PRESENT: Frank Brumback, Chairman; James Golladay, Vice Chairman; Carl M. McDonald; M. Domenic Palumbo; Kenneth Stiles; A. L. Myers; Manuel DeHaven; W. French Kirk ABSENT: George L. Romine CALL TO ORDER Chairman Brumback called the meeting to order. The first order of business, consideration of the minutes of April 21, 1982. Mr. Golladay moved to approve the minutes as presented. This was seconded by Mr. Kirk and passed unanimously. The Commission Retires to Executive Session Upon motion made by Mr. Golladay, seconded by Mr. Kirk and passed unanimously *, the Frederick County Planning Commission does hereby retire into executive session in accordance with Section 2.1- 344(a)6 to discuss legal matters. The Commission Withdraws from Executive Sessi Upon motion made by Mr. Golladay, seconded by Mr. Kirk and passed unanimously, the Commission withdrew from executive session. Monthly and Bimonthly Repo In response to Mr. Golladay's question, Mr. Horne stated that McDonald's Corporation is having problems with regard to the *Mr. Stiles was not present for this vote. 1537 -2- acquisition of land and, therefore, temporarily withdrew their application. Mr. Gyurisin next explained the variance applications approved by the Board of zoning Appeals. SITE PLANS Site Plan No. 003 -82 of Shockey Realty Co. Land, zoned M -2, in the Stonewall Magisterial District. ACTION - Approved The Secretary read the background material. Mr. Horne located the area to be developed on a map. Mr. Horne stated that this will be a light manufacturing facility for a furniture manufacturing plant. Chairman Brumback asked for the total area of the property and Mr. Horne replied that the original proposed building is 50,688 square feet, the proposed expansion to the rear is 13,824 square feet, the large tract being developed is 4.271 acres and Shockey is proposing to add another one or one and a half acres. Mr. David McClure, Architect for Howard Shockey and Sons, came forward and introduced himself to the Commission. Mr. McClure stated that the total acreage is seven acres and the rear part of the building is a warehouse. Mr. Golladay asked if Shockeys planned on developing the whole building at one time. Mr. McClure indicated on a map which parts would be constructed immediately. 1538 -3- In reply to Chairman Brumback's question, Mr. McClure stated that there were no plans for future development on the property except for the possible expansion of the building. In answer to Mr. Golladay's question, Mr. McClure stated that Shockey Realty Co. would own the building and lease it to a local furniture manufacturing company, Dovetailed Industries. In reply to Mr. Palumbo's question, Mr. McClure answered that the company is presently in existence and the product they manufacture is kitchen cabinets. He added that the company plans on having 50 employees. Chairman Brumback next inquired as to Shockey's time table for the building. Mr. McClure explained that they would start within the next week. He added that the area should be stabilized and graded by September or October. Mr. Golladay commented that when this area was being rezoned, there was a problem regarding entrances. Mr. Golladay inquired if this would effect Shockeys. Mr. Horne explained that the entrance issue had been resolved and would not effect Shockeys. Mr. Horne stated that the only entrance for this site is on Lee Avenue. In response to Mr. Stiles' question, Mr. Shockey stated that the house on the property would be torn down in the near future. Mr. DeHaven was concerned about the number of buildings on the tract and Mr. Horne stated that under the M -2 regulations there is a 50% coverage regulation which Shockey is very close to now. Mr. Horne stated that this would limit the amount of expansion on the tract as it exists now. 1539 -4- Mr. Palumbo asked if the truck areas would be paved and Mr. Horne replied that they would be. There being no one present wishing to speak further, Mr. DeHaven moved for approval. This was seconded by Mr. Stiles and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve site plan no. 003 -82 of Shockey Realty Co. Land, zoned M -2, in the Stonewall Magisterial District. PUBLIC HEARINGS Conditional Use Permit No. 007 -82 of Stephen & Sue Culbert, Jr. for a home occupation for silk flower arrangements in the Shawnee Magisterial District. ACTION - Approved The Secretary read the background information. Mrs. Peggy Dollar came forward, stated that she was Mrs. Culbert's daughter and would be representing Mrs. Culbert. Mrs. Dollar stated that this is a service that Mrs. Culbert is offering, mostly to weddings and people who call for arrangements. She added that this would not be a retail operation. Mr. Stiles questioned why Mrs. Culbert needed a conditional use permit since her operation would not be retail. Mr. Horne stated that he had explained to Mrs. Culbert that a permit was not needed, but she had still requested one to be secure so there would be no question about her right to operate. Chairman Brumback asked if there was anyone in the audience wishing to speak in favor or opposition to this request. No one came forward. 1540 -5- Mr. Kirk next moved to approve this conditional use permit with conditions. This was seconded by Mr. DeHaven and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve conditional use permit no. 007 -82 of Stephen & Sue Culbert, Jr. for a home occupation for silk flower arrangements, in the Shawnee Magisterial District with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission and Board of Supervisors. 