PC_02-04-81_Meeting_MinutesMINUTES OF THE MEETING OF THE FREDERICK COUNTY PLANNING COMMISSION Held in the Board of Supervisors' Meeting Room, 9 Court Square, Winchester, Virginia, 2/4/81. PRESENT: Messrs. Gordon; Golladay; Kirk; DeHaven; Myers; Brumback; Stiles; and Sluder. Mr. Stiles noted that he would not be voting again at this meeting. CALL TO ORDER The Chairman called the meeting to order and noted that the first consideration would be the Bimonthly Report. BIMONTHLY REPORT Mr. Riley explained that the Ayers and Judd Site Plan is in the Gilpin Industrial Park. In answer to Mr. Stiles' question, Mr. Riley commented that the RSH Properties Rezoning is east of Burning Knolls on Senseny Road. Chairman Gordon then accepted the Bimonthly Report as information. Mr. Arthur Fulton came forward and explained that he had submitted a site plan two weeks ago. Mr. John Horne explained that the site plan had been submitted on January 23, 1981 and the Health Department was there yesterday. Mr. Horne also explained that this had not been placed on the agenda as there was not ample time to prepare comments for the agenda. Chairman Gordon expressed that all items need to be placed on the agenda in order to be heard. Mr. Riley suggested that perhaps routine items such as this amended site plan could be approved administratively. 1246 -2- Mr. Stiles noted that he was in agreement with this, so long as there is an appeal process with the Planning Commission. Mr. Stiles further explained that the Planning Commission is limited as to what it can do on site plans anyway. Mr. Golladay noted having no objection with the approving of an amended Site Plan administratively. Mr. Riley explained that if it is the general consensus of the Planning Commission that this type of amended site plans can be approved administratively then this can be handled by the staff in the Planning office. Mr. Golladay made a motion to adopt as policy that an amended site plan may be approved administratively so long as it does not significantly alter the original site plan as proposed per the opinion of the administrator and also the Planning Commission be kept appraised of such approvals. This was seconded by Mr. Brumback and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval to adopt a policy that an amended site plan may be approved administratively so long as it does not significantly alter the original site plan as proposed per the opinion of the administrator and also the Planning Commission be kept appraised of such approvals. CONSIDERATION OF THE PROGRAM OF WORK Mr. Riley explained that the Program of work has been broken down into two items, administrative functions and long range planning. Mr. Riley also suggested that subcommittees be established to meet perhaps weekly. Mr. Riley also noted that when the Comprehensive Plan Update Subcommittee has the entire Comprehensive Plan update in draft form, then the Ordinance Update Subcommittee would be convened to 1247 -3- look at the residential and agricultural sections of the Zoning Ordinance. In answer to Mr. Stiles' question, Mr. Riley noted that the Comprehensive Plan would be completed by June of 1982. In response to concern expressed by the Planning Commission, Mr. Horne noted that the dates affixed to accomplishments need not be strictly adhered to, but should be considered in general. Mr. Horne also explained that there will be quarterly reports from the Planning Commission to the Board of Supervisors to keep them up -to -date on the direction of the Planning Commission. Chairman Gordon next appointed two subcommittees as follows: Comprehensive Plan Update Committee - Messrs. Golladay (convener), DeHaven, Stiles, and Myers; and, Zoning Ordinance Update Committee - Messrs. Brumback (convener), Kirk, Gordon, and Riley. BOARD OF ZONING APPEALS POLICY Mr. Golladay made a motion that the Planning Commission adopt as their policy that the Secretary of the Planning Commission, upon instruction from the Planning Commission, will attend Board of Zoning Appeals Meetings to voice the views of the Planning Commission as they relate to planning matters affected by individual request for variances and also that the Secretary will appear as a member of the public and will request time to address the Board of 'Zoning Appeals regarding planning related matters. This was seconded by Mr. Brumback and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval to adopt as there policy that the Secretary of the Planning Commission, upon instruction from the Planning Commission, will attend Board of Zoning Appeals Meetings to voice the 1248 views of the Planning Commission as they relate to planning matters affected by individual request for variances and also that the Secretary will appear as a member of the public and will request time to address the Board of Zoning Appeals regarding planning related matters. DISCUSSION OF CONDITIONAL USE PERMIT FEES Mr. Stiles noted violent opposition to a fee for conditional use permits, stating that the acquiring of a conditional use permit was instituted to benefit the neighbors, not the applicant. Chairman Gordon noted that the charging of a fee might discourage those speculating. Chairman Gordon also summarized the Planning Commission's feelings as being the same as the last time it was recommended for approval to the Board of Supervisors and suggested that the staff forward to the Board of Supervisors the recommendation for a $75.00 fee for the re- consideration. REVIEW OF CONDITIONAL USE PERMITS The Planning Commission next reviewed the list of conditional use permits and reviewed those which might now be inactive. DISCUSSION OF RECENT HIGHWAY SAFETY TRANSPORTATION COMMITTEE MEETING Mr. Golladay reported that the consensus of opinion during the recent Highway Safety Transportation Committee Meeting, commenting that the Highway Department is going to be requested to study the speed limit near Aylor and reducing the speed on that road from the new entrance to Fredericktowne to Route 277. 1249 -5- Mr. Golladay also noted that the length of the green light at the Apple Pie Road would be increased by three or four seconds to allow for traffic out of schools. There being no further business to come before the Planning Commission, Mr. Golladay made a motion to adjourn. This was seconded by Mr. DeHaven and passed unanimously. Respectfully Submitted, Jo?b R.
