Chairman; Frank Brumback, Vice Chairman;
Manuel DeHaven; James Golladay, Jr.; W. French Kirk; Thomas
Rosenberger; Elmer Venskoske; Herbert L. Sluder
ABSENT: None
CALL TO ORDER
The Chairman called the meeting to order and proceeded to the first order
of business:
Minutes of the Meeting -- June 7, 1978 -- Approved with Correction
page 457 add to Mr. Golladay's statement that "he didn't feel the application
should be heard since the comments from the City of Winchester on the availability
of water and sewer had not been received ".
Upon motion made by James Golladay, Jr. and seconded by Elmer Venskoske,
BE IT RESOLVED, That the Planning Commission for the County of Frederick,
Virginia does hereby approve the minutes of June 7 with the one correction.
The motion passed by the following vote: Kirk; DeHaven; Golladay, Jr.;
Venskoske; Brumback; Rosenberger;
Chairman - YES
Meeting Announcement
Mr. Berg told the Commission the Virginia Citizens Planning Association, Inc.
was sponsoring a second INSTITUTE FOR PLANNING COMMISSIONERS to be held on September
24 -26. He stated a topic of the meeting was to be on Conditional Zoning. A
discussion was held on "Conditional Zoning" and Mr. Berg explained this would be
a means by which the applicant could place conditions on his rezoning request.

CONDITIONAL USE PERMIT
Conditional Use Permit X1003 -78 request by William and Onile Griffith for a
grocery store at Route 522 and Route 654.
Action - Tabled
Mr. Berg told the Commission this was a request for a grocery store to
be located on Route 522 north at Nain. It was being proposed that an existing
building be remodeled and that a roadway entrance be obtained from Route 522.
Mr. Berg stated the Health Department and the Highway Department had approved
the permit.
Onile Griffith, applicant, appeared before the Commission and told them
she wanted to remodel the building for the grocery store. She stated she
had talked with the Health Department and the Highway Department and had also
obtained estimates from Howard Shockey & Sons, Inc. on building the road.
A lengthy discussion followed and it was noted that the entrance could
be hazardous because of the heavy flow of traffic on Route 522.
It was noted that several of the Commission members would like to view the
location before any action would be taken therefore, the following motion was
made by Thomas Rosenberger and seconded by Manuel DeHaven,
BE IT RESOLVED, That the Planning Commission for the County of Frederick,
Virginia does hereby table this application until the meeting of July 5 so that
all the Commission members may view the location.
The motion passed by the following vote: Kirk; DeHaven; Golladay, Jr.;
Venskoske; Brumback; Rosenberger;
Chairman -- YES
The Commission held a discussion on the adjoining property owners of this
permit. It was the consensus of the Commission that the adjoining property owners
be notified that this permit would be discussed and acted upon at the July 5
meeting.

Stonewall (Gilpin) Development Park
Mr. Berg told the Commission this was to be a presentation and discussion
of the master plan for the Stonewall (Gilpin) Development Park.
Mr. Roy Parks, Planner from the Environmental Interface, Inc., presented
a series of drawings showing existing conditions, land use, and a preliminary
development plan. Mr. Parks pointed out that there could be an industrial
district that could be rail dominated; an industrial district that could be
auto /truck dominated; an industrial district that could be auto dominated;
a commercial district; and a residential district. He stated that the 500
acres would probably be too many acres to hold for industrial use therefore,
they perhpas would like to use about 100+ acres for a housing district (upon
rezoning approval by the governing body). Mr. Parks stated that the main access
road from the Park would be on to Route 661.
The Commission showed a concern for segregating the large and small lots.
Kenneth Gilpin and Tyson Gilpin, property owners, appeared before the
Commission and presented a copy of the deed covenant and restrictions that they
had prepared for the park. Mr. Gilpin told the Commission that they were making
progress with the water and sewer into the park. He stated that he hoped they
could work with the Planning Commission and the Board of Supervisors and maybe
"phased" approval could be given on site plans so that he could install the water
and sewer lines and sell his lots at the same time.
A discussion followed on the entrance onto Route 661 and Route 11 and who
would be responsible for widening the road when the traffic increased from the
Park. Mr. Gilpin stated he would do everything he could to work with the Highway
Department but he felt it was the Highway; Department's responsibility to obtain
rights -of -way.

A discussion was held on the deed covenants and restrictions and Mr. Gary
Dove of Davenport Insulation Co., Inc., whose subdivision request is pending
action of the Board of Supervisors, was present and stated that he approved
of the deed covenants and restrictions and his firm could abide by them.
Mr. Rosenberger stated that he thought if the deed restrictions were made
a part of the Subdivision request for Davenport Insulation Company when it went
before the Board of Supervisors, he felt the request would have more information
than the Commission had and it may speed things along.
Upon motion made by Thomas Rosenberger and seconded by Manuel DeHaven,
BE IT RESOLVED, That the Planning Commission for the.;County of Frederick,
Virginia does hereby recommend that the deed covenants and restrictions go to
the Board of Supervisors along with the subdivision request for the Davenport
Insulation Company, Inc.
The motion passed by the following vote: Kirk; DeHaven; Golladay, Jr.;
Venskoske; Brumback; Rosenberger;
Chairman -- YES
Mr. Golladay commented that he would vote "yes" but he felt every time the
Commission gets in a hurry something happens, but as long as Mr. Dove had read
the restrictions and could abide by them then he would go along with the motion.
Mr. Brumback stated that he would concur with Mr. Golladay and added that
he too would vote "yes'.' as long as Mr. Dove was aware :of the restrictions.
Mr. Dove assured the Commission that he had read the deed covenants and
restrictions and that his firm could abide by them.
Mr. DeHaven led the Commission into a discussion on the subdivision of the
property of Charles Orndoff located on Route 671. Mr. DeHaven stated that Mr.
Orndoff had lived in the house for many years and now he was subdividing the land
so that he could sell the house and maintain the slaughterhouse. He stated that
there was a problem with the Health Department approving the lot with the house
and he wondered if the Commission could do something about the request.

Charles Orndoff, applicant, appeared before the Commission and told them
the house had been on the lot for fifty -five (55) years. He told the Commission
that he had been told that the Health Department had approved the lot and then
the Health Department had called and said they could not approve the lot because
the house had a cesspool instead of a drainfield.
The Commission pointed out that their policy was to have all comments from
the different agencies before they heard any request. It was also noted that
the Commission could do nothing about the Health Department's decision on the
septic system. The Commission advised..Mr. Orndoff to meet with the Health
Department and get a comment from them and then they would hear the Subdivision
request.at their meeting of'July.5.
Worksession -- Zoning Maps
A worksession was held on the zoning maps. A lengthy discussion was held
and it was decided that the maps would be corrected to reflect the existing
land use, compliance with the Comprehensive Plan, and good zoning practices.
Anyone wishing a change in the maps would be requested to appear at a public
meeting.

Upon motion made by James Golladay, Jr., seconded by Manuel DeHaven and
approved unanimously,
BE IT RESOLVED, That the Planning Commission for the County of Frederick, Virginia
does hereby adjourn its meeting; there being no:further business.
THERE BEING NOTHING FURTHER TO COME BEFORE THE COMMISSION, THE MEETING WAS ADJOURNED.