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. No one except members of the immediate family residing on the premises shall be employed. 4. On site parking shall be provided. Conditional Use Permit No. 008 -82 of Gilbert C. Mills for re- establishment of a nonconforming use for a sawmill in the Opequon Magisterial District. ACTION - Approved The Secretary gave the background material. Mr. Mills came forward and stated that he would like to operate three days a week. Mr. Golladay inquired as to how much lumber was sawed previously, on an average. Mr. Mills answered that about 2500 feet /day was sawed during the hours from 8:00 a.m. to 5:00 p.m. Mr. Mills added that the operation would be for his own fencing business with occassional sawing for his neighbors. 1541 In reply to Mr. DeHaven's question, Mr. Mills stated that the mill has always been located at this site, however, he had stopped using it for a couple of years. There next ensued a discussion of the staff recommendations for this permit. Chairman Brumback next asked if there was anyone who wished to speak in favor or opposition to this request. Mr. Leon Strosnider, an adjoining property owner, came forward and stated that he had no objection to the mill. Mr. Strosnider stated that he was in favor of the mill because it benefits the neighbors and there is no noise. Mr. John Paul next came forward and stated that he was in opposition to the permit. Mr. Paul stated that Mr. Strosnider currently has his property on the market for sale. Mr. Paul next summarized the events which have taken place so far in regard to the Mills' application. He then read Article 19, Section 21 -150, Zoning Regulations for a non- conforming use. Mr. Paul next related the changes he has noticed taking place on the Mills' property. Mr. Paul was concerned that the use of the mill would increase rather than. remain the same or less than previously. Mr. Paul commented that Mrs. Mills had informed Mr. James Cross, a neighbor next door, that one of the members of the Planning Commission who had-visited the site told her that with a slight revision to the application there would be no problem of having the permit issued. Mr. Paul next stated that the following other property owners have given him permission to voice their opposition, Mr. Lewis, Mr. Ron Sowers, and Mr. C. W. Huntsberry. 1542 -7- Mr. Paul commented that Mr. Huntsberry stated that he backed off the issue of Mr. Strosnider's conditional use permit for a firing range. Mr. Paul commented that Mr. Huntsberry told him that Mr. Strosnider came over to his property and inquired if he was the one who objected to the permit. Mr. Strosnider pulled from his truck cab what Mr. Huntsberry described as a "billy club ". Mr. Paul then stated that Mr. Strosnider said, "if I don't get my firing range, somebody's going to suffer ". Mr. Stiles next moved to make the letter submitted by C. W. Huntsberry a part of the official record. This was seconded by Mr. Golladay and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby include the letter from Mr. C. W. Huntsberry in the official minutes, as follows: May 5, 1982 Charles W. Huntsberry, Jr. Route 1, Box 156 -B Stephens City, Virginia 22655 Frederick County Planning Commission Attn: BOARD OF ZONING Dear Sir: I am a property owner in Frederick County, Virginia with a home located on Route 641. It is my feeling that the operation of a sawmill by Mr. G. C. Mills on property within 1/2 mile of my home will adversely effect both the real value of my land and the tranquility of my dwelling. Therefore, I urge you to deny Mr. Mills' request for a zoning variance and not permit him to operate the sawmill. Sincerely, Charles W. Huntsberry, Jr. Chairman Brumback next called for anyone wishing to speak in rebuttal. 1543 Mrs. Joyce Mills came forward and denied making comments that Mr. Paul stated she made. Mr. Strosnider came forward and stated that he is selling his home, but he will be building a home right up the road. Mr. Strosnider added that Mr. Paul's statement on the threat to Mr. Huntsberry is not true. Mr. Gilbert Mills came forward and stated that Mr. Paul is not an adjoining property owner. He also stated that Mr. Paul had his figures wrong regarding the amount of lumber he has processed previously on the property. Mr. Golladay next moved to approve conditional use permit no. 008 -82 of Gilbert C. Mills with conditions. This was seconded by Mr. DeHaven and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve conditional use permit no. 008 -82 of Gilbert C. Mills for the re- establishment of a non - conforming use with the following conditions: 1. Adequate screening be placed around the milling operation by placing a six foot opaque fence around the mill or by enclosing two or three sides of the milling operation structure or by the planting of trees. 2. That re- establishment be based upon the previous record of materials the mill processed at the site. 3. Hours of operation shall be limited to weekdays, Monday through Saturday from 9:00 am to 5:00 pm with no night or Sunday hours. 4. This permit is limited to the applicant's own fencing business and incidental sawing for his neighbors. 