FREDERICK COUNTY PLANNING COMMISSION
Held in the Soard of Supervisors' Meeting Room, October 7,
1981.
PRESENT: C. Lanodon Gordon, Chairman; Frank Brumback, Vice - Chairman;
Kenneth Stiles; W. French Kirk; Manuel DeHaven; Domenic
Palumbo; George Romine; Herbert Sluder; A. L. Myers; James
Golladay.
CALL TO ORDER
The Chairman called the meeting to order. The first order of
business, consideration of the minutes of September 16, 1981.
Mr. Golladay noted a typographical error on page four of the
minutes. He also noted that on page seven, fourth paragraph should
read as follows:
Mr. Golladay stated that previously the Comprehensive Plan
Update Subcommittee was under the assumption that the plant would be
built, but not within the next five years. Mr. Golladay further noted
that a plant has not been accounted for in the current update of the
Comprehensive Plan...
Mr. Kirk next motioned to approve the September 16, 1981
minutes as corrected. This was seconded by Mr. Golladay and passed
unanimously.
BIMONTHLY
In answer to Mr. Stiles' question, Mr. Horne stated that the
Stonewall Industrial Park is for the road and sewer system for the next
section of the park. Mr. Horne added that all the comments are in
except the Highway Department and they are currently negotiating with
the Highway Department on their drainage structures. Mr. Horne further
noted that this site plan does not show sewer and water, this will be
on the subdivision plan.
In answer to Chairman Gordon's question, Mr. Horne stated
that Carter Service Industries is in the Fort Collier Industrial Park.
He further commented that this site plan will be on a section of road
already built. Mr. Horne explained that what the Commission is looking
at is the extension already constructed off the existing road next to
Ron McDole back to behind Harris Intertype. The road that crosses J.
P. Darlington land, off Baker Lane, has been built to the entrance
point of the park. The section in the center, which was to be built by
Mr. Stine, has not been built. Mr. Horne further commented that Carter
Service Industries is on the section near Ron McDole which has been
built, so there is access out.

Mr. Stiles stated that no plans were to be approved until the
roads were built so there would be more than one access.
Mr. Horne stated that he would check into the situation
further and report back to the Commission.
There being no further comments, Chairman Gordon accepted the
bimonthly report as information only.
COMMISSION RETIRES INTO EXECUTIVE SESSION
Upon motion made by Mr. Golladay, seconded by Mr. Stiles and
passed unanimously, the Frederick County Planning Commission does
hereby retire into Executive Session in accordance with Section 2.1 -344
(a)(1) to discuss personnel matters.
COMMISSION WITHDRAWS FROM EXECUTIVE SESSION
Upon motion made by Mr. Golladay, seconded by Mr. Stiles and
passed unanimously, the Commission withdrew from Executive Session.
HOUSE BILL 1771
Mr. Golladay stated that he was concerned about the wording
of a house bill which was sponsored by Mr. Guest last year. Mr.
Golladay next read the bill to the Commission as follows:
"...allows locality to rezone land within proposed
Agricultural and Forestal districts or prohibit subdivision..."
Mr. Horne stated that he is in the process of acquiring a
copy of the bill for the Commission to review and comment on.
PROPOSED ADDITION TO SOUTH FREDERICK AGRICULTURAL & FORESTAL DISTRICT
Mr. Horne stated that the proposed addition to the South
Frederick Agricultural and Forestal District has been on file for the

initial 30 day filing period. He further stated that the office has
received no input, additions or deletions to that district.
Upon motion by Mr. Stiles and seconded by Mr. Kirk and passed
unanimously, the Planning Commission authorized the staff to convene
the Agricultural Advisory Committee for review of the proposal for the
second 30 day period.
DISCUSSION OF REGIONAL WASTEWATER TREATMENT PLAN
Mr. Wellington Jones, of the Frederick County Sanitation
Authority, appeared before the Planning Commission to provide
information on the status of the Regional Wastewater Treatment Plant.
Mr. Jones first gave the history of the treatment plant from the time
of its first proposal to the present.
Mr. Stiles inquired as to the purpose of the value
engineering study referred to by Mr. Jones.
Mr. Jones replied that the study is done by an independant
group to determine the feasibility of updating the existing system or
the construction of a new system.
Mr. Stiles next questioned the Planning Commission's
involvement in the design and construction of the plant when it was
first proposed in 1974.
Mr. Jones replied that the project was well coordinated with
the Planning Department during its beginnings in 1974. Mr. Jones added
that at that time, a new land use plan was in effect and the two went
hand in hand. He added that at first the plan was grandiose, but has
since been reduced in size. Mr. Jones further added that if a new

