OF THE
FREDERICK COUNTY PLANNING COMMISSION
AND THE
FREDERICK COUNTY BOARD OF SUPERVISORS
Held in the Board of Supervisors' meeting room on
November 17, 1982 at 7:00 p.m.
PRESENT: Planning Commission - Frank Brumback, Chairman; James
Golladay, Vice - Chairman; Carl M. McDonald; M. Domenic
Palumbo; A. Lynn Myers; Manuel DeHaven; W. French Kirk;
George L. Romine
Board of Supervisors - S. Roger Koontz, Chairman; Rhoda
Maddox; Kenneth Stiles; Will Owings
CALL TO ORDER
Mr. Koontz, Chairman of the Frederick County Board of
Supervisors, called the meeting to order. Mr. Koontz then turned the
meeting over to Mr. Brumback, Chairman of the Frederick County Planning
Commission.
Discussion of the 1982 Comprehensive Plan
Chairman Brumback gave a brief introduction to familiarize
the public with the development of the Comprehensive Plan to date.
Chairman Brumback stated that there will be no official votes taken at
this meeting. The Planning Commission will vote officially on
December 1, 1982, and the Board of Supervisors will vote officially on
December 8, 1982. Chairman Brumback next asked if anyone from the
audience wished to speak on the Comprehensive Plan.
Mr. Kit Moulden, President of the Top of Virginia Home
Builders Association, came forward and introduced himself to the
Commission and Board. Mr. Moulden stated that on behalf of the Home
Builders Association they are very much in favor of the Comprehensive
Plan as the document presently reads. He noted that their only concern
is that the document lose nothing in the translation to the ordinances.

Mr. Moulden felt this was a positive approach to the planning problems
of the county.
There being no one else from the audience wishing to speak on
the Comprehensive Plan, Mr. Stiles moved to close the public hearing.
This motion was seconded by Mr. Palumbo and passed unanimously.
After a discussion of the Comprehensive Plan among the Board
and Commission, Chairman Brumback called for a ten minute recess.
Adoption of Minutes
At this point, the Planning Commission resumed their regular
meeting without the Board. The next order of business was the
consideration of the minutes of October 26, 1982. Motion was made by
Mr. Myers, seconded by Mr. Golladay, and passed unanimously to approve
the minutes of October 26, 1982 as presented.
The Commission next reviewed the minutes of November 3, 1982.
There being no corrections, motion was made by Mr. Myers, seconded by
Mr. Golladay, and passed unanimously for approval.
BIMONTHLY
Mr. Gyurisin explained that Mr. John H. Wert has submitted a
Conditional Use Permit request for gas station pumps and canopies and a
variance application to vary the setback requirements for the canopies
over the pump islands. Mr. Gyurisin noted that the property is located
on Route 11, south of Middletown.
In reference to the Conditional Use Permit application of Mr.
Thompson, Mr. Golladay asked where the property was located. Mr. Horne
stated that the property was located on Route 739, Apple Pie Ridge,
across from the old school. Mr. Horne added that this request was for
a garden supplies store.

Subdivision Request of Barbara H. Lauck for six lots to be subdivided
for single family homes, zoned R -3 (Residential - General), in the
Stonewall Magisterial District.
ACTION - Approved
Mr. Horne read the background material.
Mr. Randolph Larrick, attorney representing Barbara Lauck,
came forward and introduced himself to the Commission.
In answer to Mr. Stiles' question, Mr. Larrick replied that
all the lots will have entrances on Route 832.
There being no further discussion, Mr. Stiles moved to
approve this subdivision request. This motion was seconded by Mr.
Kirk.
BE IT RESOLVED, That the Frederick County Planning Commission does
hereby approve the subdivision request of Barbara H. Lauck for the
subdivision of six lots for single family homes in the Stonewall
Magisterial District.
The above resolution passed unanimously.
Discussion on the Virginia Regional Assembly on Land Use Policies
The Commission next reviewed and discussed a memorandum
submitted by Stephen Gyurisin summarizing the policies discussed at the
Regional Assembly of Virginia held in Harrisonburg, Virginia, on
October 27, 1982.
Adjournment
There being no further business to discuss, Mr. Golladay
moved for adjournment. This motion was seconded by Mr. Kirk and passed
unanimously.
