Langdon Gordon, Chairman; Frank Brumback, Vice - Chairman; Domenic Palumbo; Kenneth Stiles; A. L. Myers; James Golladay; Manuel DeHaven; W. French Kirk; George Romine CALL TO ORDER The Chairman called the meeting to order. Chairman Gordon first introduced and welcomed Mr. Domenic Palumbo as the newest appointee of the Planning Commission. Mr. Riley next introduced Mr. Robert Harriman as the new Director of Public Works for the County of Frederick. The next order of business, consideration of the minutes of February 18, April 15, April 28, and May 6. Mr. Golladay noted the following corrections to the minutes of February 18: Page 10, Mr. Sam Cravatta should be Mr. Samuel Crovatta. Mr. Golladay noted the following corrections with respect to the April 15th minutes: Page 10, 6th paragraph, should read "This motion was seconded by Mr. DeHaven and passed unanimously. Page 11, last line, oppossed should be opposed. Mr. Kirk moved to approve the minutes of April 15 and the minutes of February 18, April 28, and May 6, as corrected. This was seconded by Mr. Golladay and passed unanimously. BIMONTHLY REPORT In answer to Chairman Gordon's inquiry, the Secretary stated that the items under Subdivisions were variances of lots mainly for families. Chairman Gordon next accepted the Bimonthly Report as information. 1326 -2- SITE PLANS Site Plan Request No. 003 -81, of Windy Hills (Al Jacobin) zoned B -2 in the Shawnee Magisterial District. ACTION - Approved Mr. Riley stated that Mr. King of the Highway Department has been contacted and has indicated that three businesses are necessary in order for a secondary road to be taken into the State Highway System. Mr. King also indicated that the road in question meets with State specifications. Mr. Riley further stated that Mr. Jay Givens of the Winchester Utility Department, had been contacted with regard to this specific tract. Mr. Givens stated that the subdivision was designed so there would not be any sewer main extensions in that area and each lot could be served with just a hookup, with out extending the main. Mr. Riley added that Mr. Givens' policy did not allow for main extensions but if the service exists, they do allow hookups. Mr. Riley next introduced Mr. Wellington Jones, Director of the Frederick County Sanitation Authority. Chairman Gordon asked if Mr. Givens' policy would preclude further subdivision of lots in that area. Mr. Jones stated that it would not, provided each lot formed has direct access to the sewer main. In reply to Mr. Stiles' question, Mr. Jones replied that with regard to City sewer line extensions, it is the City's policy not to extend sewer lines into the County, but the City will provide County connections into existing sewer lines. Mr. Jones further explained that if an individual wishes to subdivide a piece of property with an existing sewer line owned by the City running through his property, 1327 -3- each lot situate in the County would be provided a connection as long as there is access to the main. However, if he subdivides in such a manner that would necessitate extension of the sewer main for hookup, this would not be allowed. Mr. Jones added that it is the County's perogative to approve or disapprove connections in the County. Mr. Jones noted that if the City decided to take exception to their policy to extend, they should seek the approval of the County. Mr. Al Jacobin came forward and introduced himself to the Commission. Mr. Jacobin stated that the type of business hookup was more important than the number of hookups because the usage would be greater for some. Mr. Jacobin added that he has two businesses proposed for himself and one already exists across the street; therefore, the business requirement for inclusion in the State Highway System would be met. In answer to Mr. Stiles' question, Mr. Riley stated that two businesses are permitted on one lot and subdivision of the lot is not required. In reply to Mr. DeHaven's question, Mr. Jacobin stated that there will be two seperate water meters and two seperate sewer hookups. Chairman Gordon next inquired as to how Mr. Jacobin planned to service the rear two acres. Mr. Jacobin replied that if he sold the rear two acres, he would subdivide. Mr. Jacobin further added that the entrance ways, roads, etc., were designed to meet requirements for the rear lot if it were sold. 1328 -4- There being no one present in favor or opposition to this request, Mr. Brumback motioned to approve the site plan request as presented. This was seconded by Mr. Kirk and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan Request No. 003 -81 of Al Jacobin. Subdivision Request for C & P Telephone Company for a telephone relaying station in the Back Creek Magisterial District. ACTION - Approval The Secretary gave