FREDERICK COUNTY PLANNING COMMISSION
Held in the Frederick County Administration Building, July 18, 1979, 2:00 p.m.
PRESENT: C. Langdon Gordon, Chairman; Frank Brumback, Vice Chairman; Manuel DeHaven
James Golladay, Jr.; W. French Kirk; Elmer Venskoske.
CALL TO ORDER
The Chairman called the meeting to order. No citizens were present for the
scheduled fifteen minute citizen comment session.
The Planning Commission discussed the Conditional Use Section of the Zoning
Ordinance. Ms. Stefen explained that she had reviewed State case law and had worded
the Conditional Use Section of the Zoning Ordinance to allow for more powers and to
give possible conditions that would be considered. It was noted that a Public Hearing
would be required at a joint meeting of the Board and Commission. It was further
discussed that costs should again be worked up for consideration by the Board to cover
the costs of advertising the conditional use permits. It was decided by consensus to
let the previously recommended fee of $75.00 stand. Ms. Stefen then noted that
Warren County makes use of conditional use permits instead of rezoning and conditional
zoning. In answer to a question, she also explained that adjoiners are notified per
the list supplied by the applicant. Ms. Stefen then suggested that conditional use
permits have signs available to the public at cost. It was suggested that a larger
size then the already used Board of Zoning Appeals sign be obtained. It was decided
to obtain signs at cost for availability to the public by consensus.
Discussion was then directed at the problem of conditional use permits being
granted for home occupations in buildings not yet built. It was felt that this should
be brought up at the next joint meeting of the Commission and Board.
Next, the discussion of down zoning took place. It was noted that a question
of the legality of down zoning without the landowners' request was a problem to consider.
It was suggested that Mr. Ambrogi be posed this question

It was also noted that only one R -6 area that could possibly be down
zoned - existed.
Mr. Rosenberger then made a motion to retire to executive session to
discuss legal matters. This was seconded by Mr. Golladay -.and passed- unanimously.
The .next matter for consideration by the Commission was a letter from
Donald Richardson introduced by Elmer Venskoske regarding possible violations of
two area companies, National Fruit Product Company and Winchester Rendering Company,
in disposing of waste on county land. A motion was made by Mr. Rosenberger and
seconded by Mr. Kirk to request the staff, Mr. Pangle, Public Works, to look into
this matter and report to the next worksession. This was passed unanimously.
The Commission next discussed the upcoming VCPA Institute for Planning
Commissions. Ms. Stefen suggested that those planning on attending let Mr. Duncan
know as early as possible, as funds are limited. Messrs. Golladay, Deaaven and
Venskoske indicated their interest at this time and Ms. Stefen noted she would
submit their names.
The next topic of discussion was the request for comment by Mr. Duncan
of the Lord Fairfax Planning District Commission regarding District Highway Projects.
It was noted that the Southern Loop had previously been discussed at a Commission
meeting and it was suggested that a copy of those minutes be forwarded to Mr. Duncan.
It was also suggested that this subject be put on the August 1, agenda.
It was also suggested that Parking Requirement -,changes of the Ordinance
be included for the agenda of August 1.
Mr. Venskoske then moved ..for adjournment. This was seconded by Mr. Golladay
and passed unanimously.