plant is constructed, it will provide less capacity than what already
exists.
Mr. Stiles commented that part of the justification of the
new City plant was not only capacity, but a problem associated with
chemicals from the discharge of apple processing plants. Mr. Stiles
questioned the feasibility of the new plant since these plants have
elected to use land treatment of their waste.
Mr. Jones replied that absent the plants, we are still in
violation of stream standards.
Mr. Stiles next questioned the justification of designing a
facility when there is no money to build.
Mr. Jones explained that something must be done. The Clean
Water Act states that a region can be told by the Federal Government to
update a facility without giving out funds. If grant funds are
available and we elect not to build, we will have to do it on our own.
Mr. Golladay next inquired as to the number of people
expected to be using the plant and what population growth rate was
used.
Mr. Jones replied that the State's population projections
were used, although they seemed incorrect.
Mr. Horne commented that almost none of the population growth
in the last decade went to the City, but almost all of the population
went to the County. The amount of population growth predicted was
correct, but the distribution was wrong.
Mr. Jones continued that there has been occasions when
industry has wanted to locate here, but the capacity they needed would
exceed the capacity that we have available to them. He further

explained that it is more difficult to design the upgrading of an
existing facility because that facility must operate and continue to
operate while it is being upgraded
It is more cost effective to build
a new plant.
Mr. Golladay stated that everything in the Capital
Improvements Plan is bought and paid for by the users.
Mr. Jones commented that in respect to the Regional
Facilities plan, the current feeling is that cost will be borne by the
users. To date the
County
and City have
contributed
equally
and
bonds
have been posted.
Once the
construction
begins, the
County
and
City
will be paid back.
In answer to Mr. Brumback's question, Mr. Jones replied that
the amount of increase in rates will be discussed at the meeting on
Wednesday.
After some further general discussion, the Commission felt
that Mr. Jones' information was very enlightening and planned to meet
with the Joint Council and Board of Supervisors the following week.
REPORT ON THE STATUS OF THE COMPREHENSIVE PLAN UUATE
Chairman Gordon first expressed thanks on behalf of the
Commission to Samuel Lehman for his contribution to the Comprehensive
Plan Update. Upon motion made by Mr. Golladay, seconded by Mr. Kirk
and passed unanimously the Commission requested that their appreciation
be made an official part of the minutes, as follows:
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby extend tremendous thanks to Samuel Lehman for the endless hours
of research, the wonderful work and tremendous interest by Mr. Lehman
for his contribution to the Comprehensive Plan Update and his
development and implementation of the maps for that plan.

BE IT FURTHER RESOLVED, That Frederick County will be indebted to
Samuel Lehman for his research for a long time to come.
Mr. Golladay next stated that the package has been submitted
to all County Agencies and Departments for their review.
Mr. Horne further stated that the package of information was
initially put together for County agency heads to give them a base from
which to project population and economic trends when they prepare their
individual Capital Improvements Plan. The Capital Improvements Plan is
being structured in that.the agencies will use this baseline data and
develop individual agency Capital Improvement Plans giving very
detailed information on what they feel are their agency's needs for
capital facilities over the next few years. This information will
dovetail with the general Comprehensive Plan, therefore, this baseline
information will be used repeatedly. Mr. Horne next referred to the
large scale maps on display, noting that much of the information on
them is included in the complete package. He further noted that this
information is available to the public. Mr. Horne next went through
the package of information and briefly discussed each section. He then
gave an explanation of each of the maps on display. Mr. Horne ended
his discussion by noting that as far as the timetable for the process
is concerned, the staff is fairly well on schedule.
APPOINTMENT TO JOINT ECONOMIC DEVELOPMENT COMMISSION
Mr. Horne explained that Frederick County and the City of
Winchester are forming a temporary economic development working group
which was recommended by the Planning Commission and the Board of
Supervisors as a concept. Mr. Horne added that this working group will
not only keep the spirit of cooperation alive between the

County and the City, but will discuss duties of the Joint Economic
Development Commission and develop joint economic development goals.
Mr. Horne noted that so far, the working group from the County will
consist of two members from the Industrial Development Authority, a
member from the Board of Supervisors, and a member of the Planning
Commission.
Upon motion made by Mr. Kirk, seconded by Mr. Myers and
passed unanimously, the Commission appointed Mr. Palumbo to serve on
this committee as a representative for the Planning Commission.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby appoint Mr. M. Domenic Palumbo as a representative for the
Planning Commission for the Joint Economic Development Commission.
There being no further business to discuss, Mr. Golladay
moved for adjournment. This was seconded by Mr. DeHaven and passed
unanimously.