the background information. Mr. James Miller, Construction Engineer for C & P Telephone, came forward and introduced himself to the Commission and explained that the structure was a radio equipment building and its function is to provide growth for long distance service out of the Winchester area. Mr. Miller further added that presently, the Winchester area and satellite communities have their long distance and operator's service served by cable to Leesburg and this cable is now operating at 100% capacity. Mr. Miller noted that this facility is to provide relief for future growth of that service in these areas. Mr. Miller commented that the building is unmanned, does not require water or sewer and is of masonary construction with a microwave antennae on the roof. Mr. Miller further explained that the present cable system is subject to damage by highway accidents and this system provides more reliability. Mr. Miller added that the equipment is serviced once a week and the radiation from the antennae is well within Federal standards for this type of operation. 1329 -5- Mr. Golladay questioned what relationship this had with the tower proposed for Stephens City. Mr. Miller explained that Winchester was the least expensive alternative and also is a central area for handling long distance and operator service out of this general area of the state, but because it is a historic district, there were many problems. Mr. Miller added that because of a misinterpretation of the zoning ordinance, C & P was not successful in the Stephens City location either. In answer to Chairman Gordon's question, Mr. Riley stated that public utilities are permitted in M -1 and M -2 and this operation is similar to the substation constructed to the south of this location. Mr. Riley further explained that this property is owned by the IDC and they are under option to purchase this tract to put in a relay station. Mr. Riley continued to explain that any traffic for service or maintenance will use the same entrance off of Rt. 652 that the Potomac Edison people use. Chairman Gordon asked if anyone in the audience would like to speak in favor or opposition to this position. There being no one present wishing to speak further, Mr. Brumback motioned to approve this request. This was seconded by Mr. Golladay and passed unanimously. BE IT RESOLVED, That the Planning Commission for the County of Frederick does hereby recommend approval of the subdivision request for C & P Telephone Company to the Board of Supervisors. Site Plan Request No. 005 -81 of C & P Telephone Company for a telephone relaying station in the Back Creek Magisterial District. 1330 ACTION - Approved The Secretary gave the background information. There being no one present in the audience wishing to speak in favor or opposition to this request, Mr. Brumback motioned to approve this site plan request as presented. This was seconded by Mr. Stiles and passed unanimously. BE; IT RESOLVED, That the Planning Commission for the County of Frederick does hereby approve Site Plan Request No. 005 -81 for C & P Telephone Company. Rezoning Request No. 003 -81 of Fredericktowne Company, (Donald Packard), from R -3 (Single- Family Residential) to R -6 (Multi - Family Residential) ACTION - Denial The Secretary gave the background information and further noted that the area in question is designed for medium density residential and surrounding trends in the area indicate that use pattern. Mr. Riley stated that multi - family is designated on Route 277 and Route 641, adjacent to the Pines & Nottoway development. Mr. Donald Packard Jr., representing the Valley Corporation and Mr. Thomas Johnson, designer, came forward and introduced themselves to the Commission. Mr. Packard stated that originally, when option was taken from Fredericktowne Corporation on the the impression that the property was z Packard added that after going through design, they learned that the property Mr. Johnson next stated that conforming to R -3, they are requesting proposed land, they were under �ned for multi- family. Mr. Johnson stated that because of the shape of the site, it is impossible to build private homes and furthermore, the price of the homes would be very high. In answer to Mr. Stiles question, Mr. Packard stated that his business only has an option on the property, and does not actually own it. Mr. Packard noted that the property is owned by the Fredericktowne Corporation. Chairman Gordon next asked for anyone is the audience wishing to speak in favor or opposition to this request. Mr. Lewis Boyer came forward, introduced himself to the Commission and stated that he represented Mr. Paul Cadwallader, a landowner adjacent to the property in question, and persons who signed a petition against this proposal. Mr. Boyer stated that Mr. Cadwallader is in the process of subdividing property on the other side of the property in question and feels this rezoning might effect the sales of those lots. Mr. Boyer added that Mr. Cadwallader was concerned about the possibility of heavy traffic flow that multi- family housing might generate. Mr. Boyer noted that with regard to the petition, these persons are located directly along the effected area, behind and to the left of the effected area. Mr. Boyer next presented a petition of landowners who object to the rezoning of 1.75 acres from R -3 to an R -6 classification. 