OF THE
FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room on September 21, 1983.

CALL TO ORDER
Chairman Brumback called the meeting to order at 2:00 p.m.
The first order of business was the consideration of the
minutes of September 7, 1983. Motion was made by Mr. Golladay,
seconded by Mr. Kirk, and passed unanimously to approve the minutes
as presented.
BIMONTHLY REPORT
The staff reviewed pending applications with the
Commission.
PRESENTATION BY ROADWAY EXPRESS, INC.
Mr. Louis Mustian, Manager of Roadway Express, Inc. in
Winchester, introduced himself to the Commission. Mr. Mustian stated
that his purpose for appearing before the Commission was to provide
information on the operating characteristics of double bottom
trailers (twin 28' long trailers pulled by one tractor) as compared
with the typical trailers used today and to solicit support from the
County for opening selected sections of Routes 522, 50, and 11 for
the use of double trailers and for the use of 102" trailers on all

county roads. Mr. Mustian then proceeded to show the Commissioners a
video tape on this subject.
The Commissioners felt that Mr. Bushman of the Virginia
Department of Highways and Transportation should come to the next
Planning Commission meeting and discuss the safety implications of
these trailers on the highways before they could make a
recommendation to the Board of Supervisors. Mr. Horne stated that he
would schedule this item for the Planning Commission's October 5
meeting.
REVIEW OF AMENDMENTS TO RESIDENTIAL PERFORMANCE ZONING REGULATIONS
Mr. Horne reviewed several changes in the proposed
Residential Performance Zoning Ordinance regarding open space
requirements for developments utilizing single - family detached
traditional and single - family detached cluster housing types; the
enforcement mechanism for maintenance of common elements by
homeowners associations; and the appeal process from decisions of the
administrator.
Motion was made by Mr. Stiles, seconded by Mr. Myers, and
passed unanimously to approve the changes as presented.
Mr. John Riley, County Administrator, came forward to ask
for some clarification on the Master Plan section of the ordinance.
Mr. Riley asked if any subdivisions would be exempt from the Master
Development Plan approval process; for example, a ten lot subdivision
or a subdivision in a commercial or industrial park. He was
concerned about keeping the Board abreast of subdivisions in these
cases. The Commission had no objection to Mr. Horne including a

statement in the ordinance to the effect that when a Master Plan is
waivered the final plat review will first go the Planning Commission
and then to the Board of Supervisors.
WORK PROGRAM FOR ORDINANCE SUBCOMMITTEE
The Commission decided that the next major work item for
the Ordinance Subcommittee should be the revision of the ordinance
for Agricultural Districts.
REQUEST BY JEFF WEBBER FOR DISCUSSION OF SECTION 18.2 OF THE
SUBDIVISION CODE.
Mr. Jeff Webber of Delmar Bayliss Realty came forward. Mr.
Webber asked that the Commission consider amending the ordinance so
that a septic system permit would not be required for subdividing
agricultural land for nonagricultural purposes in parcels larger than
five acres.
The Commission decided to address this problem while
revising the Agricultural District section of the ordinance, which is
to be the next work item for the Subcommittee.
CONFERENCES FOR PLANNING COMMISSION MEMBERS
Mr. Horne informed the Commissioners of two upcoming
conferences that may be of interest; the Institute for Planning
Commissioners in Natural Bridge, Virginia and the Rural Planning
Caucus in Luray, Virginia.

There being no further business to discuss, the meeting
adjourned.
