Langdon Gordon, Chairman; Frank Brumback, Vice Chairman; Kenneth Stiles; W. French Kirk; Manuel DeHaven; Domenic Palumbo; George Romine; Herbert Sluder; A. L. Myers; James Golladay CALL TO ORDER The Chairman called the meeting to order. The first order of business, consideration of the minutes of October 7, 1981. Mr. Golladay noted that on page two, the eighth paragraph should read, "Mr. Horne stated that he is in the process of acquiring a copy of the bill for the Commission to review and comment on." There being no further corrections, Mr. Golladay moved for approval of the minutes as corrected. This was seconded by Mr. 'Kirk and passed unanimously. BIMONTHLY Mr. Golladay next inquired about the large increase in miscellaneous building permits from 1980 to 1981. Mr. Horne stated that because of the economic situation, many people are adding on to a structure as opposed to building a new structure. These permits would include such things as bedrooms, repair work, etc. Their being no further questions, the Chairman accepted the Bimonthly Report as information only. SITE PLANS Site Plan #013 -81 of Carter Service Industries, zoned M -1, Industrial- Limited, in the Stonewall Magisterial District. ACTION - Approval The Secretary read the background information. 1439 -2- Mr. Horne added that he did research the Board of Supervisors minutes to determine what conditions they had placed on site plan approvals. Mr. Horne stated that the Board of Supervisors would review site plans but would not allow occupancy of any buildings until the second access was completed. Mr. Horne noted that the second access is complete and it has been approved by the Department of Highways and Transportation. Marvin J. Cantor, architect for Carter Service Industries, next came forward and introduced himself to the Commission. Mr. Cantor stated that this job has been let out for bids to a number of general contractors, a price has come in and they will be ready to begin in 30 days. To answer Mr. Romine's question, Mr. Cantor explained that the business is for an industrial laundry. The main plant which is in Landover, Maryland, does the heavy laundry and this plant will do the light laundry. The laundry done in Maryland will be shipped here and stored here and deliveries will also be made from this location. To answer Chairman Gordon's question, Mr. Horne stated that this parcel of land was an existing parcel which had been subdivided within the last year. Mr. Horne commented that the parcel was not as large as five acres. Mr. Stiles questioned what percentage of the lot would be surfaced. Mr. Horne answered that the amount was low and certainly under the requirements of the ordinance. Mr. Horne next indicated the direction of water run -off on the site plan displayed. 1440 -3- In answer to Mr. Brumback's question on the rate of expansion, Mr. Cantor explained that there will probably be no expansion within the next five to seven years. Within 10 -20 years, however, the building may be expanded to twice its size. Mr. Cantor added that the 10,000 square foot parking and loading area would not be enlarged. This expansion, he continued, would only require one or two extra employees. There being no one present in the audience wishing to speak in favor or opposition to this request, Mr. DeHaven motioned for approval. This was seconded by Mr. Romine and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan Request No. 013 -81 of Carter Service Industries to construct a 10,000 square foot office and distribution facility. SUBDIVISIONS Broad Avenue Subdivision Request by David Holliday requesting the subdivision of an existing 1.3 acre lot into two housing lots of 32,000 and 24,373 square feet, located in the Shawnee Magisterial District. ACTION - Approval The Secretary gave the background information. Mr. Holliday came forward and stated that the recreational impact fee of $111 will be paid under protest. Mr. Horne commented that the Board of Zoning Appeals did rescind their previous action on this property at their last meeting. There being no one present in the audience wishing to speak in favor or opposition to this request, Mr. Palumbo motioned for approval. This motion was seconded by Mr. Brumback and passed unanimously. 