1332 Mr. Golladay moved to make the petition a part of the minutes. This was seconded by Mr. Kirk and passed unanimously. Mr. Samuel Lehman, Vice President of the Frederick County Taxpayer's Association, came forward and expressed his concern about the density of nine to ten units per acre in relation to the surrounding density which is lower. Mr. Lehman also commented that he believed that apartments do not belong in a rural area and that crowded conditions such as these will bring trouble in the future. Mr. Golladay stated that this request is not in compliance with the Comprehensive Plan and the impact on Route 647 and existing single family units will be great. Mr. Golladay expressed his concern with regard to precedent setting and maintenance of roads if the area becomes heavily populated. Mr. Stiles stated that he felt R -6 was not entirely incompatible with R -3 as long as buffers were included in the site plan and the structure was properly designed. Mr. Horne noted that because of the shape of the site, only one single family residence could be constructed here and this one residence would generate about ten trips a day. Mr. Horne continued that the eight units proposed would generate about 43 trips per day. 1335 - 11 - Chairman Gordon inquired of the staff if there was a shortage of vacant acreage at this point, whereby more vacant acreage would be needed. Mr. Riley replied that based on acreage in the County for multi - family, there is approximately 75 acres. Mr. Golladay next moved for denial of this rezoning request. This was seconded by Mr. Kirk and passed unanimously. BE IT RESOLVED, That the Planning Commission for the County of Frederick does hereby recommend denial of the rezoning request No. 003 -81 of Fredericktowne Company to the Board of Supervisors. At this point in the meeting, Mr. Stiles took leave. Rezoning Request No. 004 -81 of Fredericktowne Company (Lewis Costello) from B -1 (Commercial) to R -6 (Multi - Family Residential) ACTION - Denial The Secretary gave the background information. Chairman Gordon requested Mr. Wellington Jones of the Sanitation Authority to comment on this area. Mr. Jones commented on the pumping station for this area, noting that it becomes overloaded during long or hard rains and not because of normal sewage discharge. Mr. Jones further commented that these overloads would not effect the performance of the pumping station and that the station can handle what is existing plus Fredericktowne III. Mr. Jones noted that the Sanitation Authority is concerned about infiltration which is the cause of the problem and is working to eliminate these overflows during wet weather. In answer to Mr. Golladay's question, Mr. Jones replied that 1336 -12- the eight inch line has adequate capacity and adding more hookups would not make the problem any more severe than it is already. Mr. Thomas Dickinson, representative for Fredericktowne, came forward and introduced himself to the Commission and addressed several of his concerns. Mr. Dickinson explained that he had gathered information from various locations concerning the impact of traffic on Route 647 and the results indicated that commercial development would cause greater impact (8,000 cars per day) than the proposed apartments (approximately 400 cars per day). Mr. Dickinson noted that although his proposal does not comply with the Comprehensive Plan, he understood that this was a guideline based on services available and not necessarily strictly adhered to. Mr. Dickinson added that water, sewer and schools are available. Mr. Dickinson further added that if this downzoning was approved on the seven acres they would consider developing the remaining six acres in the same manner. Chairman Gordon next asked if there was anyone in the audience in favor or opposition to this request. Mr. Lewis Boyer came forward and introduced himself to the Commission. Mr. Boyer stated that he represented Mrs. Ann Wyatt who was instrumental in obtaining a petition consisting of landowners who are in opposition to multi - family dwellings being located next to land they have already purchased. Mr. Brumback motioned to make the petition a part of the permanent record