PRESENT: Frank Brumback, Chairman; James Golladay, Vice - Chairman; Carl M. McDonald; Kenneth Stiles; M. Domenic Palumbo; Manuel DeHaven; W. French Kirk; George L. Romine ABSENT: A. L. Myers CALL TO ORDER Chairman Brumback called the meeting to order. The first order of business was the consideration of the minutes of September 1, 1982. Mr. Kirk commented that on page two, second paragraph, line nine, should read, "The Subcommittee felt it would be all right to assume new obligations..." There being no further corrections, Mr. Golladay moved for approval. This was seconded by Mr. Kirk and passed unanimously. BIMONTHLY In answer to Mr. Kirk's question, Mr. Horne replied that the lots for the H. B. Crim rezoning were located just to the east of the Country Store on Senseny Road. In answer to Mr. Stiles' question, Mr. Horne stated that Mr. Mielzarek is no longer pursuing his rezoning application. In regard to the Board of Zoning Appeals applications, Mr. Gyurisin noted that an application has been submitted for 13 lots in the Colonial Heights Subdivision on Route 659 by Orpha Martin. There being no further discussion, Chairman Brumback accepted the monthly and bimonthly reports as information. 1614 SITES PLANS Site Plan Request #014 -82 of Agape Christian Fellowship, zoned A -2, Agricultural - General, in the Shawnee Magisterial District. f ACTION - Approved Mr. Horne, the Secretary, gave the background information. Mr. Sluder stated that Agape has received permission from the State Department of Health to install a Wisconsin Mound Sewage disposal system. Mr. Sluder then proceeded to explain how this system is installed and the way in which it works. Mr. Charles Heath next came forward and stated that he was with New England Log Homes and also represented Agape Christian Fellow- ship. In answer to Chairman Brumback's question, Mr. Heath replied that the church owns a total of five acres. In reply to Mr. Romine's question, Mr. Heath stated that Agape is a church day school with grades from kindergarden to 12th grade. Mr. Heath explained that the proposed structure will have three stories and will contain approximately 11,500 square feet. There being no one wishing to speak in favor or opposition to this request, Mr. Kirk moved for approval and Mr. DeHaven seconded the motion. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #014 -82 of Agape Christian Fellowship to construct a Christian Center /School, parking facilities, and entrance driveway in the Shawnee Magisterial District. The above resolution was passed unanimously. PUBLIC HEARING Rezoning Request #008 -82 of Eldon Lindsey to rezone 9.519 acres from A -2 (Agricultural - General) to B -2 (Business - General) in the Opequon Magisterial District to be used as an office park. 1615 ACTION - Approved The Secretary gave the background information. Mr. Sluder stated that the existing system was installed 10 -12 years ago for a garage and presently the soil is marginal. Mr. Sluder noted that Western Union is proposing a maximum of 11 -12 employees. He added that Mr. Lindsey has agreed to install a special type of water closet that conserves water, and therefore, he did not see any problems using the existing system. Mr. Eldon Lindsey came forward and introduced himself to the Commission. Mr. Lindsey explained that presently there will just be one office. This office will be secured and not open to the public. He stated that Western Union has said that there will not be more than eight people on any one shift. Mr. Horne commented that he has seen a copy of the original easement agreement for sewer that was established on the property. Mr. Horne stated that as long as there is excess capacity at the Middletown Plant, the applicant does have access to water and sewer. There being no one else wishing to speak further, Mr. Golladay moved to approve the request. This motion was seconded by Mr. Stiles. BE IT RESOLVED, That the Frederick County Planning Commission does hereby recommend approval to the Board of Supervisors for Rezoning Request #008 -82 of Eldon Lindsey to rezone 9.519 acres from A -2 (Agricultural - General) to B -2 (Business - General) for an office park in Opequon Magisterial District. The above resolution was passed unanimously. SITE PLANS Site Plan Request #015 -82 of All Points Warehousing, zoned M -1 (Industrial- Limited), for the construction of warehouse facilities, 1616 a 15' x 24' office, a new entrance, and new vehicle maneuvering facilities. ACTION - Approved Mr. Horne read the background information. Mr. Thomas Baker came forward and introduced himself to the Commission. Mr. Baker explained that the buildings will be constructed as they are needed. In reply to Chairman Brumback's question, Mr. Baker stated that there will be approximately 40,000 square feet of available space. He explained that the buildings will consist of 28 -30 cubicles with concrete floors. Mr. Baker noted that he would be tending the operation for the present time. In answer to Mr. Stiles' question, Mr. Baker replied that he understood that a resident manager was not permitted. Mr. Stiles expressed concern about run off. Mr. Horne explained that he was satisfied with the erosion control measures proposed and felt that these measures would slow down the rate of run off. Mr. Horne noted that the large drainage easement will empty into Ash Hollow Run. There being no one wishing to speak further, Mr. Stiles moved for approval. This motion was seconded by Mr. DeHaven. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #015 -82 of All Points Warehousing, zoned M -1, to construct warehouse facilities, a 15' x 24' office, a new entrance, and new vehicle maneuvering facilities in the Stonewall Magisterial District. The above resolution was passed unanimously. 1617 Site Plan #016 -82 of Arthur H. Fulton, zoned M -2 (Industrial - General) to construct an office addition, additions to repair facilities, a new entrance, and new parking facilities in the Opequon Magisterial District. ACTION - Approved The Secretary gave the background information. Mr. Arthur Fulton, owner of Arthur H. Fulton, Inc., came forward and introduced himself to the Commission. Mr. Fulton stated that the directors of his company wanted to address three problems: First, they were out of space; second, they had a safety hazard because their trucks could not get off Route 277 quickly enough; and third, water came into the tractor shop when it rained. Chairman Brumback asked if anyone wished to speak in favor or opposition to the request and no one came forward. Mr. Golladay moved to approve the site plan and this motion was seconded by Mr. Palumbo. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve Site Plan #016 -82 of Arthur H. Fulton, zoned M -2 (Industrial - General), to construct an office addition, additions to repair facilities, a new entrance, and new parking facilities in the Opequon Magisterial District. The above resolution was unanimously passed. DISCUSSION OF COMPREHENSIVE PLAN The Subcommittee presented the package of policies for the Comprehensive Plan to the Commission. Mr. Horne commented that the policies would be presented to the Board of Supervisors in this same format. Mr. Golladay suggested a worksession with the Board of Supervisors to discuss the policies and the effect of these policies on future ordinance changes. 1618 Mr. Stiles felt that in the near future the Commission would need to look at industrially zoned land in the County. Mr. Stiles felt it was becoming apparent that the undeveloped, industrially zoned land in the Gilpin and Stine Parks and the Industrial Development Corporation land in Kernstown was not the most desirable land for anyone wishing to locate in the area. Mr. Stiles felt the Commission should extend some industrial zoned land into areas not currently zoned for industry. Mr. Stiles commented that in order to help pay for a sewage treatment plant some industrial hookups are needed because residential hookups alone cannot pay for an entire plant. Mr. Horne felt that the Economic Development Commission strategies, numbers 5 and 6, in the policy package addressed this issue. Mr. Stiles felt that the EDC could make a recommendation to include a statement to the Comprehensive Plan regarding the expansion of industrially zoned lands. Mr. Palumbo next inquired if the special exception permit system was approved under the rural land use strategies. Mr. Stiles replied that the concept had been endorsed, but the real struggle will come about when rules and regulations are being set up. SCHEDULED WORKSESSION The Commission set the next worksession dates for September 28, 1982 and October 12, 1982. 1619 SITE PLAN POLICY DISCUSSION The Commission briefly discussed the administrative approval of site plans. Mr. Stiles asked the staff to make a recommendation to the Commission regarding this. DISCUSSION OF SLUDGE IN FREDERICK COUNTY Mr. Stiles commented that the apple processors and the town of Stephens City are dumping sludge in Frederick County without the official consent of the County. Mr. Stiles expressed concern about the contamination of ground water by sludge. He felt that the Commission needed to establish a policy whereby the County could have some input. Mr. Horne commented that the apple processors must adhere to a tremendous number of tests established by the State Water Control Board before they can dump waste. He further commented that the Health Department receives the test results and if there is a potential hazard, they will check on it. Mr. Horne added that the staff could possibly arrange a seminar on the subject in order for the Commission to become better informed. Mr. Sluder stated that as of January 1, 1983, a permit will be required to dump sludge and the sludge must be dumped in an approved area. UPCOMING SEMINARS Mr. Gyurisin announced a seminar on October 3 and 5 by the Virginia Citizens Planning Association and a Rural Planning Caucus conference in Charlottesville on October 21 and 22. Mr. Gyurisin asked that anyone wishing to attend to please contact the office. 1620 ADJOURNMENT There being no further business to discuss, Mr. Golladay moved to adjourn.