1544 Conditional Use Permit No. 009 -82 of Cohoka Corporation for a Recreational Fun Cart Track in the Back Creek Magisterial District. ACTION - Approved The Secretary gave the background information. Mr. Richard Kaylor, representative for Cohoka Corporation, came forward. Mr. Kaylor stated that the track will be about 1 1/10 mile in circumference. He noted that all areas will be graded and seeded. He also noted that every effort will be made to keep the noise level down. In answer to Chairman Brumback's question, Mr. Kaylor stated that the track will accomodate 30 cars, but he will only be purchasing 10. Mr. Palumbo voiced concern about the noise. Mr. Kaylor explained that they will be using a larger model car and the noise will not be as great as if a smaller car was used. Also, the cars will not be going very fast. Mr. Kaylor also commented that they plan to operate seven to eight months out of the year and probably will not operate past 9:00 P.M. Mr. Golladay was concerned about night lighting causing problems on Route 11. Mr. Kaylor stated that they will not be using high intensity lighting. Mr. Stiles asked if Mr. Kaylor would have a problem putting in screening, if it was necessary. Mr. Kaylor replied that there would be no problem. Chairman Brumback next called for anyone wishing to speak in favor or opposition to the request. 1545 -10- Mr. Donald Michael with the Division of Motor Vehicles, came forward. Mr. Michael stated that he was at first concerned about the traffic, but since Mr. Kaylor has stated that this is not a competitive operation and everyone will not be leaving or arriving at once, he is comfortable with it. Mr. Michael also confirmed the exact location of the site with the Commission. Mr. Thomas Baker came forward and stated that he was an adjoining property owner. Mr. Baker was concerned because he had received conflicting information on the operation of the fun cart track than what was presented by Mr. Kaylor. He stated he was very concerned about future controls on the site. Mr. Horne commented that the conditional use permit is for a specific use and if Cohoka changes this use, it cancels the permit. Mr. Horne stated that he would have to get another permit to change the conditions or to change to any other permitted use in a B -2 zone. Mr. Thomas Glass came forward and stated that the interchange in question is probably the best tax base in the County. Mr. Glass was concerned that if there were not enough restrictions on the noise level for this area, it would effect the future development of the interchange. Mr. Palumbo next moved for approval with conditions. This was seconded by Mr. Stiles and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve conditional use permit no. 009 -82 of Cohoka Corp. for a Recreational Fun Cart Track in the Back Creek Magisterial District with the following conditions: 1. This be a one year permit to be reviewed annually by the staff, Planning Commission and Board of Supervisors. 1546 -11- 2. If the use, occupancy, or ownership of the property changes, this conditional use permit shall expire and a new conditional use permit will be required. 3. All night lighting be directed away from adjacent properties. 4. Only vault priveys be utilized as per Health Department comments. 5. Noise screening as necessary. Conditional Use Permit No. 025 -80 of Robert S. Hawkins for change of conditions to operate a public garage in the Back Creek Magisterial District. ACTION - Approved The Secretary gave the background information. Mr. Robert Hawkins came forward and stated that he was under the impression that junk vehicles, listed in his conditions, were vehicles not meant to be repaired or vehicles in which pieces are taken off. He stated that all of his vehicles are licensed and have inspection stickers and he has no junk cars. Chairman Brumback next called for anyone wishing to speak in favor or opposition to the request. Mr. Strother Adams came forward and stated that he resides on Route 4, close to Mr. Hawkins. Mr. Adams presented a petition of 51 names and address of people in favor of the request. Mr. Myers next moved to make the petition a part of the official minutes. This was seconded by Mr. Golladay and passed unanimously. Mr. Roland Snapp, adjoining property owner, next came forward and stated that he was in favor of this operation. Mr. Snapp felt that it was not necessary to put any type of screening up. He next stated that a few of Mr. Hawkins' neighbors, who are in favor of this 1550 -15- operation, were present. He next asked those people to stand. (Eleven people stood) Ms. Virginia Hawkins, Robert Hawkins' sister, came forward and stated that all of Robert Hawkins' vehicles are in order and are waiting for parts. Ms. Hawkins felt that Robert Hawkins should be allowed to work if he is able. Mr. Tony Papierniak came forward and noted that Mr. Hawkins' operation is an asset to the local community and he and his wife are both in favor of this application. Mr. Leonard Richard came forward and stated that he was in favor of this operation. Mr. Palumbo next moved to approve the change in conditions to operate a public garage by rewording condition number three. This was seconded by Mr. Stiles and passed unanimously. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the operation of a public garage by Robert S. Hawkins with the following conditions: 1. This be a three year permit which is to be reviewed annually. 2. If the use, occupancy or ownership changes, this conditional use permit shall expire and a new conditional use permit shall be required. 