by inclusion in the minutes Golladay and passed unanimously. Mr. Jacobin stated that he travels Route 647 everyday and it is extremely crowded in the morning. Mr. Jacobin added that there are many children nearby. Mr. Jacobin also expressed concern about pulling out from Route 647 onto Route 277, stating that it is very difficult to do so. Mr. Samuel Lehman, representing the Frederick County Taxpayers Association, came forward and introduced himself to the Commission. Mr. Lehman stated that there is a wide disparity in traffic generated by commercial use and some uses generate eight times as much as others according to some statistics. Mr. Lehman also commented that if an eight inch pipe is not holding existing sewage in wet weather and you add 57 more houses, the sewage is going to go someplace. Mr. Lehman continued that no matter how much sewage is diluted, people do not want to have it running in their yards. Mr. Lehman next discussed the availability of R -6 zoned land in the County, stating that he knows of about 100 acres, not much of which is actually developed and rented and more R -6 acreage that has been developed but not yet rented. Therefore, Mr. Lehman continued, there may be approximately 110 acres and if developed at ten units per acre, the result would be 1,100 new apartments in Frederick County along with the 11,500 single family dwelling units already existing. 1340 -16- In reply to Chairman Gordon's concern with the remaining six acres, Mr. Riley answered that this area was designated as a possible logical location for a B -1 neighborhood commercial center. Mr. Riley explained that it would not generate new trips, but would generate trip attraction to local residents in the area. Mr. Riley commented that the service center would not be there to exclusively serve that neighborhood, although that is the way it would be designed. Mr. Riley added that as far as rezoning seven acres to multi - family and six for commercial, there would be less impact as far as the amount of area to be constructed commercially; however, a new trip generation factor is created with the 57 additional units. Mr. Golladay next made motion to deny the rezoning request of Fredericktowne Company. This was seconded by Mr. Brumback and the vote was as follows: YES: Messrs. Kirk, Myers, Golladay, Brumback, Gordon NO: Messrs. Romine, DeHaven ABSTAIN: Mr. Palumbo BE IT RESOLVED, That the Planning Commission for the County of Frederick does hereby recommend denial of Rezoning Request No. 004 -81 of Fredericktowne Co. to the Board of Supervisors. Conditional Use Permit No. 007 -81 of John and Brenda Owings for a Home Occupation /Antique Shop, zoned A -2 in the Opequon Magisterial District. ACTION - Approval The Secretary read the background information. Mr. John Owings came forward and introduced himself to the Commission. Mr. Owings stated that the hours of operation would probably be from 10:00 a.m. to 5:00 p.m. and three acres are available for off - street parking. 1341 -17- Mr. Golladay requested that condition number 5 under Planning & Zoning read, "Daylight hours of operation ". There being no one present in the audience in favor or opposition to this request, Mr. Golladay moved to approve the request. This was seconded by Mr. DeHaven and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval of this Conditional Use Permit No. 007 -81 of John & Brenda Owings for a Home Occupation /Antique Shop to the Board of Supervisors with the following conditions: 1. This be a one year permit to be reviewed and renewed annually by the Staff, Planning Commission, and Board of Supervisors. 2. If the use, occupancy, or ownership of the building changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. No one except members of the immediate family residing on the premises may be employed. 4. Off street parking shall be provided. 5. Daylight hours of operation. Conditional Use Permit No. 008 -81 of Wesley L. Spangler for an antique shop, zoned A -2, in the Opequon Magisterial District. ACTION - Tabled The Secretary stated that the comments from the Health Department have not yet been received on this request. Mr. Brumback motioned to table this request until the June 3rd meeting. This was seconded by Mr. Kirk and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby table this Conditional Use Permit Request No. 008 -81 until the June 3rd meeting. 1342 Conditional Use Permit No. 009 -81 of Margaret Brown for a Home Occupation /Beauty Shop, zoned R -3, in the Back Creek Magisterial District. ACTION - Tabled The Secretary stated that the comments from the Health Department have not yet been received on this request. Mr. Brumback motioned to table this request until the June 3rd meeting. This was seconded by Mr. Kirk and passed unanimously.