1441 BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the Broad Avenue Subdivision Request of David Holliday to subdivide an existing 1.3 acre lot into two housing lots of 32,002 and 24,373 square feet. DEPUTY DIRECTOR OF THE DEPARTMENT OF PLANNING & DEVELOPMENT The Secretary announced that the position of Deputy Director of the Department of Planning and Development has been offered to Mr. Stephen Gyurisin who is presently with the Lord Fairfax Planning District Commission. Mr. Gyurisin has accepted the position and will be starting on November 2, 1981. NE MEMBER APPOINTE TO FREDERICK COUNTY PLANNING COMMISSION The Secretary next announced that on October 14th, 1981, the Board of Supervisors appointed Mr. Carl M. McDonald, of Whitacre, Virginia, as a new member at large to the Frederick County Planning Commission. The Secretary noted that Mr. McDonald will attend the November 4th meeting of the Planning Commission. DISCUSSION OF REGIONAL SEWER SITUATION The Secretary first reviewed population and income data compiled by the staff regarding the plan for the regional waste water treatment plant. Mr. Horne announced that the Service Authority has requested that anyone with questions concerning the sewage treatment plant should submit the questions in writing to the Service Authority before their next scheduled meeting. After considerable discussion, the Planning Commission posed several questions and directed the staff to submit them to the Service Authority along with the data compiled by the staff. 1442 -5- PUBLIC HEARINGS Conditional Use Permit No. 015 -81 of Virgil A. Wilkins, Sr., requesting a home occupation /accessory structure for an automotive repair shop. This property is designated as Parcel 3, (13) on Tax Map 87A in the Opequon Magisterial District. ACTION - Approved The Secretary gave the background information. Mr. Wilkins came forward and introduced himself to the Commission. Mr. Wilkins stated that the operation will only be on a part -time basis. Mr. Wilkins stated that his son will be doing the work which will basically consist of minor repairs and tune ups. Mr. Wilkins further explained that the building is presently used as a garage for his own private use. Mr. Horne stated that Mr. Wilkins' existing compound should be adequate for screening all outside storage. In answer to Mr. Golladay's question on the hours of operation, Mr. Wilkins replied that the hours will be daylight, 10:00 a.m. to 2:00 p.m. and some evening hours. Chairman Gordon next asked Mr. Wilkins if he was familiar with the conditions of the permit and Mr. Wilkins replied that he was. There being no one wishing to speak further, Mr. Golladay motioned to approve the conditional use permit with conditions. This was seconded by Mr. Stiles and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval of Conditional Use Permit No. 015 -81 of Virgil A. Wilkins, Sr., requesting a home occupation /accessory structure for an automotive repair shop with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission, and Board of Supervisors. 1443 2. If the use, occupancy or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. No one except members of the immediate family residing on the premises shall be employed. 4. On -site parking shall be provided. 5. All outside storage shall be fully screened from adjacent residential properties. 6. Daylight hours of operation only. Conditional Use Permit No. 016 -81 of Bernard and Sally McClung, Winchester, Virginia, requesting a home occupation for a model home. This property is designated as Parcel 198C on Tax Map 42 A in the Stonewall Magisterial District. ACTION - Approval The Secretary gave the background information. Mr. McClung came forward and introduced himself to the Commission. Mr. Stiles asked if anyone will be living in the home and Mr. McClung replied that this home is his primary residence. Mr. McClung explained that he is a distributor for the model home. Mr. McClung further commented that his closest neighbor is 600 -700 feet away. Chairman Gordon next asked Mr. McClung if he understood the conditions of the permit and Mr. McClung replied that he did. Mr. McClung next asked if he could erect a 3' X 4' sign at the entrance of the property. Mr. Horne replied that Mr. McClung has the right to erect an on- premise sign, not to exceed four square feet. 1444 -7- There being no one wishing to speak in favor or opposition to this request, Mr. DeHaven motioned for approval. This was seconded by Mr. Stiles and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval of Conditional Use Permit No. 016 -81 of Bernard and Sally McClung for a home occupation /accessory structure for a model home shown by appointment only, to the Board of Supervisors with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission, and Board of Supervisors. 2. If the use, occupancy or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. No one except members of the immediate family residing on the premises shall be employed. 4. On -site parking shall be provided. Mr. Horne announced a Worksession meeting to be held on October 27th at 7:30 p.m.; the topic of discussion being Agricultural and Rural Lands Policy. There being no further business to discuss, Mr. Golladay moved for adjournment. This was seconded by Mr. Stiles and passed unanimously.
