FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room on
December 15, 1982.

CALL TO ORDER
Chairman Brumback called the meeting to order.
The first order of business was the consideration of the
minutes of December 1, 1982. There being no corrections, Mr. Golladay
moved for approval. This motion was seconded by Mr. Romine and passed
unanimously.
BIMONTHLY AND MONTHLY REPORTS
The Commission discussed pending applications with the staff.
Mr. Horne explained that the Road Viewers have recommended to
the Board of Supervisors that the section of road in Colonial Heights
(consisting of 1/10 mile) and a road off Route 803 in Round Hill
(consisting of 3/10 mile) be included in the Secondary Road System as a
Rural Addition.
Mr. Horne stated that as a result of the inclusion of the
Colonial Heights road into the Secondary Road System, Colonial Heights
could now be considered as a valid subdivision request. He noted that
Colonial Heights will be coming to the Commission as a series of
residential lots with existing houses.
There next ensued a discussion of funding for roads included
in the State System.
PUBLIC HEARINGS
Rezoning Request #001 -82 of Jerry Updike and Dewey Gillespie,
consisting of 4.1705 acres now zoned A -2 (Agricultural - General) to be
rezoned MH -1 (Mobile Home) for the placement of mobile homes in the
Shawnee Magisterial District.
ACTION - Approved

Mr. Horne read the background material. Mr. Horne stated
that the proposal includes the extension of a private road through the
park and down a steep slope towards Route 7. He noted that the Health
Department has approved the northern section of the road, but not the
southern section of the road for subsurface sewage disposal systems.
In answer to Chairman Brumback's question on the density of
this park, Mr. Horne replied that the permitted density under the
ordinance is ten units /net acre with overall density being eight
units /acre. Mr. Horne noted that the density in this park is about
four units /acre because of the septic systems.
Mr. Jerry Updike came forward and introduced himself to the
Commission. Mr. Updike explained that the northern section of the road
has been generally acceptable throughout the development of the park.
He stated that he has been building throughout the area and, on
occasion, ran lines underneath the road. Mr. Updike stated that he
does have adequate drainage.
Chairman Brumback asked if there was anyone wishing to speak
in favor or opposition to the request and Mr. Samuel Lehman asked for
the total number of trailers in the general area.
Mr. Updike replied that he has about 48 trailers there now
and Mr. Gillespie also has about the same number adjoining his.
Mr. Lehman asked if there has been any stream problems or
complaints about sanitation and Mr. Sluder of the Health Department
replied that he had not received any complaints. Mr. Lehman then asked
if it was permissible to run a septic system under a private road and
Mr. Sluder replied that it was.

There being no one wishing to speak further, Mr. DeHaven
moved to approve the rezoning. This motion was seconded by Mr. Kirk.
BE IT RESOLVED,_ That the Frederick County Planning Commission does
hereby approve rezoning request #001 -82 of Jerry Updike and Dewey
Gillespie for 4.1705 acres to be rezoned from A -2 (Agricultural -
General) to MH -1 (Mobile Home) for the placement of mobile homes in the
Shawnee Magisterial District.
The above resolution passed unanimously.
Interstate Properties Subdivision request, zoned B -2 (Commercial -
General), to subdivide seven lots for commercial developments and to
construct approximately 1,100 feet of roadway to Virginia Department of
Highways and Transportation standards.
ACTION - Tabled
Mr. Horne stated that the staff has not received the Highway
Department's written comments.
Mr. Palumbo next moved to table this subdivision request
until the meeting of January 5. This motion was seconded by Mr. Kirk.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby table the subdivision request of Interstate Properties
Subdivision until the meeting of January 5, 1983, due to lack of
written comments from the Virginia Department of Highways and
Transportation.
The above resolution passed unanimously.
Discussion of Land Use Taxation
Mr. Horne commented that Mr. Esten Rudolph, the Commissioner
of Revenue, was ill and would not be able to be present for this
discussion. Mr. Horne stated that given the importance of having the
designated county representative present, the staff and the Chairman
felt that the formal discussion should be postponed to a later date.
Mr. Horne presented a large map depicting all parcels of land
currently enrolled in the Land Use Taxation Program.

The Commission next discussed various pros and cons of the
Land Use Taxation Program and tried to determine where abuse of the
system was taking place, if at all. Mr. Stiles felt it would be
helpful to have the parcels under Land Use broken down into separate
categories according to Agriculture /Horticulture, Forestal, and Open
Space. The Commission also discussed the application for Land Use with
Mr. Roy Jennings of the Commissioner of Revenue's Office.
The Commission decided to continue discussion of the Land Use
Taxation Program at future meetings in order to fully evaluate the
system.
Adiournment
Mr. Golladay moved to adjourn, while Mr. Stiles seconded the
motion, which was passed unanimously.
