Held in the Board of Supervisors' Meeting Room on November 3, PRESENT: Frank Brumback, Chairman; James Golladay, Vice Chairman; Carl McDonald; M. Domenic Palumbo; Kenneth Stiles; A. L. Myers; Manuel DeHaven; W. French Kirk; George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order. The first order of business was the consideration of the minutes of October 20, 1982. There being no corrections, Mr. Golladay moved for approval. This motion was seconded by Mr. Romine and passed unanimously.* Letter from Shenandoah College and Conservatory of Music Chairman Brumback read a letter he received from Mr. James A. Davis, President of Shenandoah College and Conservatory of Music. Motion was made by Mr. Golladay, seconded by Mr. Myers, and passed unanimously, to include the letter as part of the official record, as follows:* October 26, 1982 Mr. Frank Brumback Chairman Frederick County Planning Commission Winchester, VA 22601 Dear Frank: Thanks for your support of our efforts to re -zone the Seal tract for college use. Davis President JAD /j *Mr. Stiles was not present for these votes. 1646 -2- BIMONTHLY Mr. Horne noted that Dewey Gillespie and Jerry Updike have submitted a smaller acreage on their rezoning and the Health Department will probably be able to give them a positive comment. Mr. Horne stated that with regard to Shenandoah College and Conservatory of Music, the Board of Supervisors also informally endorsed the extension of the campus onto the Seal tract. He noted that the Board has requested the staff to submit a resolution endorsing this extension to put in their minutes to preclude any confusion in the future. Discussion of Route and Mr. Diamond )ute 647 Intersection Area with Mr. Bushman Mr. Horne introduced Mr. William Bushman, Resident Engineer, and Mr. James Diamond, Traffic Engineer, of the Virginia Department of Highways and Transportation. Mr. Horne stated that these gentlemen were present to discuss the area around the Interchange of I -81 and Routes 647 and 277, east of Stephens City. Mr. Diamond stated that a traffic count for the area was done in 1980. At that time, traffic counts did not warrant signalization. Mr. Diamond stated that this year, with the help of Mr. Horne, information was collected on the potential future land development in that area. Mr. Diamond stated that in all probability the traffic generated by this future development would meet requirements for signalization, but he did not know exactly when this would occur. Mr. Diamond further stated that updated traffic counts will probably be taken in January, after McDonald's Restaurant is established and the holidays are over. Mr. Diamond suggested that pavement markings to accomodate left turns and better signage to identify separate inter- sections on Route 647 to the ramps at I -81 could be steps to take prior to signalization. 1647 -3- Chairman Brumback next asked that this discussion be briefly interrupted in order for the public hearings, advertised for 7:30 p.m., to be heard. Conditional Use Permit #014 -82 of Kenneth B. Settle for a Commercial Outdoor Recreation, Athletic, or Park Facility /Miniature Golf Course in the Shawnee Magisterial District. ACTION - Approved Mr. Horne read the background material. Mr. Stiles asked how the area was zoned and Mr. Horne replied that it was zoned B -2. Mr. Settle came forward and introduced himself to the Commission. Mr. Settle stated that he wanted to operate seven to eight months a year, seven days a week, with hours from 10:00 a.m. to 12 p.m. He commented that there should be no more than 50 customers at the site at one time. Mr. Stiles asked where parking would be and Mr. Settle replied that the parking lot would be next to the motel and would be 64' wide x 200' long for 40 cars. In answer to Mr. Stiles' question, Mr. Horne stated that from the motel to the property line the site is 110' wide going north -south and 285' long going east -west. Mr. Settle explained that the golf course is a pre -fab structure. With regard to the lighting, he noted that there will be three pole lights below the tree line facing south and also one each at the north and south end of the parking lot. Mr. Harley Oates came forward and stated that he owned the property directly behind the proposed golf course. Mr. Oates was 1648 Elm concerned that there would not be enough parking. He was also concerned about trash and pedestrian traffic. Mrs. Marvin Fleet came forward and stated that she lived in back of the existing motel. Mrs. Fleet was also concerned about insufficient parking on the site. She did not want people parking along her street and creating congestion. Mr. Gyurisin next stated the he received a call from Mr. Charles Segelquist, an adjoining property owner, who was concerned with pedestrian traffic. After a brief discussion on the most effective type of screening for this site, Mr. Romine moved for approval of this Conditional Use Permit with the conditions discussed by the Commission. This motion was seconded by Mr. Palumbo. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Conditional Use Permit #014 -82 of Kenneth B. Settle for a Commercial Outdoor Recreation, Athletic, or Park Facility /Miniature Golf Course in the Shawnee Magisterial District, with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission, and Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. No off -site parking is permitted and additional parking may be required on the site, if needed. 4. Compact vegetative screening should be placed along the north side of the site. 5. All lighting should be directed away from adjacent properties and shielded to minimize off -site glare. 6. Hours of operation will 8:00 a.m. to 12:00 p.m. daily. The above resolution passed unanimously. 1649 -5- Conditional Use Permit #015 -82 of Peter G. and Crystal M. Dassler for a Cottage Occupation /Construction and Sale of Small Utility Buildings in the Gainesboro Magisterial District. ACTION - Approved Mr. Horne read the background material. Mr. Stephen Butler, attorney representing Mr. and Mrs. Dassler, came forward and introduced himself to the Commission. Mr. Butler stated that the "L "- shaped building that will be used to construct the utility buildings is located 225' from Route 50. Mr. Butler stated that Mr. Dassler has three types of all -wood storage buildings for sale and he would like to keep these outside so that someone driving by could see them He further noted that Mr. Dassler will have no inventory. Mr. Dassler stated that he would like his operation to be full time with one additional employee. Mr. George Seeley, an adjoining property owner, came forward and introduced himself to the Commission. Mr. Seeley stated that he had no objections to Mr. Dassler's construction and sale of utility buildings. He commented that Mr. Dassler maintains his property in quality condition and he is sure Mr. Dassler would continue to do so with his new venture. Mr. Romine next moved for approval of the application with the standard conditions. This motion was seconded by Mr. DeHaven. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Conditional Use Permit #015 -82 of Peter G. and Crystal M. Dassler for a Cottage Occupation /Construction and Sale of Small Utility Buildings in the Gainesboro Magisterial District with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission, and Board of Supervisors. 1650 2. If the use, occupancy or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. The above resolution passed unanimously. --------------------- Continuation of Route 277 /Route 647 Intersection Discussion with Mr. Golladay suggested that a caution light and remarking the entrances on Route 647 and 1012 may help the situation here. He also suggested common entrances for two or three businesses. Mr. Bushman stated that a preliminary sketch has been done and a center turning lane is possible between the 81 overpass on 277 and down to High's, where the road narrows. Mr. Bushman also noted that the signage could be improved to make 647 more identifiable. Mr. Golladay asked if it was possible to widen Route 647 as another alternative and Mr. Bushman replied that widening the road was possible. After some further discussion, the Commission decided that as step one the Highway Department should address striping, a potential turn lane, and sign realignment at the intersection. In January, the Highway Department could do traffic counts as step number two. The third step would involve the development of a logical proposal to present at the Primary Allocation hearings next year. The fourth step would be to incorporate Route 647 into the Six Year Road Improvement Plan Secondary Road System. Mr. Golladay next thanked Mr. Bushman and Mr. Diamond, in behalf of the entire Commission, for attending the meeting. 1651 -7- Adjournment There being no further business to discuss, Mr. Golladay moved for adjournment.