3. There shall be no vehicle of any kind which is incapable of being operated and which would not be economically practical to make operative, placed, located or found on the property. 4. Hours of operation shall be daylight hours. 5. No body or fender work. 6. Off- street parking shall be required. 1551 -16- 7. Required installation of a commercial entrance if it is deemed necessary by the Virginia Department of Highways and Transportation. 8. No one employed on the premises except for members of the immediate family residing on the premises. Mr. Stiles next moved that the tapes for this meeting be kept on file for future reference and not be destroyed. This was seconded by Mr. Golladay and passed unanimously. Ordinance Amendments Upon motion made by Mr. Stiles, seconded by Mr. Golladay and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: An ordinance to amend the Frederick County Code, Chapter 18, Subdivision of Land, to amend Article III, Design Standards, Division 5, Streets, Section 18 -46.1, Minimum Width, as follows: /r The minimum width of proposed streets, measured from lot line to lot \ line, shall meet the Virginia Department of Highways and Transportation Subdivision Street Requirements; shall be approved by the Administrator; and, shall be shown on the preliminary and final J subdivision plats. Upon motion made by Mr. Stiles, seconded by Mr. Myers and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: 1552 -17- An ordinance to amend the Frederick County Code, Chapter 18, Subdivision of Land, to amend Article III, Design Standards, Division 5, Streets, Section 18 -47, Construction Requirements, as follows: All new subdivision streets shall conform with the Virginia Department of Highways and Transportation Subdivision Street Requirements; shall be inspected and approved by the Virginia Department of Highways and Transportation; and, shall be approved by the Administrator. —' Upon motion made by Mr. Palumbo, seconded by Mr. Kirk and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: An ordinance to amend the Frederick County Code, Chapter 21, Zoning, to amend Article I, Section 21 -1, by the addition of the following: Accessoro Use - A use customarily incidental and subordinate to the main use or building and located on the same lot therewith. In no case shall such accessory use dominate, in area, extent, or purpose, the principle, lawful use of the building, except that vehicle parking areas may be larger than the building area. On bonafide, operating farms, temporary or permanent housing for farm workers actively working on the farm, or tenants shall be considered an accessory use and structure. Accessory Structure or B uilding - A subordinate structure or building located on the same lot with the main building occupied or devoted to an accessory use. Where an accessory building is attached to the main building in a substantial manner as by wall, roof, or floor, such accessory building shall be considered part of the main building for purposes of yard determination. Upon motion made by Mr. Stiles, seconded by Mr. Kirk and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: An ordinance to amend the Frederick County Code, Chapter 21, Zoning, to amend Article III, Section 21 -16, (P), as follows: 1553 (P) Accessory Uses as defined, however, garages or other accessory uses such as carports, porches, and stoops, attached to the main building shall be considered part of the main building. No accessory structure may be closer than 15' to any property line. Upon motion made by Mr. Stiles, seconded by Mr. Palumbo and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: An ordinance to amend the Frederick County Code, Chapter 21, Zoning, to amend Article III, Section 21 -20, (a), as follows: (a) The minimum side yard for each main structure shall be 15' and the total width of the two required side yards shall be 35'. Upon motion made by Mr. Stiles, seconded by Mr. Kirk and passed unanimously, the Commission approved the ordinance amendment as presented. BE IT RESOLVED, That the Frederick County Planning Commission does hereby approve the ordinance to amend the Frederick County Code as follows: An ordinance to amend the Frederick County Code, Chapter 21, Zoning, to amend Article IV, Section 21 -26, (o), as follows: (o) Accessory Structures as defined, however, garages or other accessory structures such as carports, porches, and stoops, attached to the main building shall be considered part of the main building. No accessory structure shall be closer than 15' to any property line. Discussion of Secondary Road I Plan Projects The Commission discussed funds available for construction /improvement of roads in the County. The Commission also discussed which roads should receive priority. 1554 -19- Mr. Palumbo next read a letter to Mr. Frank Brumback, Chairman of the Frederick County Planning Commission, from the Stonebrook Citizens Association. Mr. Stiles moved that this letter be referred to the Comprehensive Plan Subcommittee. This was seconded by Mr. Kirk and passed unanimously. Middletown Compactor Complaint Mr. Golladay stated that he has received several complaints about the compactor at Middletown Scales. Mr. Golladay stated that people have complained that trash was blowing through the field and over to Route 81. Mr. Golladay requested that Mr. Horne pass this information to Mr. Harriman, Public Services Director. There being no further business to discuss, Mr. Golladay moved to adjourn.
