FREDERICK COUNTY PLANNING COMMISSION
Held in the Board of Supervisors' Meeting Room, June 16, 1982
PRESENT: Frank Brumback, Chairman; James M. Golladay, Vice - Chairman;
Carl M. McDonald; M. Domenic Palumbo; Kenneth Stiles; A. L.
Myers; Manual DeHaven; W. French Kirk
ABSENT: George L. Romine
CALL TO ORDER
Chairman Brumback called the meeting to order. The first
order of business, consideration of the minutes of June 2, 1982.
Mr. Myers noted that on page five, line seven, should read
"...what the owner /operator of the particular store..."
There being no further corrections, Mr. Myers moved for
approval. This was seconded by Mr. Kirk and passed unanimously.
Mr. Horne next presented a preliminary plan for subdivision
development in the Opequon Magisterial District submitted to the
staff by Mr. Fred Glaize, III and Mr. James Bowman. Mr. Horne stated
that the presentation does not require action by the Planning
Commission; however, before the owners go to the time and expense of
drawing road profiles and final site plans, they wished to have the
Planning Commission review the design for any problems. Mr. Horne
explained that this will be a very large subdivision with areas
designated for parks. The subdivision does reflect new subdivision
road standards with 50' right of way roads except for the central
road which is a 60' right of way. Mr. Horne noted that the property
is located on Route 647 on the Mobile property. Mr. Horne further
stated that both the Department of Planning and the Department of
Parks and Recreation have been working with the developers on the
overall design.
Mr. Glaize, part owner, and Mr. Bruce Edens, representative
for the developer, were present to answer any questions.
Mr. Stiles asked for the total acreage designated for park
area and Mr. Edens replied that there would be 6.6 acres.
Mr. Golladay asked who would own and maintain the park
area.
Mr. Horne stated that in lieu of the recreational impact
fee, the land would be dedicated to the County. Mr. Horne commented

that a detailed set of conditions would go into the Deed of
Dedication of the subdivision as to what the character (slopes,
grades) of the land will be when the County does take over. He
further commented that the parks will be minimum maintenance.
Some of the members of the Commission were very concerned
with regards to County maintenance of the park areas.
Mr. Edens stated that the parks could be drawn in Section One
of the plans as an option and the Commission could then decide later
whether they preferred money or land for the impact fee.
There next ensued a discussion on the water runoff and
drainage for the subdivision.

Mr. Gyurisin explained the variance applications reviewed
at the June 15, 1982, Board of Zoning Appeals meeting.
Discussion of Rural Land Policies
Mr. Horne stated that the Comprehensive Plan Update
Subcommittee has approved the rural land policies as presented,
based on a set of underlying understandings as to the ultimate
details of this type of land regulation system.
Mr. Stiles felt that two statements should be included in
the agricultural preservation section of the rural land policies; one
dealing with the protection of property owner's rights and another
stating that agricultural land preservation should be voluntary and
on the part of the landowner. Mr. Stiles further stated that he
agreed with the underlying understandings listed in the memorandum,
but the majority of people at the public meetings disapproved of more
restrictions.

After much discussion, the majority of the Commission felt
that the agricultural preservation section needed to be reworked and
made less restrictive.
Chairman Brumback next turned the Rural Land Use Policies
back to the Subcommittee without the Commission's endorsement until
the agricultural section could be reworked.
Discussion of Urban and Suburban Land Policies
Mr. Horne stated that the Comprehensive Plan Update
Subcommittee has approved the urban and suburban land policies as
presented.
There next ensued a discussion on whether a broad statement
of intent should be added to the policies stating how the County
envisions its urban and suburban development for the future. The
Commission concluded that all of the policy statements combined
sufficiently outlined the County's philosophy on future development.
Mr. Palumbo then moved for endorsement of the policies as
presented. This was seconded by Mr. Kirk and passed unanimously.*
BE IT RESOLVED, That the Frederick County Planning Commission
does hereby endorse the Comprehensive Plan Policies for Urban and
Suburban areas presented by the Comprehensive Plan Update Sub-
committee.
Discussion of Comprehensive Plan Schedule
Mr. Horne stated that he will have a package of infor-
mation, in fairly complete form, ready in August to submit to the
Board of Supervisors. Mr. Horne added that it will contain the outline
of the text and the actual chapters for the Comprehensive Plan.
Mr. Horne next reviewed each individual chapter in order to bring the

Commission members up to date on what has been completed and what yet
needs to be done.
Adjournm
Mr. Gollady next moved for adjournment. This was seconded
by Mr. DeHaven and passed unanimously. **
